STALLHOLDER AGREEMENT

  1. In signing this agreement the “stallholder” agrees to meet all guidelines established by the Narawong Produce market as set out in the Exhibitor information kit. It is the stallholder’s responsibility to ensure they are familiar with, and meet these guidelines. This includes but is not limited to:-
  2. Holding an ABN
  3. Holding a streatrader licence –including registering attendance prior to each market (event)
  4. Holding current public liability insurance
  5. Meeting all local council bylaws in respect of produce production, handling and sale
  6. Meeting all State legislative requirements in respect of produce production, handling and sale
  7. In addition to the terms and conditions in this agreement, all stallholders agree to abide by directions provided by the Narrawong Produce market coordinator on the day.
  8. All stallholders will be allocated a site. It is requested that potential stallholders visit the site in advance to determine where they would like to set up. Every effort will be made by the NPM to facilitate this request. Existing stallholders have first right of refusal for the same site at subsequent market events where the site is booked in advance.
  9. Stallholders can sell locally sourced, locally made and sustainable produce. Produce can include foods like locally home grown fruit, herbs and vegetables, meat, eggs, honey etc or home made ie. jams, sauces, goat products, cakes and slices. All fruit and vegetable needs to be free of herbicides, pesticides and fungicides. They don’t have to be certified organic. Other produce could include candles, soaps, cards, macrame, knitting, scarves, children’s toys, recycled clothes, the list is endless. The only prerequisite is that they are locally produced and preferably from natural materials. Recycled clothes, children’s toys, books etc also fit within the framework of sustainable.
  10. Cooking of food is only permitted at a powered site – well away from plants and lawn so that no damage is done to the garden. Details of cooking and requirements are to be provided in the stallholders application form.
  11. Stallholders are responsible for removal of all of their own rubbish. Failure to do so may incur a fee and/or cancellation of stallholder licence.
  12. Timandra Garden by the Sea is open to the public seven days a week. All stallholders are requested to respect and protect the gardens and leave the area where they set up in the same condition as they found it.
  13. If the Narrawong Produce Market is cancelled due to reasons of emergency, danger, weather conditions, disasters, safety, health concerns, or other reasons that are not in reasonable control of the NPM, then stallholders will not receive a refund of their stall hire paid, however, will be offered a transfer to another market. This is at NPM’s discretion. Fire and similar issues will have negotiable refunds.
  14. The NPM organiser may cancela market not less than 4 days prior to a scheduled market if :-
  15. there are not at least 10 exhibitors registered to attend
  16. there is scheduled bad weather – either very hot or rain/storms.
  17. Other points of consideration may be made by stallholders themselves and reviewed with consensus agreement by all before being pronounced as this point.
  18. We are considering an alternative venue within Narrawong to use for really inclement weather, as the intention is for the market to run monthly once it begins. This will provide continuity to all – stall holders and the general public.
  19. Narrawong Produce Market agrees to provide all registered stallholders with written confirmation of the cancellation [via email]. Written confirmation will be provided to the email address supplied on the application form. It is the stall holder’s responsibility to ensure their contact details and email are correct. Cancellations by NPM for reasons stated above will result in a full refund of fees paid or a credit towards a stall at a future date.
  20. A Stallholder may cancel their application to attend at least 14days prior to a market in writing to . This booking will then be deferred to another date without loss of payment. Cancellations provided in writing more than 21 days prior to the event will be entitled to a full refund. It is requested that ample notice be given to Alison to book each market for ease of management of the site. I’m sure that everyone understands the logistics of this, especially in the early stages.
  21. The stallholder is responsible for the conduct and behaviour of all representatives who attend with them.
  22. The stallholder is responsible for the safety in their designated area. This includes ensuring their stall is set up in a safe and secure manner.
  23. No responsibility is taken by the organiser for theft, loss or damage. Stallholders are responsible for their own stall security including all monies.
  24. NPM is seeking to develop a quality, sustainable market. Stallholders that commit for multiple markets will be given priority over new stall holders. The organiser will try to maintain a balance of produce to ensure everyone has an opportunity to do well at the market.
  25. The NPM shall not be held responsible for the compliance by a stallholder with any By-laws, Regulation, Act or Statute. There are guidelines about selling produce, food handling etc.
  26. The NPM accepts no responsibility for any transaction entered into at the Market.
  27. The NPM reserves the right to refuse admission to the Market to any person without giving any reason for the same and to eject or cause to be ejected any person and/or his/her produce without giving any reason for the same.
  28. The NPM accepts no liability for the loss or damage of any kind suffered by any person who enters the Market area and all persons who enter the Market area do so at their own risk.
  29. The stall holder agrees to indemnify the NPM against all claims for damages or injury to the property or person of any persons in respect of any claim by any such person arising out of negligence on the part of the stall holder or his agents or servants.
  30. This contract is to be signed by stall-holders prior to their first market and is part of the registration process.
