WHAT HAPPENS NEXT?

The Authority has 28 days from receipt of the notification to respond. You should receive an acknowledgement informing you of the date of receipt. Work cannot begin within the period of 28 days from the date of which the Authority received your notification unless the Authority indicate in writing that the development can proceed sooner. If they do not respond within this 28 day period, then the development can proceed exactly as notified.

If informal discussions take place with the Authority and the original proposal is modified by agreement, there is no requirement to re-notify the Authority. The Authority should give written approval to the modification to make it clear that the modified proposals can proceed.

If the Authority indicates, within the 28 day period, that they require the formal submission of details for approval, work cannot begin until details have been approved by the Authority.

(a)In the event that the Planning Authority are not prepared to approve your proposal and that you are unable to subsequently reach agreement, your proposal does not constitute permitted development and you should not proceed; and

(b)In the above circumstances, the Government has not provided an appeal procedure. To exercise a right of appeal, you are required to lodge an application for planning permission which if granted with conditions or refused, would entitle you to normal rights of appeal to the Secretary of State for Scotland.
