GENERAL TERMS AND CONDITIONS

1.0 PREFACE

1.1 Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara invited sealed competitive bids from the bonafied manufacturer or his authorised dealer for the following in adherence to the detailed specifications stipulated in the schedule of this tender.

1.2 The Managing Director, Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara reserve the rights to accept or reject any or all the tenders in full or part thereof, which in his opinion justifies such action without further explanation to the tenderers.

2.0 TENDERING PROCEDURE

IMPORTANT NOTES

1)  All things remaining same, the manufacturer of equipment would be given preference.

2)  Due favorable consideration and preference would be given to a manufacturer who has manufactured and supplied equipment of capacity tendered or of higher capacity preferably to a Dairy Cooperative of Repute Operating Modern Composite Milk Plant and such equipment should have satisfactorily performed.

2.1 The tenders should be sent by Registered Post with acknowledgement due so as to reach the Managing Director, Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara not later than the time and date mentioned in the NIT/Special Note. Alternatively the tenderer or their agent can also submit their tenders personally at the office of the Managing Director, Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara.

2.2 The tender must be submitted in the three envelops method as specified in special note.

2.3 The tender thus prepared should be put in properly sealed double cover and super scribed giving the tender reference number, description of the item and date of opening. The covers should bear address of Managing Director, Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara. Only one tender should be kept in cover. In case more than one tender is kept in a cover, all the tenders thus kept shall be liable to be ignored.

2.4 No responsibility shall be taken for the premature opening of the tender which is not properly addressed and identified.

2.5 No telegraphic/telephonic/telex/fax/email tender shall be considered. However, any amendment sent by telegram/telex/fax to the tender already submitted shall be considered. Provided it is received before the date and time for opening of the tender and it is confirmed in writing by post.

2.6 LEGAL COMPETENCY OF SIGNING THE TENDER

Individual signing the tender or other document connected with this tender must specify whether he sign as :

a)  “Sole Proprietor” of the firm of constituted attorney of such proprietor.

b)  The partner of the firm, if it is a partnership firm in which case, he must have authority to refer to arbitration disputes pertaining to business of the partnership either by virtue of the partnership deed or by holding the power of attorney.

c)  Constituted attorney of the firm, if it is a company.

Note:-

1) In case of (b) above, a copy of the partnership deed or general power of attorney duly attested by a notary public should be furnished or an affidavit on stamp paper of all the partners admitting execution of the partnership deed or the general power of attorney should be furnished.

2) In case of partnership firms, where no authority to refer disputes concerning to the business of the partnership has been conferred on any partner, the tender and all other related documents must be signed by every partner of the firm.

3) A person signing the tender form or any documents constituting an integral part of the contract, on behalf of another shall be deemed to warranty that he has authority to bind such other and if, on enquiry it appears that the person so signing has no authority to do so, the JSMUL, Raniwara may without prejudice to other civil remedies terminate the contract and hold the signatory liable for all cost and damages.

4) JSMUL, Raniwara shall have the fullest liberty to notify the defaulting firm to Business/Trade Association/Public Sector undertakings/ Autonomous bodies and the like about the default and breach of contract committed by a firm giving out names of the partners of the firm. A register is indented to be maintained for such defaulting firm and their partners.

2.7 EARNEST MONEY DEPOSIT

2.7.1 Earnest money amounting to Rs. 55,000/-(Fifty Five Thousand only) must accompany the tender. The earnest money shall be required to be paid through NEFT or by a crossed demand draft. The tenders accompanied by cheques instead of demand draft towards earnest money will not be considered.

For DD : Demand draft should be in favour of “Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara”, drawn on any nationalized bank in India or any Cooperative bank in Raniwara, payable at Raniwara. The tenders accompanied by cheques instead of demand draft towards earnest money will not be considered.

2.7.2 Any tender which is not accompanied by earnest money deposit will be summarily rejected. Earnest money of unsuccessful tenderer will be returned with 120 clear days from opening of the tender.

2.7.3 No interest shall be paid for the earnest money deposite for the period during which it(the earnest money) lies it deposit with the Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara. The earnest money in respect of the successfully tenderers shall get converted into the security amount to be retained by Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara for the period of contract including extended period, if any. No. interest shall be paid on this security deposit. If require an additional appropriated amount on the part of security money required to be deposited by contractor.

2.8 The tenderers should state herein the complete address to which the orders, notice and further correspondence pertaining to the tender and agreement are to be sent. Any correspondence made by the Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara at the address given herein shall be deemed to have been delivered to the party. Any change in the address thereafter must be noticed to the Managing Director, Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara and having recorded change in address be obtained in writing from Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara. In absence of such confirmation the correspondence is issued by Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara subsequent correspondence shall be sent to the new notified address.

2.9 The tenders received shall be opened on the date and time given in the NIT at the office of the Managing Director, Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara. The tenderers or their accredited agents will be present at the time of opening of the tender.

2.10 Negligence on the part of tenderer in preparing the tender confers no right to withdraw the tender after it has been opened.

2.11 The specification, conditions, schedules drawing of the tender constitute an integral part of the tender.

2.12 All tenders in which any of the prescribed conditions are not fulfilled or which have been vitiated by errors in calculations, totaling or other discrepancies or which contain overwriting in figures or words or corrections no initialed and dated will be rejected.

2.13 In the place of substantial now conformity with the terms and conditions in the tender documents as a whole or if is contains any inadmissible reservations seen or otherwise, in contravention to the spirit and letter of the tender documents, such tenders shall be summarily rejected.

2.14 The tenderer whose tender is accepted (hereinafter called the supplier/contractor) will be required to furnish security of 5% of the contracted value (F.O.R. site) for the due fulfillment of his contract in the form of a Demand Draft/Bank Guarantee of a nationalized bank or any Cooperative bank in Raniwara drawn in favour of Jalore-Sirohi Zila Dugdh Utpadak Sahakari Sangh Limited, Raniwara is to be submitted within a period of 15 days from the date of placement of Purchase Order. The EMD amount shall be adjusted in the aforesaid security.
