Charges will be exerted on a cost per sq. meter basis. While it would be a basic requirement of all road opening permits that trench widths are as narrow as possible, all trenches of 1 meter in width or less, shall be regarded asbeing 1 meter wide for the purpose of calculation of charges. For trenches of greater than 1 meter in width, theactual width will be assumed for calculation purposes. Fifty per cent (50%) of the fee may be refundable after a period of two years, where the work complies with the Louth CountyCouncil standards and specifications. The remainder will be retained by the Council as a maintenance & Long Term Damage charge and is non-refundable.

Note: These charges apply to longitudinal and transverse openings.

LARGE SCHEMES: The Local Authority reserves the right to review charges for large schemes.

REDUCTIONS TO CHARGES: If road openings are completed prior to Local Authority overlay worksthen a reduction in fees may apply at the discretion of the Local Authority.

PENALTIES: If road openings are carried out within 5 years of Local Authority new roadway or footpath works thenpenalties may apply at the discretion of the Local Authority. Penalties will generally involve either full roadwidth or half road width reinstatement and/or an additional road reinstatement charge. These works are notified to all statutory authorities in advance of our roadwork’s and all bodies are invited to upgrade services before the re-surfacing begins annually.

FULL WIDTH ROAD REINSTATEMENT: Full width road reinstatement may be agreed / required by Louth County Council in certain circumstances (e.g. narrow roads, roads with poor baseor sub-base courses).

  • A road opening may only be carried out under licence by Louth County Council.
  • The administration of road opening applications on national roadsfor electronic Communications falls to the NRA. If works are required on theNATIONAL ROADfor Electronic Communications the applicant shall liaise directly with the NRA via email .
  • Provided all documentation is submitted, a period of 2 weeks should normally be allowed for processing any application.
  • A licence will expire 3 months after the granting of same.
  • The licensee must provide evidence of up to date insurance which specifically covers the nature of the works being undertaken and specifically indemnifies Louth County Council against all losses and claims that may result from such works. Theminimum level of indemnity required:

Public Liability:€6,400,000.00

Employers Liability:€12,700,000.00

The Employers Liability and Public Liability must be stand alone policies which operate independently of any other insurance policies.

  • Any opening or excavated material shall be kept adequately protected, signed and marked with warning lights during the hours of darkness until the temporary restoration is complete.
  • A copy of the licence must be kept on site at all times for inspection.
  • The applicant & contractor responsible for the proposed works shall ensure fulfilment of their respective responsibilities in accordance with the Safety, Health & Welfare at Work Act 2005 and the Safety, Health & Welfare (Construction) Regulations 2006.
  • Louth County Council must be notified on completion of final reinstatement. See attached completion notice
  • In the event of the failure of a reinstatement within a period of two years from the date of execution, or other licensee, shall renew the reinstatement to the satisfaction of the Council within a specified period, otherwise the work shall be carried out by the Council and the expenditure recovered from the Licensee, in the first instance deductible from the initial charge.
  • If after a period of two years, the road or footpath has not failed, the road or footpath shall become the responsibility of Louth County Council and any refund due shall be made at that time.
  • Where the original reinstatement has failed and remedial works have been carried out by the Licensee, the Council shall accept responsibility for future maintenance after a further period of two years provided the reinstatement is of a satisfactory condition.
  • Where the Council carries out remedial work to a failed reinstatement, the responsibility for future maintenance shall fall to the Council forthwith.
  • No works are to be carried out until the applicant is in receipt of a road opening licence, which will be posted to the applicant’s address.
  • Once the licence has been issued, notice of three working days must be given to the Roads Section before any work commences.
  • Work shall only be carried out between 08.00 and 17.00 hrs, unless agreed with Area engineer.
  • The applicant shall be liable for any cost incurred by the Council resulting from supervision of the works or damage to Council property resulting from the works

Specifications

  1. All works to Public Roads, Footpaths and Grassed Areas are to be carried out in accordance with “Specifications for Road Works” issued by the Department of the Environment & Local Government, unless specifically stated otherwise and in accordance with the requirements of LCC.
  1. A road-cutting saw shall be used for cutting straight edges prior to excavating through roads and/or footpaths.
  1. Joints in asphalt and macadam roads and footpaths are to be sealed vertically and horizontally (as shown in drawings) with hot bitumen.
  1. Where an opening is made through concrete kerbs, replacement kerbs shall be laid to Clause 1101, Department of the Environment & Local Government Specification (in the case of pre-cast kerbs) and to Clause 1104, DOE & LG Specification (in the case of in-situ kerbs).
  1. Where an opening is made through limestone/granite flags, the flags shall be carefully removed by hand prior to excavation work, and shall be re-laid in the proper manner as agreed with DBC. Any limestone/granite flag damaged in the course of the works shall be replaced by limestone/granite flags, and not by any other flag or material.
  1. Where an opening is made through a paved area, the paviors shall be carefully removed by hand prior to excavation work, and shall be re-laid in a proper manner as agreed with LCC. Any paviors damaged in the course of the works, shall be replaced by paviors of identical size and colour, and not by any other pavior.
  1. Any pre-cast concrete/granite flags damaged in the course of the works shall be replaced by flags of exact size and colour.
  1. Where an opening in a concrete footpath crosses a vehicular access or driveway, the depth of concrete shall be 150mm and not 100mm as applies elsewhere on concrete footpaths, and shall be reinforced with mesh.
  1. It shall be the responsibility of the Licensee to liaise with the public utilities and ascertain the existence of underground services, and to take all reasonable care in the protection of the said services, as specified by the relevant Authority. The applicant shall be held responsible for any damage caused during such works.
  1. Where the Public Utility proposes to carry out an opening through what it considers to be a sub-standard road or footpath, the condition of the said road or footpath shall be brought to the attention of Louth County Council prior to any works.
  1. If an opening is made in a footpath, then the full widthand full length of the affected bays of the path shall be restored in accordance with the requirements of Louth County Council.

Should the answer be yes to any of the above the applicant is required to submit a detailed traffic management plan in accordance with Chapter 8 of the Traffic Signs Manual. The plan must detail all necessary measures that need to be in place to facilitate the safe flow of traffic including pedestrians.

The licensee is also required to notify fire, ambulance, Gardaí and public transport services of any proposed disruption to traffic routes within a reasonable time frame by fax:

A detailed map should accompany the traffic management plan showing clearly the locations of signage in accordance with the Traffic Signs Manual. This map should be clearly legible and please note that sketches are not acceptable.

I hereby undertake to light, watch and fence properly, the said road where broken open and to take all necessary precautions to prevent injury to the public and interruption of traffic from the commencement of the work until final completion and to remove all rubbish and to restore all parts of the road to the same good condition as theretofore without delay & to your satisfaction. I also undertake to fully investigate & protect existing Utilities and obtain from the appropriate Bodies separate permission for any disturbances. I hereby further undertake to keep Louth County Council and its officers indemnified against all actions, proceedings, claims and demands on the part of any person or persons whomsoever and against all costs and damages and expenses whatsoever by reason of or on account of the works herein mentioned or otherwise in relation thereto.

I hereby accept the Conditions under which permission may be granted to break openings on the Public Road or footpath and send herewith the specified fee of €…………….. to be retained by the Council subject in all respects to the said conditions. Fifty per cent (50%) of the above fee shall be refundable after a period of two years subject to the work being carried out in compliance with Louth County Council standards and specifications.
