To approve the General regulations on the submission and examination of the applications of the financial market participants supervised by the Bank of Lithuania for authorizations and on the granting of the authorisations (enclosed).
2. To repeal paragraph 1 of Resolution No 48 of the Board of the Bank of Lithuania of 12 April 2001 on the general requirements for the documents to the Bank of Lithuania that are related to the authorisations (licenses) issued by the Bank of Lithuania (Valstybės žinios (Official Gazette) No 37-1276, 2001).

This legal act lays down the requirements for the submission and examination of the applications for the granting to the financial market participants supervised by the Bank of Lithuania indicated in Article 42(1) of the Law of the Republic of Lithuania on the Bank of Lithuania of the general licenses, permits, consents, approvals, non-oppositions specified in legal acts regulating their activities or to carry out other actions (hereinafter authorisations), and the requirements for other documents submitted to the Bank of Lithuania together with the application, as well as the general procedure of granting the authorisations.

Where laws regulating the activities of the financial market participants supervised by the Bank of Lithuania or other legal acts of the Bank of Lithuania establish the requirements other than those set in these Regulations,or additional requirements for applications and other documents submitted to the Bank of Lithuania together with the application, or a different procedure for the submission and examination of applications and for the granting of authorisations, the provisions of such laws or other legal acts shall apply.
II. APPLICATION FOR THE AUTHORISATION AND ACCOMPANYING DOCUMENTS
3. The application for the authorisation shall contain:
3.1. the applicant’s particulars:
3.1.1. in the case of a natural person – the name and surname, personal identification number (if any), place of residence;
3.1.2. in the case of a legal person – the name, registered office address, code;
3.2. information on the authorisation applied for;
3.3. attachments to the application (accompanying documents);
3.4. the position of the applicant or his representative (in the case of the application submitted by a legal person), name and surname, signature and the date of the application. Where the application is signed by the applicant’s representative, the representative’s particulars listed in item 3.1.1 shall be indicated in the applicaion and the documentary evidence of the representative’s rights and responsibilities shall be attached.

The documents to be submitted to the Bank of Lithuania together with the application for the authorisation shall be specified by laws regulating the activities of the financial market participants supervised by the Bank of Lithuania and other legal acts of the Bank of Lithuania.

The Bank of Lithuania shall be furnished with the original documents or their notarized transcripts (copies, extracts). The Bank of Lithuania may also be provided with the documents bearing the authentication mark of the legal person of the Republic of Lithuania who has drawn up or received the document in accordance with the procedure laid down by the Rules for the drawing up of documents approved by Order No V-117 of the Chief Archivist of Lithuania of 4 July 2011.

The application for the authorisation and other documents submitted to the Bank of Lithuania must be drawn up in the Lithuanian and English languages. Documents drawn up in other languages must be translated into Lithuanian,and their translations confirmed by the translator’s signature and the seal of the translation agency must be attached to such documents and filed with them. On the request of the Bank of Lithuania, translations of English documents into Lithuanian, confirmed by the translator’s signature and the seal of the translation agency must be submitted.
7. Documents drawn up and/or issued in foreign states that are submitted to the Bank of Lithuania must be legalized or certified with Apostille, except in the cases provided for by laws or international treaties.
8. The submitted documents shall be typed or hand-written in legible characters, tidy (their pages shall not be torn, crumpled, etc.) and comply with other requirements of legal acts regulating the drawing up and execution of documents.
9. The submitted documents shall be bound in such a way that they can be easily turned, separated from each other and bound together again.
III. EXAMINATION OF THE APPLICATION FOR THE AUTHORISATION AND THE GRANTING OF THE AUTHORISATION
10. The application for the authorisation may be not examined on the merits and the submitted documents may be returned to the applicant within 5 working days of the day of their receipt, where not all documents specified in legal acts are submitted or where the submitted documents are drawn up and executed disregarding the requirements set out in this and other legal acts. The examination of the application for the authorisation may be discontinued and the submitted documents may be returned to the applicant on the latter’s request.

When returning the submitted documents, the Bank of Lithuania, shall indicate the reasons for the refusal to examine the application and the procedure of appeal against such decision. The Bank of Lithuania shall retain the copies of the returned documents certified by authorized employees of the Bank of Lithuania.

The application for the authorisation shall be examined and the decision shall be made no later than within 30 days of the receipt of the application, unless the laws regulating the activities of the financial market participants supervised by the Bank of Lithuania or other legal acts of the Bank of Lithuania provide for a different time limit.

Where the Bank of Lithuania requests additional documents or information necessary for making the adoption of the decision or the applicant furnishes them voluntarily, the time limit for examining the application and making the decision shall be calculated from the receipt of the requested documents or information. When requesting the additional documents or information necessary for making the decision, the Bank of Lithuania may set the time limits for the submission of such information.
14. Where the details indicated in the application or in other submitted document change during the examination of the application for the authorisation, the applicant must provide the Bank of Lithuania with the updated details no later than within 5 days of their change.

The decision on the granting of the authorisation shall be made by the Board of the Bank of Lithuania or by a structural subdivision of the Bank of Lithuania on its instruction.

The conditions for the granting of the authorisation (the grounds for refusal of the authorisation) shall be laid down by laws regulating the activities of the financial market participants supervised by the Bank of Lithuania and other legal acts of the Bank of Lithuania.
17. Upon granting the authorisation, the Bank of Lithuania may set the time limit of the beginning and end of its validity which may be expressed as a particular date, period or linked to the emergence of certain conditions (cessation of circumstances).

When the Bank of Lithuania makes the decision on the granting of the authorisation, the applicant shall be issued a document confirming the decision of the Bank of Lithuania.
19. Where legal acts provide for payment of the stamp duty for the granting of the authorisation, the authorisation (the document confirming its granting) shall be issued only upon submission of the documentary evidence of payment of the stamp duty specified by legal acts.

The document confirming the decision of the Bank of Lithuania to grant the authorisation shall be sent to the applicant by registered mail or issued at the Bank of Lithuania.
IV. FINAL PROVISIONS

When the Bank of Lithuania makes the decision to grant the authorisation, the application and other submitted documents shall not be returned and shall be stored in the documentary files of the financial market participants supervised by the Bank of Lithuania.
