SUITE RENTAL AGREEMENT

RULES AND REGULATIONS

1.  The Town Toyota Center and it’s agents and employees, shall have the continued right to enter the suite at any time and all times including, without limitation, for any purpose set forth in the rules and regulations stated in this agreement.

2.  The Town Toyota Center and it’s agents and employees reserve the right to eject from the Town Toyota Center the Suite Renter and/or Suite Guest who, in the opinion of any authorized representative of the Town Toyota Center are conducting themselves in an objectionable manner, and the Suite Renter hereby waves any and all claims for damages, claims, liability expense arising from the exercise of such rights and the Suite Renter shall indemnify the Town Toyota Center and its agents and employees from and against any cost or damages arising from the exercise of such right.

3.  The Suite Renter is responsible for any and all damages that occur in the suite during the duration of their occupancy.

4.  The Suite Renter shall not sell any food or beverages whatsoever in the Suite. Any alcoholic beverages, other beverages or food consumed in the suite shall be obtained from the Food and Beverage Department at the Town Toyota Center or concessionaire designated by the Town Toyota Center. If alcoholic beverages are being served in the Suite, such service shall only be by an attendant approved either by the Town Toyota Center or a designated concessionaire. The Suite Renter shall promptly pay all bills for food, beverages and services furnished, sold or rendered to the Suite Renter or any Suite Guest in connection with the use of the Suite. The Town Toyota Center shall monitor all food and beverage menus and will ensure that fair and equitable pricing is being practiced.

5.  The Town Toyota Center is a smoke-free facility by State Law. The designated smoking area is on the East end of the main concourse, not on the East end balcony upstairs.

6.  The Suite Renter and the Suite Renter’s Guests shall at all times maintain proper decorum while using the Suite and shall not attach, hang r display any banner, advertisement or notices in or around the suite without the prior verbal consent from the Town Toyota Center sales department or General Manager. Notwithstanding such consent, the Suite Holder shall remove forthwith any such signs, banners, advertisements or notices at the request of the Town Toyota Center or its agents.

7.  Certain events may prohibit the use of movie cameras or videotape or audio recording equipment. The Town Toyota Center and its employees and agents reserve the right to restrict the use of such equipment.

8.  The Suite Renter and Suite Renter Guests shall, while in the Suite or within the Town Toyota Center or its grounds, comply with all federal, state and city laws, rules and regulations governing the sale, possession and consumption of alcoholic beverages. The Suite Renter whether present or not within the suite, the Town Toyota Center or on its ground, shall be responsible for controlling any Suite Guest in this regard.

9.  The Maximum capacity of each Suite shall be based on fire code and other applicable bylaws and governmental regulations.
