TOWNSHIP OF FRANKLIN
ORDINANCE REPEALING ORDINANCE 0-16-08 ADOPTED BY THE TOWNSHIP OF FRANKLIN ON MAY 6, 2008

WHEREAS, the Township had adopted an Ordinance O-16-08 which provided substantive amendments to Chapter 253 of the Code of the Township of Franklin which specifically repealed the portion of said Ordinance which required that expenditures of recreation facility/open space dedicated trust fund; and
WHEREAS, Ordinance O-16-08 repealed the section which states:
“All expenditures shall be approved by the Planning Board upon recommendation of the Open Space and Recreation Subcommittee of the Planning Board. Disbursement of funds shall be approved by the Township Committee.”; and
WHEREAS, the Township of Franklin believes that the input of the Planning Board and the Open Space and Recreation Subcommittee is necessary and appropriate to support the expenditure of recreation facility/open space funds; and
NOW THEREFORE, BE IT ORDAINED, by the Township Committee of the Township of Franklin, County of Gloucester, State of New Jersey that Ordinance O-16-08 be and is hereby repealed and that §253-50(a)(31)(i) is reinserted and amended to read as follows:
“All open space expenditures shall be referred to the Planning Board for consideration. The Planning Board shall report back to the Township Committee within thirty (30) days with its recommendations or objections, if any, to the spending plans of the Township Committee. The recommendations and/or objections of the Planning Board shall be considered by the Township Committee. All disbursements of funds shall be approved by Township Committee.
BE IT FURTHER ORDAINED that any Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance be and the same are hereby repealed; and
BE IT FURTHER ORDAINED, that this Ordinance shall take effect immediately upon passage and publication in accordance with the laws of the State of New Jersey.
