14. General Summary of Function/Purpose of Position
Employees in this job evaluate compliance with state regulations. In accordance with established Department/Bureau/Division policy and procedures, the employee licenses Homes for the Aged and investigates complaints relative to compliance with state regulations. The job requires travel.

Duty 1

General Summary of Duty 1 % of Time 35%
Independently conducts on-site inspections throughout the state to determine applicant/licensee compliance with state licensing regulations for Homes for the Aged.
Individual tasks related to the duty.
·  Reviews and evaluates resident, staff and administrative records to determine compliance with state regulations governing licensure.
·  Evaluates resident care practices and services provided within each facility to determine compliance with state regulations.
·  Evaluates physical plant and dietary services to determine compliance with state regulations.
·  Advise facility representatives of inspection findings, both orally and in writing. Conducts on-site exit conference and prepares correspondence and written reports including all items in violation of state regulations.
·  Reviews, evaluates, and approves or disapproves facility corrective action plans to achieve compliance with state regulations for licensure of Homes for the Aged.
·  Used the Bureau’s established templates to prepare licensing reports.
·  Makes recommendations to supervisor for facility corrective action plans to achieve compliance with state regulations for licensure of Homes for the Aged.
·  Enters all required information into the Bureau Information Tracking System (BITS) database to reflect on-site inspections events.
·  Conducts follow-up inspections, as applicable, to verify implementation of approved corrective action plans.

Duty 2

General Summary of Duty 2 % of Time 35%
Conducts investigations in response to complaint received relative to state regulations for Homes for the Aged, evaluates and determines compliance or violations.
Individual tasks related to the duty.
·  Conducts investigations to determine rule violations and/or compliance.
·  Conducts interviews with facility staff, residents, families, and other relevant persons.
·  Reviews and evaluates appropriate resident, staff, facility administrative or other appropriate records to determine compliance.
·  Evaluates resident care practices and services provided within the facility and physical plant requirements to determine compliance with state regulations.
·  Prepares correspondence and report of investigation findings.
·  Uses the Bureau’s established templates to prepare special investigation reports.
·  Reviews, evaluates, and approves or disapproves facility corrective action plans to achieve compliance with state licensing regulations for Homes for the Aged.
·  Enters all required information into BITS database to reflect required investigation and on-site inspection events.
·  Makes recommendations to supervisor regarding license status to maintain current status or proceed to disciplinary action.
·  Conducts follow-up inspections, as applicable, to determine implementation of approved corrective action plan.
·  Conducts investigations of unlicensed facilities to determine if licensure is required.

Duty 3

General Summary of Duty 3 % of Time 15%
Provide technical assistance to licensees and applicants to achieve compliance with state licensure regulations for Homes for the Aged.
Individual tasks related to the duty.
·  Provides technical assistance to licensees correcting violations and/or clarifying rule requirements relating to state licensure regulations for Homes for the Aged.
·  Provides technical assistance to bureau/division staff relative to Homes for the Aged regulations and processes as needed or requested.

Duty 4

Provides consultation to licensees upon request to improve the quality of care provided to a level over and above what is required by statute and rules.

·  Provides information and identifies resources to assist in developing methods for improvement of service delivery that exceed the minimal requirements and enhance the quality of life of facility residents.

16. Describe the types of decisions made independently in this position and tell who or what is affected by those decisions.
Conducts inspections and complaint investigations of facilities throughout the state requiring independent professional judgment used in making compliance determinations. Decisions usually relate to whether or not regulatory compliance has been achieved by the licensee and that adequate and appropriate care of residents is occurring in accordance to rule and statutory requirements. These decisions directly affect the health, safety and welfare of residents receiving care in the facility as well as the licensee who may experience consequences of state regulatory action if violations are found.
17. Describe the types of decisions that require the supervisor’s review.
Guidance is requested when established policy does not exist or when the inspection protocol does not cover significant issues identified during the course of the inspection or complaint investigation, especially when there are regulatory issues resulting in the request for disciplinary action.

18. What kind of physical effort is used to perform this job? What environmental conditions is this position physically exposed to on the job? Indicate the amount of time and intensity of each activity and condition. Refer to instructions.
The position requires travel to all areas of the state, which may include sitting for extended periods of time and which may require flexible work hours to determine compliance with operational requirements in facilities operating around the clock on a seven-day basis. The position requires physical ability to inspect the physical environment and to observe and evaluate resident care. There is also possibility of exposure to communicable/contagious diseases and infestations.

23. What are the essential functions of this position?
This position is responsible for conducting inspections for licensure and investigations of complaints of Home for the Aged facilities to determine compliance with state licensure regulations.
The primary duties in performing on-site inspections and complaint investigations of Homes for the Aged are to evaluate and determine compliance with licensure requirements, prepare reports of inspection/investigation findings, input relevant licensure information on the Bureau Information Tracking System (BITS) as events occur, provide technical assistance and consultation to licensees/applicants, and be available when requested to provide expert witness testimony before administrative and/or judicial hearings in support of violations as necessary.

The required knowledge for this position in the area of aging has increased due to an increase in resident acuity levels and the various levels of care provided within the industry.
25. What is the function of the work area and how does this position fit into that function?
·  Conducting on-site inspections of licensed facilities and/or applicants for license issuance and/or renewal. There are currently 237 licensed facilities with a wide range of diversity relative to programs, services, population served, and size (beds ranging from 2-399 per facility).
·  Conducting investigations in response to complaints/allegations regarding violations of Homes for the Aged rules.
·  Making evaluations of Homes for the Aged facilities to determine compliance with state regulations and statutory requirements and provide technical assistance as necessary and consultation upon request.
26. What are the minimum education and experience qualifications needed to perform the essential functions of this position?
EDUCATION:
Bachelor’s degree in nursing, gerontology, psychology, social work, and guidance or rehabilitation counseling
EXPERIENCE:
Health Care Surveyor P11-Two years of experience equivalent to a Health Care Surveyor, including one year equivalent to an intermediate level Health Care Surveyor.
KNOWLEDGE, SKILLS, AND ABILITIES:
·  Thorough knowledge of state regulations governing licensure and operational requirements for Homes for the Aged facilities and inspection and review procedures and processes.
·  Ability to make independent judgments regarding violations based on observations, interview, and record review while conducting inspections at Homes for the Aged.
·  Ability to independently review complaints, relate and communicate well with staff and officials of facilities and other agency personnel.
·  Ability to use computer for written correspondence and reports and maintain up-to-date information on the BITS database.
·  Ability to testify effectively in legal proceedings, when requested.
