REGULATION ON THE CONTENT AND THE METHOD OF KEEPING RECORDS ON TRAVEL DOCUMENTS

Subject

Article 1

This Regulation shall stipulate the details of the content and the method of keeping records on: submitted requests for issuing travel documents, data from requests, documents which are submitted with requests, issued travel documents, data entered into travel documents, reasons and date of expiry, travel documents which are declared invalid, cessation of reasons for rejecting requests for issuing travel documents, duration of reasons and authorities that submitted requests, and developed forms of travel documents.

Records on submitted requests for issuing travel documents

Article 2

The records on submitted requests for issuing travel documents shall contain: scanned request for issuing travel documents, number of the request, date when the request was submitted and the name of the authority that the request was submitted to.

Records on data from requests for issuing travel documents

Article 3

The records on the data from requests for issuing passports shall contain: the first and the last name, born surname, name of parents, gender, date, month and year of birth, place, municipality and country of birth, citizenship, personal identification number, personal identification numbers of parents, residence and address of residence, ID number, residence and address abroad and the year of leaving Montenegro (records on the data from the request for issuing passports in a diplomatic and a consular representative office), the number of previous passport, date of issue and the name of the authority that issued the passport, reason for issuing the passport, indication of the language and the script in which the personal name is entered, a digital photograph, a digital signature, the last and the first name of legal representative, date when the request was submitted and the signature of the Applicant.

The records on the data from requests for issuing a diplomatic and a business passport shall contain: the last and the first name, born surname, date, month and the year of birth, place, municipality and the country of birth, personal identification number, residence and the address of the residence, function i.e. the title, reasons for travelling to the country a person is travelling to, when and for how long, on whose order, i.e. the invitation he/she is travelling, number of previous diplomatic or business passport and the date of issue, the last and the first name, date, month and the year of birth, place, municipality and the country of birth and personal identification number of a member of the family who travels with the person for whom the request is submitted, indication of the language and the script for entering personal name, a digital photograph, a digital signature, date when the request was submitted and the signature of authorized person.

The records on the data from the request for issuing travel certificate shall contain: the last and the first name, born surname, names of parents, gender, day, month and the year of birth, the place, municipality and the country of birth, citizenship, personal identification number, personal identifications numbers of parents, residence and address of the residence, the residence and address abroad, the number of previous passport, the date of issue and the name of the authority that issued the passport, reasons for issuing travel certificate, the date of issue and the name of the authority that issued the travel certificate, indication of the language and the script used for entering personal name, a photograph of the Applicant, the last and the first name of legal representative, the date when the request was submitted and the signature of the Applicant.

Records on documents that are enclosed to requests for issuing travel documents

Article 4

The records on the documents that are enclosed to the request for issuing passports shall contain: scanned certificate of citizenship and the data on the municipality that issued it, residential area, page of registration and the number of the entry, the scanned birth certificate and/or Register of Births and the municipality that issued it, the place of issue, the current number and for which year the entry was made, the scanned written consent of parents or a legal representative for issuing a passport to minors or work unable people; the scanned evidence of payment for form of the passport and scanned evidence of paid fee for issuing passports.

The records on the documents which were enclosed to the request for issuing a diplomatic and a business passport shall contain: decision of the Government authority in which the Government employee performs functions or in which the Government employee or the servant is employed or for whose needs a diplomatic or a business passport is issued.

The records on the documents which are enclosed to the request for issuing travel certificates shall contain: a certificate of citizenship and the data on the municipality that issued it, residence area, page of entry and number of entry, birth certificate or a certificate from the Register of Births and the data on the municipality that issued it, the place of issue, the current number and for which year the entry was made, two photographs, the evidence of payment for the form of travel certificate and the evidence that the fee was paid for issuing a travel certificate.

Records on issued travel documents

Article 5

The records on issued travel documents shall contain: the name of the authority that issued travel documents, the type of travel documents, the date of issue of travel documents, the validity of travel documents, the serial number of travel documents, the date of handing in or taking of travel documents.

