The purpose of this letter is to provide you with the review agency responses to the above named development application that has been received to-date by Planning and Community Development.

You are encouraged to directly contact those agencies that did provide review comments if the comments require additional action by the applicant/applicant’s representative. You are also encouraged to directly contact those agencies that did not provide review comments if such response is required by state statutes and the El Paso County Land Development Code.

Comment 1:

REPSONSE: Redlines received and the reports updated per the redlines.

Comment 2:

Based on the draft drainage report, no additional drainage fee is likely required with the plat amendment since there is no increase in imperviousness. If the FDR were approved with the final plat and the subsequent Site Development Plan application has changes that affected the drainage, then the FDR would need to be amended. For simplification the approval of the FDR will be deferred with the Site Development Plan to ensure the submitted site plan, GEC, FAE are all in conformance with the FDR. A cursory review of the FDR is provided with this PUD. Detailed review of the FDR will be conducted with the site development plan application.

Comment 3:

EPLASO COUNTY PARKS DEPARTMENT

The Planning Division of the Community Services Department has reviewed the Fountain Valley Ranch Warehouse PUD Amendment application and has the following comments of behalf of El Paso County Parks.

The project site is located on the west side of Grinnell Boulevard, at the intersection of Crandall Drive. The El Paso County Parks Master Plan (2013) shows no parks, trails, or open space intersected by or within the project area. The proposed Grinnell Boulevard Secondary Regional Trail is located approximately 60 feet east of the property, on the east side of Grinnell Boulevard. Widefield Community Park and Crews Gulch Regional Trail, both accessed by the Grinnell Boulevard Secondary Regional Trail, are located approximately 0.75 mile southeast of the project site, while the City of Colorado Springs’ Bluestem Prairie Open Space is located approximately 1.5 miles east of the property.

The Board of County Commissioners has not elected to require park fees for commercial subdivisions, so none are recommended at this time.

These comments are being provided administratively, as this application does not require Park Advisory Board consideration.

ELPASO COUNTY ENVIRONMENTAL SERVICES

The El Paso County Environmental Division has completed its review of the above noted project. Our review consisted of the following items: wetlands, federal and state listed threatened or endangered species, general wildlife resources and noxious weeds.

We have reviewed the submittal and have no comments at this time.

The applicant is hereby on notice that the U.S. Army Corps of Engineers and the U.S. Fish and Wildlife Service have regulatory jurisdiction over wetland and threatened and endangered species issues, respectively. It is the applicant’s responsibility, and not El Paso County’s, to ensure compliance with all applicable county, state, and federal laws and regulations, including, but not limited to, the Clean Water Act, Endangered Species Act, Migratory Bird Treaty Act, Colorado Noxious Weed Act and El Paso County Weed Management Plan.

COLORADO SPRINGS AIRPORT ADVISORY COMMISSION

Airport staff recommends no objection with the following conditions:

• Provide proof of previous avigation easement or Airport Activity Notice and Disclosure recordation for this property.

• If use of temporary construction equipment will exceed 200 feet above ground level in height at this site, the applicant is to file an airspace evaluation case with the Federal Aviation Administration (FAA) and provide the results to the Airport before the commencement of construction activities.

• More information about the airspace evaluation submittal process is available on the FAA’s Obstruction Evaluation/Airport Airspace Analysis website (https://oeaaa.faa.gov/oeaaa/external/portal.jsp).

REPSONSE: Noted, no action needed. An avigation easement given to the City of Colorado Springs was recorded October 30, 2002 at Reception No. 202189125.

COLORADO SPRINGS UTILITIES

Utility Comments (electric, gas, water, wastewater)

Action Items:

Modify the Preliminary Utility and Facility Plan to address the following comments:

• Request completion of project specific information item. Approval is recommended.

Project Specific Information Item:

1. Contact Rob Estes at (719)668-5904 to discuss options and locations for gas service line and location of gas meter(s).

Information Items:

1. The applicant or their engineer should contact Utilities Development Services for an estimate of any system development charges, fees, Recovery Agreement Charges or other costs that may apply to this development (668-8111).

2. When new water meters are proposed to serve the project or additional demand added to existing water meters, a Commercial Water Meter Sizing form will be required to be submitted to CSU prior to Service Contract issuance and building permit approval.

3. CSU requires an Application for Gas and Electric Line Extension to be submitted along with a Load Data form or an Application for Gas Service Line Approval and/or Application for Elevated Pressure Approval prior to electric and natural gas system design for service to the project. Refer to the CSU Line Extension and Service Standards or contact Field Engineering at 719-668-4985.

4. CSU may require an extension contract and payment of contributions-in-aid of construction (or a Revenue Guarantee Contract) for the extension of electric facilities needed to serve the development. With regard to natural gas extensions, CSU may require an extension contract and an advance payment for the estimated cost to construct the necessary gas extensions.

5. Improvements, structures and trees must not be located directly over or within 6 feet of any underground gas or electric distribution facilities and shall not violate any provision of the National Electric Safety Code (NESC) or any applicable natural gas regulations or Colorado Springs Utilities’ policies.

6. Improvements, structures and trees shall not be located under any overhead utility facility, shall not violate NESC clearances, and shall not impair access or the ability to maintain utility facilities.

7. Landscaping shall be designed to provide the required clearances for utility facilities, to allow continuous access for utility equipment, and to minimize conflicts with such facilities.

8. Colorado Springs Utilities requires wastewater and water construction drawings when new wastewater and water facilities are proposed. Plans can be submitted electronically to Utilities Development Services via www.csu.org.

9. The water distribution system facilities must meet the Colorado Springs Utilities’ criteria for fire flow, water quality, service interruption and pressure. To meet service interruption criteria, no more than fifty (50) homes on a dead end water main line are permitted. The static pressure of the water distribution system shall be a minimum of 60 psi. CSU will assess the need for a Water Quality Plan based on information presented in the Development Plan. CSU may require a new or updated Water Quality Plan where construction phasing or the water system design differ from the approved Development Plan.

PIKES PEAK REGIONAL BULDING DEPARTMENT

1.  On page EL1, the pedestrian access looks to in the wrong location. Vehicle parking is on the east: shouldn’t the pedestrian doors be located on the east as well?

REPSONSE: There are man doors provided on both sides of the building with the front door/ main public access provided along the eastern façade of the building adjacent to the parking lot. The doors along the back of the building will be for owner/ tenant access.

Due to the number of comments and necessary revisions to the plan(s) an additional detailed review will be necessary. Please address the comments as listed above. A detailed letter needs to accompany the revisions to allow for an expeditious re-review timeframe. The letter should include each comment listed above and, immediately thereafter, include a response from the applicant addressing the comment.

If any review agency has an issue that needs resolution or requires a revision, you will need to provide the necessary documents, drawings, etc., to the Planning and Community Development Department in the form of a resubmittal. The Planning and Community Development Department will then forward the resubmitted items directly to the appropriate review agency. If you have any questions pertaining to specific agency comments please contact the appropriate agency directly.

PLEASE NOTE: The application cannot be scheduled for public hearing until and unless a final response has been received by Planning and Community Development from those agencies that are required (pursuant to state statute and the El Paso County Land Development Code) to provide such response (i.e.- State Engineer’s Office, County Attorney’s Office, County Health Department, etc).

In order to be considered for the Planning Commission hearing, all outstanding issues must be resolved no later than. In order to give the reviewers time to confirm that those outstanding issues have been resolved, revisions need to be submitted by.
