FUNCTION BOOKING TERMS AND CONDITIONS
Definitions and Interpretations
“Applicable Laws”means all relevant laws, regulations and statutes relating to the
Ground and any part or parts thereof
“Client” means the hirer
“the Club” means Countesthorpe Cricket Club
“the Function Room”means the club house and the principal building on the Ground
“the Officers” means the Secretary, the Chairman or the Facilities Manager of Countesthorpe
Cricket Club
“Regulations” means the rules and regulations relating to the use and occupation
of the Ground and any part or parts thereof and the Function Room
“Ground” means the cricket ground at Bassett Avenue, Countesthorpe, Leicester
Any Schedules to this Agreement form part of and together form the whole Agreement.
Where the context requires the singular includes the plural and vice versa and any gender includes the othergender.
An obligation on the Client not to do any act, matter or thing includes an obligation not to cause or permit thedoing or such act, matter or thing.
Booking
The Officers will hold a provisional booking for 21 days after which the booking may be released.
All bookings remain provisional until the deposit is received and accepted by the Officers.
The Client shall notifythe Officers not less than 14 days before the event of the final numbers of persons attending.
1)Deposit
A deposit of £40.00 is payableupon the signing hereof (“the Deposit”). In the event of the Client cancelling the event the Deposit is non refundable and non transferable andadditional cancellation charges are detailed in clause 3 hereof will be levied by the Club.
2)Payment
Full settlement of the account is required 14 days prior to the event.
Cheques should be made payable toCountesthorpe Cricket Club.
The Club shall charge interest at the rate of 4% per annum above the base rate of HSBC Bank Plc fromtime to time (“the Interest Rate”) on any outstanding sums payable by the Client commencing on the day ofthe event.
3)Cancellations
All cancellations must be notified to the Officers in writing or by fax or email.
If the Client was to cancel the event a charge will be made calculated as a percentage of the total bookingvalue on the following scale:

6 – 3 months prior 50%
3 – 1 months prior 75%
Less than 1 month 100%
The Officers may cancel the booking without penalty if the Ground or any part or parts thereof is closeddue to fire, orders of any public authority or any cause affecting the event that is outside the Club’s control whereupon the Officers will refund to the Client any Deposit or advance payments made by theClient but the Club will have no further liability to the Client.
The Officers may cancel the booking when the date coincides with any fixture or re-arranged fixture whichis due to be played at the Ground whereupon the Deposit and any advance payment will be refunded to the Client but the Club will have no further liability to the Client.
5) Corkage
No wines, spirits or food may be brought into the Ground or the FunctionRoom unless with the prior consent of the Officers and the Club reserve the right to refuseentry to the event or dispose of such items and charge a corkage charge.
6)Alterations
The Club aim to provide the Client with the Function Room and facilities requested but in the unlikely
event that for any reason the Club need to change any aspect of the event it reserves the right to do so at any time. The Officers will notify the Client immediately in relation to any changes.
7) Alcohol Sales
The sale of alcohol by the Club at the event shall be subject to the Liquor Licence held by and on behalf of the Club. The Club under the Licensing Acts have the right to refuse to sell alcohol to
attendees.
8) Client’s Obligations
The Client undertakes with the Club:
8.1: to use the Ground and the Function Room only for the purpose of staging the Event;
8.2: not to use the Function Room, the Ground or any part of it for any activities which are dangerous,offensive, noxious, illegal or immoral or which are or may become a nuisance to the Club or theowner or occupier of any neighbouring property;
8.3:not to do anything which may invalidate any insurance maintained by the Club in respect of the Function Room or which might increase the insurance premium payable for the Function Room;
8.4:not to bring on to the Ground or any part of it any animals except disability assistance dogs without the consent of the Officers;
8.5:to observe all Applicable Laws, Licences and the Regulations relating to the use of the Ground and Function Room forstaging the event;
8.6:at its own cost to comply with all requirements of the Health and Safety Executive in relation to anyfeatures of the event which are special or unique to the event;
8.7:to pay the Club the cost of making good all damage to the Function Room, Ground or anyparts thereof suffered during the event and damage by the Client’s attendees, agents, servants and subcontractors;
8.8: at the end of the event to remove all the Client’s equipment, goods, waste and other materials from the Function Room and the Ground and shall indemnify the Club against any costs, damages orliability incurred by the Club;
8.9:not to park on or obstruct the access ways giving access to the Ground;
8.10:no dangerous or hazardous items are to be brought into the Ground and/or Function Room eg fireworksor gas cylinders for balloons. If any such items are found they shall be removed immediately uponrequest from any of the Club’s staff;
9) Insurance / Liability
The Club are not to be liable for any injury to a Client, guest of the Client or attendee of the event
unless the injury can be shown to have occurred at the Ground or within the Function Room and to have beencaused by virtue of negligence on the part of the Club, its servants or agents.
The Club is not responsible for the property of the Client or its guests or service providers at the
Ground.
Cloakroom and car parking are provided only for the convenience of the Client and its guests. All
personal possessions, goods or vehicles are left at the Ground at the owner’s risk. The Club shall only
be responsible for any loss or damage to such items arising as a result of the negligence of the Club orits employees.
The Club shall not be liable for any loss due to any breakdown of machinery, failure of supply of
electricity, leakage of water, licensing restriction or act of god which may cause the Ground and/or Function Room to be temporarily closed or the Event to be interrupted or cancelled.
The Client shall be responsible for any damage to the Ground and/or Function Room or any furniture,
furnishings, décor or equipment therein by the wilful act or default of the Client or their guests. The Clientshall also be responsible for any damage to the Ground and/or Function Room, furniture, furnishings, décor orequipment which is caused by the Clients own or any third party service providers equipment. The Client shall pay the Club on demand the amount required to make good or remedy any suchdamage.
In addition the Client shall be responsible for any additional losses suffered by the Club as a result of
such damage eg cancellation or loss of other bookings of facilities within the Ground.
Interest shall accrue on any sum due at the Interest Rate until payment in full is received.
11) Termination
The Club shall be entitled to terminate this Agreement forthwith on notice to the Client in the event
that any monies due and payable under this Agreement (whether demanded or nor) have not been paid onthe due dates for payment.
11) Miscellaneous
11.2. Capacity The maximum number of persons to be admitted to the event is not to exceed the capacity of the Function Room and the Client must keep a note of the number of people admitted and produce the same
on demand to any employee of the Club.
11.3. Licence The Client must comply with all regulations, conditions and stipulations of the public entertainments licence and liquor licence for the Ground and Function Room (so far as the same may be relevant to the event).
11.4. Smoking No smoking is allowed in the Function Room.
11.6. Entire Agreement This Agreement sets out the entire agreement between the Cluband the Client. Any additional conditions or amendments or variations of the terms herein shall have no effect unless agreed in writing by both parties
11.7. Jurisdiction This Agreement shall be governed by English Law and the parties hereto submit to the exclusive jurisdiction of the English Courts.
