Response to email from Debra Lee Andersohn’s email dated 9/16/2011
Dear Debra Lee Andersohn,
If you wish to retire from future obligations under the Management Contract between Debra Lee Andersohn, AKA known as Di Di Merlow and Barry McCloud Management and Productions, hereinafter known as “BMMP”, signed and dated July 9, 2011 we would like your written agreement to the following and then the matter will be concluded.
1. Debra Lee Andersohn and anyone associated with her will not make any further contact with any writers, musicians and/or studio personnel associated with this project. This includes but is not limited to phone calls, emails, text messages, hand written or typed letters, or any other forms of communication both written and verbal.
2. Debra Lee Andersohn will revert to the name of Debra Lee Andersohn as we own the variants of Di Di Merlow domains. However, we will not use the name of Di Di Merlow for any other performer.
3. Debra Lee Andersohn and anyone associated with her will not under any circumstances use either the recordings made between August 22, 2011 to August 30, 2011 or the tracks only version for any public performance or attempt to create a record release of her own or attempt to license to third party or post to any social network. Nor will Debra Lee Andersohn and anyone associated with her allow third parties to listen to the recordings and/or the tracks. These recordings and tracks are the property of BMMP and Michelle Ineson and John Ineson. This is an immediate cease and desist.
4. Debra Lee Andersohn and anyone associated with her will not release to any third party including any social network any videos of her performance on September 6, 2011 at Yoshi’s in San Francisco, California. We also undertake not to release her vocal tracks or videoed performance or make them available to a third party under any name. This is an immediate cease and desist.
5 Debra Lee Andersohn and anyone associated with her will not use or allow to be used any photographs taken by either Barry McCloud or anyone associated with him inter alia as a post on any social media, for promotion or as a part of a portfolio as these are copyrighted by Barry McCloud Photography and BMMP. We for our part will not release these photographs to any third parties or in any public place.
6 We will remove the ‘Di Di Merlow’ Fan page on Facebook.
7 You will make no derogatory remarks either spoken or in writing about Michelle Ineson or John Ineson, Barry McCloud or BMMP. For our part, we will not say and/or write anything derogatory about you, your ability or any other matter pertaining to you, your career or your family.