Records on the data entered into the forms of travel documents

Article 6

The records on the data entered into the passport form shall contain: the name of travel documents, the code of the country, the last and the first name, the date, month and the year of birth, the municipality of birth, place and the country of birth if a person was not born in Montenegro, the gender, citizenship, personal identification number, a photograph, the data related to description of the photograph, signature, the date of issue, the validity, the serial number of the passport, the name of the authority that issued the passport and the mechanically readable records.

The records on the data entered into the form of a diplomatic and a business passport shall contain: the name of travel documents, the code of the country, the last and the first name, the day, month and the year of birth, the municipality of birth, the place and the country of birth if a person was not born in Montenegro, the gender, the citizenship, the personal identification number, the function, a photograph, the data related to description of the photograph, the signature, the date of issue, the validity, the serial number of a diplomatic and a business passport, the name of the authority that issued a diplomatic or a business passport and the mechanically readable records.

The records on the data entered into the form of travel certificates shall contain: the name of travel documents, the code of the country, the number of the travel certificate, a photograph, the last and the first name, the day, month and the year of birth, the municipality of birth, the place and the country of birth if a person was not born in Montenegro, the gender, the citizenship, the personal identification number, the date of issue, the validity of the travel certificate and the name of the authority that issued it.

Records of scanned finger prints

Article 7

The records of scanned finger prints shall contain: scanned prints of two fingers, the information for which fingers the prints were taken, the code “ND” if a person does not have fingers.

Records on the cessation, reasons and the date of cessation of travel documents

Article 8

The records on the cessation, the reasons and the date if cessation of travel documents shall contain: the type of travel documents, the first and the last name of the person whose travel document ceased to be valid, personal identification number, the number of the travel document which ceased to be valid, the authority which made a decision on the cessation of the validity of the travel document, the number and the date of the decision, the reasons for the cessation of the validity of the travel document and the date of cessation of the validity of the travel document.

Records on travel documents which are declared invalid

Article 9

The records on the travel documents which are declared invalid shall contain: the type of travel document, the last and the first name of the holder of the travel document, the personal identification number, the date when it was reported that the travel document disappeared, lost or stolen, the authority which made a decision on declaring the travel document invalid, the number and the date of the decision, the serial number of the travel document which is declared invalid, the date when the data are submitted for the purpose of declaring the travel document invalid and the number of the “Official Journal of Montenegro” which published the number of the travel document that was declared invalid, the date when the travel document was found and the date when the found travel document was destroyed.

Records on the cessation of reasons for rejecting the request for issuing travel document

Article 10

The records on the cessation of reasons for rejecting the request for issuing travel documents shall contain: the last and the first name, the personal identification number, the gender, the legal grounds for rejecting the request for issuing travel documents, the number and the date of the decision for rejecting the request for issuing travel documents, the date of sending the decision, the date when a complaint on the decision on rejecting the request was submitted, the date and the number of the decision upon the complaint, date when the decision upon the complaint was handed in, the date of the cessation of reasons for rejecting the request for issuing or withholding travel documents and the authority that issued a notification about the cessation of the reasons for rejecting the request for issuing travel documents.

Records on duration of reasons for rejecting the request and withholding travel documents and authorities that submitted such request

Article 11

The records on duration of reasons for rejecting the request and withholding travel documents and authorities that submitted such request shall contain: last and the first name of the person for whose request for issuing travel documents there are reasons for rejecting such request, personal identification number, gender, authority that issued a notification about the reasons for rejecting the request for issuing travel documents or withholding travel documents and duration of such reasons.

Records on developed forms of travel documents

Article 12

The records on developed forms of travel documents shall contain: number of developed forms of travel documents, the type and serial numbers of travel documents.

Method of keeping the records

Article 13

The records stipulated by this Regulation shall mean electronically managed database and shall be summarized in the form of the Register of Travel Documents.

Final provisions

Article 14

This Regulation shall come into effect on the eight day from its publishing in the “Official Journal of Montenegro”.
