LOCAL TRAINING AND ADJUSTMENT BOARDS

Designation

1.(1)OTAB shall not designate a local training and adjustment board under subsection 18(1) of the Act unless it meets the following criteria:

1. It is a not-for-profit corporation incorporated under the Corporations Act with objects that reflect the purposes of the Ontario Training and Adjustment Board Act, 1993 and are not inconsistent with that Act.

2. The articles of incorporation of the local training and adjustment board provide that, on dissolution of the board, its assets shall be distributed to the governments that provided funding for the assets or, failing that, to charitable organizations that serve the geographical area served by the board.

3. The local training and adjustment board does not serve a geographical area that is served by another local training and adjustment board designated under subsection 18(1) of the Act.

4. The local training and adjustment board is composed of the following member directors, not exceeding 27:

i. At least four member directors representing business who were recommended by organizations representing business.

ii. At least four member directors representing labour who were recommended by organizations representing labour.

iii. At least one but not more than two member directors representing educators and trainers who were recommended by organizations representing educators and trainers.

iv. One member director representing francophones who was recommended by organizations representing francophones.

v. One member director representing persons with disabilities who was recommended by organizations representing persons with disabilities.

vi. One member director representing racial minorities who was recommended by organizations representing racial minorities.

vii. One member director representing women who was recommended by organizations representing women.

viii. Member directors representing local groups selected by the member directors of the local training and adjustment board who are referred to in subparagraphs i to vii.

ix. One member director who is a senior member of the public service of Ontario and who was recommended by the Government of Ontario.

x. One member director who is a senior member of the public service of Canada and who was recommended by the Government of Canada.

xi. One member director representing municipalities in Ontario who was recommended by organizations representing municipalities in Ontario.

5. In addition to the member directors referred to in paragraph 4, the local training and adjustment board may have one member director representing aboriginal people who was recommended by recognized representatives of aboriginal people.

6. The local training and adjustment board has two co-chairs, one chosen from among the member directors referred to in subparagraph i of paragraph 4 and one chosen from among the member directors referred to in subparagraph ii of paragraph 4.

7. A majority of the member directors of the local training and adjustment board are directors referred to in subparagraphs i and ii of paragraph 4 and the number of member directors of the board that are referred to in those subparagraphs is equal.

8. The member directors referred to in subparagraphs ix, x and xi of paragraph 4 are non-voting and receive no remuneration in their capacity as member directors of the local training and adjustment board.

(2)Despite paragraphs 4 and 5 of subsection (1), a local training and adjustment board may be designated under subsection 18(1) of the Act if it does not have a member director representing a group referred to in those paragraphs and no recommendation was received from organizations representing that group. Powers and Duties

2.A local training and adjustment board designated under subsection 18 (1) of the Act shall, in service to OTAB, to the Government of Ontario, to the Government of Canada, to other local training and adjustment boards designated under subsection 18(1) of the Act and to the geographical area it serves, and in accordance with the broad policy and accountability framework provided under subsection 18(4) of the Act,

(a) provide information, analysis and advice on labour markets;

(b) work to improve the information available on labour markets, including by developing systems of information;

(c) establish a planning framework for efficient and effective action relating to labour force development programs and services;

(d) provide analysis, advice and recommendations on funding, programs and delivery mechanisms in the geographical area served by the local training and adjustment board;

(e) purchase or direct the purchase of training and services;

(f) promote the value of learning and training as continuous, lifelong processes;

(g) promote equity and access to labour force training and adjustment programs in the geographical area served by the local training and adjustment board; and

(h) promote national and Ontario training standards. O. Reg. 573/94, s. 2.

Funding

3.(1)OTAB may provide funding to each local training and adjustment board designated under subsection 18(1) of the Act for the following purposes:

1. For activities in connection with the powers and duties delegated by OTAB to the local training and adjustment board or assigned by this Regulation.

2. For administrative costs that are within the broad policy and accountability framework provided under subsection 18(4) of the Act.

3. To compensate member directors of the local training and adjustment board for up to $150 daily of income lost and to reimburse them for expenses incurred while they were engaged in activities for the board.

(2)Subsection (1) ceases to apply if the local training and adjustment board does not comply with this Regulation or with the broad policy and accountability framework provided under subsection 18(4) of the Act.

(3)OTAB shall not make a payment to a local training and adjustment board under paragraph 3 of subsection (1) unless the local board submits to OTAB documentation acceptable to OTAB that substantiates the basis for the payment. O. Reg. 573/94, s. 3.
