1.0INTRODUCTION:

1.1Bharat Petroleum Corporation Limited (BPCL) has been one of the leading petroleum refining and marketing company in India since its inception in 1956. BPCL with its refinery located at Mahul, Mumbai has a capacity to process a wide variety of crude oils.

1.2BPCL through its Refinery Modernization Project have enhanced its capacity to 12 MMTPA by installing Crude & Vacuum Distillation Unit, Hydrocracker Unit (HCU), Hydrogen Generation Unit (HGU), Sulphur block along with Utilities / Off sites facilities.

1.3Engineers India Limited (EIL) on behalf of Bharat Petroleum Corporation Ltd. (BPCL),invites sealed bids for “ Desalter Package “ under single stage two bid system from competent bidders with sound technical and financial capabilities fulfilling the Qualification Criteria stated in paragraph 8.0 below.

2.0JOB DESCRIPTION

Supply of Desalter Package having Electrostatic Crude Desalting Technology (such as BI-LECTRIC/TRIVOLT/EDD/EDGE etc.) for Design and Engineering of Desalter Package with Single Point Responsibility comprising of, but not limited to, the following major components including Proprietary items (Electrode Grid Assembly, Inlet/Outlet/ Wash Water/Effluent Pipe Distributors, Transformers etc.), Electrical and Instrumentation within the package battery limit.

3.0 BRIEF SCOPE OF WORK

The brief scope of work envisaged for the bidder under this RFQ shall be as below:

(i)Complete Process/Hydraulic and Mechanical Design and Engineering of Desalter Package.

(ii)Project management

(iii)Procurement/Fabrication of Desalter internals, all bought-out components including Proprietary and Specialty Components, Internals, Mix Valves, PSVs, Power units, Electrical items, Instrumentation and Controls etc.

(iv)Manufacturing and trial assembly of internals at shop.

(v)Inspection and Testing at shop

(vi)Packing and forwarding

(vii)Documented Quality Assurance Systems

(viii)Performance Guarantees as applicable

(ix)Supervision during Erection and Commissioning

(x)Performance Guarantee Test Run.

4.0EXCLUSIONS:

5.0DELIVERY PERIOD

For Indian Bidder: 14 (Fourteen) Months from the date of issue of Fax of Acceptance on FOT Site Basis. Date of Receipt of equipment / material at Site shall be date of delivery.

For Foreign Bidder: 13 (Thirteen) months on FOB International Port of Exit (as per Incoterm 2010) from the date of Fax of Acceptance. Date of Clean bill of Lading shall be the date of delivery.

If the Bidder is unable to submit Bid Document FeeEMD in original within the due date & time, then bidder shall submit the original Bid Document Fee & EMD within 7 days from the date of unpriced bid opening, provided copy of the same have been uploaded on E-Tendering Website. In case the bidder fails to submit the same in original within 7 days, then their bid shall be rejected, irrespective of their status/ ranking in tender and notwithstanding the fact that a copy of Bid Document FeeEMD was earlier uploaded by the bidder.

6.1Cost of Bidding Document fee and EMD exemption will be applicable for Micro and Small Enterprises (MSEs) registered with National Small Industries Corporation (NSIC) as per guidelines(for similar work and monetary limit). On opening the unpriced bid, the NSIC registration certificate will be verified for the monitory limit of registration and category. If the bidder meets both the requirements, i.e. Monitory limit and category, the bid will be processed further. If not, the bidder will be asked to submit EMD.In case the bidder does not submit the EMD, then their bid shall be rejected. The bidder shall submit Notary attested copy of the valid NSIC registration certificate indicating that their registration includes the item/works under tender. The certificate issued by NSIC shall be valid as on the date of opening of Un-priced Bid.

6.2There will be no waiver of Bidding Document fee and EMD for Public sector undertakings of central / state Government undertakings.

6.3Bidder shall download the Bidding Document in his own name and submit the bid directly. The Bidding Document is non-transferable. Bids submitted by Bidder who have not downloaded the Bidding Document will be rejected.

7.0EARNEST MONEY DEPOSIT (EMD) / BID SECURITY

Bids must be accompanied with Earnest Money Deposit/ Bid Security of value mentioned against 6.0 (j).

EMD/ Bid Security shall be in favour of Bharat Petroleum Corporation Limited, Mumbai in the form of crossed demand draft or non-revocable Bank Guarantee (as format attached with RFQ documents) on non-judicial stamp paper of value not less than Rs.100.00 and in the prescribed pro-forma, from any Scheduled Commercial Bank in India/Indian Branch of Foreign Bank recognized as scheduled bank from RBI.

Foreign Bidder may also submit BG from an International bank repute having branch in India or having correspondent banking relationship with an Indian Scheduled bank, in which case the BG shall be countersigned by their Indian Branch or by any scheduled Indian Bank.

Earnest Money Deposit/Bid Security shall be valid for a period of 08 (Months) from the date of submission of Bids.

8.0BIDDER QUALIFICATION CRITERIA (BQC)

Bidder shall fulfil the following qualification criteria in order to qualify for this Work:

8.1EXPERIENCE-TECHNICAL

8.1.1For Reference Job:

Bidder shall be a regular and reputed designer and supplier of Electrostatic Desalter Package and presently continuing the same. Bidder must have supplied at least two jobs of electrostatic Desalter during last ten years.

8.1.2For Qualifying Job:

Bidder shall have experience of design and supply of at least 1 (One) number (similar Technology) Desalter Package having at least 783 M3 /hr flow rate, guaranteed performance parameters same or better as specified in para 2.0 above in the last 10 (Ten) years, which is in operation for minimum one year. The qualifying jobs should have been executed by bidder based on Single Point Responsibility Vendor (SPRV) with scope as per Para 3.0.

