Useof BodyWorn Video PolicyDocument

Background

NewcastleUniversityEstatesSecurityService is committedtomaximisingits effectivenessintacklinganti-social behaviour,reducingcrimeanddisorder and maintainingasafe, secure environmentfor staff, studentsandmembers ofthepublic whilst onUniversityproperty.

In support ofthis strategy, BodyWornVideo(BWV) technologyis beingintroducedfor use bysecuritystaff for operational purposes.

Aims

TheintroductionofBWVis to:

•Reducecrimeanddisorder

•Reduceanti-socialbehaviour

•Provideasafeandsecure environment

•Reducepotential escalation ofincidents

•Augmentopportunitiesfor evidencecapture

General Principles

ThegeneralprinciplesregardingBWVare asfollow:

•BWVwill onlybeusedwhen operationallynecessaryin supportofthe aimsoutlined above.

•Anyuse ofBWVasanoperational tool byfrontline staffmustbejustifiableand proportionatetotheissueathand.

•IfBWVis usedthen careful considerationmust begiventotheuseofa comprehensive strategyto complywith‘fair processing’ ofrecordedinformationwithin thetermsoftheDataProtection Act(DPA) 1998. The basic legal requirement is to comply with the DPA, however the Estate Security Section also considers their obligations in the wider legislative environment with relation to;

Human Rights Act (HRA) 1998, Freedom of Information Act (FOI) 2000 & The Protection of Freedom Act (POFA) 2012 - including Home Office Surveillance Camera Code of Practice pursuant to Section 30 (1)(a) of FOPA 2012.

In order to maintain good practice, the Estate Security Section will use BWV as advised by the Information Commissioners Office (ICO) Code of Practice for Surveillance Cameras & Personal Information 2014.

•Anyuse ofBWVshould beconsideredalongside prevailinginteractionandimpact on staff,studentsormembers ofthepublic thatmaybepresent.

•StandardOperatingProcedures (SOPs) thatclearlydemonstrateacceptable usageof BWVwill beavailableto all users (frontlineandmanagement) atall levels ofrecording, datastorageanddata retrieval.

•EstateSecurityService Staffaretocomplywiththis Policydocument and SOPs when gatheringevidence or information,ensuringthequalityandintegrity ofthatevidence or information.

•ThisPolicy documentandassociatedSOPsmustbefollowed atanyincidentwhereBWVisor hasbeenused.

•EstatesSecurityServicehasaBWVevidencemanagement system.This systemwill ensurecomplianceofall relevantlegislationandprovideafull audittrail maintaining evidential continuity.

•SecurityStaffwill use the equipmentinlinewiththisPolicydocument and SOPs.They will receivefull instructioninitsuseandtherelevantlegislation.

•All staffwill use the equipmentinlinewith Estates SecurityServicerisk assessment.

•All frontlinesecuritystaffwill havefull trainingfromanidentifiedadministrator or lead beforeusingBWV.These staffwill receivetheir own copyofthis PolicydocumentandSOPs andwill confirm their receipt,reading andunderstanding ofthese documents after which,theywill beauthorisedtousetheequipment.

•BWVarchivedfootagewill notroutinelybeviewedformisdemeanoursor unlawful acts committed byusers,butifacomplaintis received,interrogation ofthe systemis an appropriatelineof enquiryandmaybeinstigated.

•All requestsfor reviews mayonlybeactionedontheauthorityoftheSecurityManager or appointeddeputy.

•EstatesSecurityServicerisk assessmentwillbeproducedtogive guidanceonthe use ofBWVandassociated equipment.Thismust beusedinconjunctionwith otherGenericrisk assessments. All trainedstaffwilluse theequipmentinlinewith published risk assessments.

•EstatesSecurityServiceManagementwill monitor theuseofBWVtoensurethe equipmentisanappropriatetool andthatitsuse is inlinewiththisPolicyand procedures.

FinancialImplications

All costs relatingtothedeploymentand useoftheBWVequipmentwill bethesole responsibilityofthe EstateSecurityService.

Review

Thisdocumentistobe reviewedinthelightof anylegal andprocedural changes to ensurethatthe useofBWVisappropriatetothe Estates SecuritySectionaims.

Additionally,a tri-annualreview will take place to updatethePolicyas/ifrequired.
