-Received call regarding property at 3655 Abbott Rd and whether or not a 2 acre minimum is required as stated in the St. Hedwig Subdivision Ordinance. It is in the ETJ and PZ informed them that the 2 acre minimum was recently repealed and is no longer a requirement. Explained that with the exception of the 2 acre minimum they must follow the platting requirements in the St. Hedwig Subdivision Ordinance in the ETJ, but that platting requests are handled by Bexar County.

-Rezoning process information requested by listing realtor for 68 acre property located at 13181 FM 1518 (Zigmond). Provided information via email of process and guidelines by which a rezoning request is heard.Copied Code Compliance.

-Discussed land use in HD1 district with realtor representing potential property owner for property located at 14091 FM 1346. Walked through locating on website the zoning ordinance, table of use, and zoning map. Discussed new school opening date and location.

12/1/16

-Received follow up email request from Mrs. Nemec for updates regarding zoning ordinance violations of building use/permit issuance on property owned by Undre and Patricia Smith located just south of 720 N. Abbott Rd; brought to PZ’s attention on 11/03/16, PZ notified Code Compliance of the issue on the same day. Copied Code Compliance on 12/1/16 reply to Mrs. Nemec that PZ did not have any updates but that Mrs. Nemec was seeking information.

-Violation of sign ordinance brought to City’s attention on 10/31/16. On 11/7 Code Compliance indicated that the property owner was planning to request either a permit or a variance, but no contact has been made to PZ as of yet. For scheduling purposes on potential variance hearing needs due to noncompliance PZ has requested status of sign erected at Adrian Way and whether or not the property owner will be removing the sign to bring the property back into compliance, or if PZ will need to schedule a variance hearing.

-PZ Public hearing and subsequent vote whether or not to recommend to Council a rezoning request submitted by David Koeherfor property located at 2850 E. FM 1518 N.

-Per LGC Section 211

-The property owner must be able to explain to both the PZ and Council as to why/how by placing a commercial property in the middle of the single family agricultural district in which it currently resides:

1) supports the character of the district and its suitability for particular use, with a view of conserving the value of the surrounding buildings and

2)encourages the most appropriate land use for the location

-PZ and CC must evaluate how the answers to the above questions will support the intent of the City's current Comprehensive Master Plan for the districts in which the requested rezoning resides.

-PZ will submit their recommendation to CC at the January 2017 CC meeting.

-So that it can be included in the notification to the affected property owners, Council will need to determine a date for their public hearing at today’s meeting. After the CC public hearing Council will need to place an item on the agenda for the next regularly scheduled meeting so a vote on whether or not to rezone the property as requested can occur.

Several things going on with ECISD:

1)Final plat review anticipated for 12/20/16 PZ meeting

2)City notified in October and again in Novemberthat ECISD is using the followingCodes for the design of the elementary school:

  1. 2006 Fire Code
  2. 2006 IBC
  3. 2014 National Electric Code

3)BOA hearing on 12/21/16 due to the maximum height of a certain section of the school building however lack of supporting docs may delay the hearing until January.

  1. ECISD and/or its architect will need to explain why, having known the maximum height requirements since June of this year, they designed the building to be greater than the allowed maximum in the A-1R district and are now seeking a variance rather than abiding by the ordinance requirements. Max height is 35 feet, designed to 39 feet.
  1. Guidelines for BOA hearing:
  2. The plight of the owner of the property for which the variance is sought isdue to unique circumstances existing on the property, and the uniquecircumstances were not created by the owner of the property and are notmerely financial, and are not due to or the result of general conditions inthe district in which the property is located.

-Joint public hearing with City Council to hear public input relating to Council’s consideration of changing the current sign ordinance to allow CEVMS and/or digital signs in the City Limits and ETJ.