In case single qualifying job does not satisfy all the parameters as per design conditions, bidder may furnish additional references of jobs in last ten years to establish that each of the design performance ( i.e. salt, BS&W and oil in effluent water) is achieved in one job or other.

8.2FINANCIAL REQUIREMENT

8.2.1Turn Over:

For Foreign Bidder: The annual turnover of the Bidder shall not be less than € 868,100 (Euro Eight Hundred Sixty EightThousand and One Hundred)or US$ 1,073,000(US Dollar One Million Seventy Three Thousand) as per the audited financial results, in at least one of the immediate preceding three financial years up to the due date of submission of bid.

For Indian Bidder: The annual turnover of the Bidder shall not be less than INR 6,00,00,000.00 (Rupees Six Crore) as per the audited financial results, in at least one of the immediate preceding three financial years up to the due date of submission of bid.

8.2.2The financial net worth of the Bidder as per the latest audited annual report shall be positive.

9.0SUBMISSION OF DATA ALONG WITH OFFER IN ATTACHED TABLE-1.

Bidder shall submit comprehensive reference list of Desalter Systems supplied by him in last ten years, identifying the reference jobs and qualifying jobs, meeting the qualifying criteria as per Para 8.1 above.

For Reference jobs(as per clause 8.1.1), evidence of supplies having been completed shall be furnished.

For qualifying jobs (as per clause 8.1.2), data shall be furnished in Table-I attached (for each job separately) and shall cover Client/Plant, Capacity, Performance Parameters, Year of Supply, Year of Commissioning and adequately addressing the requirements of experience criteria stated in Para 8.1 above.

Bidders shall also submit all documentary evidences in support of the qualifying jobs e.g. copy of work orders, detailed scope and other relevant approved technical documents, user’s certificate for completion, commissioning, operation or performance data with user’s or Third party’s certificate for the qualifying reference jobs etc.

NOTES:

(i)BPCL/EIL reserves the right to complete the evaluation based on the details furnished by the bidder in the first instance along with their bid or based on in-house data / users feedbacks, if any without seeking any additional information.

(ii)Period of experience criteria mentioned in this BQC / NIT shall be reckoned from the last due date of submission of bid.

10.0GENERAL

10.1Experience of only the bidding entity shall be considered. In-house work experience (where for the past experience referred for qualification, the Supplier and the Owner being the same Organization) shall not be considered as valid experience for the purpose of qualification.

10.2Applicant shall furnish documentary proof of fulfilling the Qualification Criteria as mentioned above and applicable sub-clauses. This documentation shall include but not be limited to copies of work order(s) / contract agreement(s) / relevant pages of contract document (s), completion certificate(s), fulfilling the qualification criteria, annual reports containing audited balance sheets and profit & loss accounts statement etc. BPCL/EIL reserves the right to complete the evaluation based on the details furnished without seeking any additional information.

10.3All supporting documents pertaining to “Bidder Qualification Criteria” submitted by the bidder shall be certified true copies, duly signed, dated and stamped by a Public Notary in bidder's country. However, certification by an official authorized for this purpose in Indian Embassy / High Commission in bidder's country shall be acceptable in lieu of the above. For bidders from member countries of Hague Convention, 1961, certification by 'Apostille' of bidder's country shall also be acceptable.”The above requirement is not applicable to Published Annual Reports.

10.4Only E-bids acceptable. Bids through any other mode shall not be acceptable.

10.5 Bids not received by the due date and time shall be rejected and representative of such bidders shall not be allowed to attend the bid opening.

10.6 BPCL/EIL shall not be responsible for any expense incurred by bidders in connection with the preparation & delivery of their bids, site visit and other expenses incurred during bidding process.

10.7 BPCL/EIL reserve the right to assess bidder’s capability and capacity to execute the work using in-house information and by taking into account other aspects such as concurrent commitments and past performance etc.

10.8 Bidder submitting his bid should not be under liquidation, court receivership or similar proceedings.

10.9Canvassing in any other form by the bidder or by any other agency on their behalf may lead to disqualification of their bid.

10.10 Unsolicited clarifications to the offer and/or change in the prices during its validity period would render the bid liable for outright rejection.

10.11 Consortium/Joint bids shall not be accepted.

10.12Bids received by way of Fax or Telex or Telegram or email or in open condition shall not be considered.

10.13Late bids (bids received after the bid due date and time) and unsolicited bids shall not be opened and shall not be considered for evaluation.

10.14Central Government Public Sector Undertaking/ Enterprises shall be extended purchase preference as per Government of India guidelines as applicable.

10.15Bid submitted by the bidder, who is on Holiday list of EIL/any BPCL Group Company, shall not be considered for opening and further evaluation.

10.16BPCL /EIL reserve the right to reject any or all the bids without assigning any reason.

10.17“Bid Due Date” shall mean the last date for submission of Bid as mentioned above under Para 4.0.

INSTRUCTIONS TO BIDDERS

(i)This Pro-forma duly filled in, stamped & signed shall be submitted along with the bid.

(ii)Since the information requested in this Pro-forma shall be utilized to assess the Bidder’s capability, it is in the interest of the Bidder to pick those cases out of total list of references which match the BQC requirement. The Bidder shall also ensure that all information asked for is furnished and the same is correct and complete in all respects. Incorrect information furnished in this Pro-forma shall render the bid/order liable for rejection at any stage of evaluation/work execution, at the risk and cost of the Bidder.

(iii)For the referred installations, the Bidder shall indicate the name of the user’s contact person (along with his address, telephone no., fax no., e-mail id, etc.) who may be contacted by the Purchaser/ his representative, if felt necessary.

Bidder shall also furnish along with the bid his standard reference list for the offered equipment / package.
