1.1.Purpose

The purpose of this resource is to provide a consistent format and language for certification statements and signature blocks that appear on the face of a recorded plat, including subdivision plats and exemption plats.

1.2.Background

Consistent language for plat certifications and signature blocks assists both the preparer and reviewer of the plat. Certifications and signatures provide verification of the commitment of the owner to the information on the plat, including the owners’ authorization for the dedications that occur with the recording of the plat.

1.3.Applicable Statutes and REGULATIONS

Section 8.3.3 (D) of the LDC provides that any land dedications required by the LDC shall be competed prior to or concurrently with filing of the plat for recording with the Clerk and Recorder. Section 8.4.4 (B) of the LDC provides that roads shall be located within a dedicated public right-of-way meeting the requirements of the ECM for the roadway classification proposed.

Section 8.4.5 (G) (1) of the LDC provides that drainage easements shall be dedicated including the rights of access if necessary.

Section 8.5.1 of the LDC provides that the applicant or owner is responsible for making the required land dedications at the time of filing the final plat for recording and that land dedication may include both public and private land dedications.

Section 8.5.1 C (1) (b) of the LDC provides that the title associated with the dedicated land shall be free and clear of any and all liens and encumbrances.

Section 8.5.1 C (3) (b) of the LDC provides that The owner shall dedicate or deed easements required by this Code, or the ECM, or to serve the division of land with utilities and other required services, or those easements that may be requested by public agencies.

Section 8.5.4 (A) (1) of the LDC provides that the owner shall dedicate the entire right-of-way for roads, trails, and other public improvements associated with the division of land in accordance with standards in this Code, the ECM and the MTCP. Dedications shall be shown on the plat and meet the general dedication requirements of this Code.

Section 8.5.5(B) of the LDC provides that the owner shall dedicate the entire easement or right-of-way for drainage improvements associated with the division of land in accordance with this Code and the ECM. Dedications shall be shown on the plat and meet the general dedication requirements of this Code.

1.4.Applicability

This resource is applicable to all subdivision plats, exemption plats, replats, or other plat related actions.

1.5.Technical Guidance

The location on the plat drawing for the required certificates and signature blocks is included in S-PL-011-08 (Final Plat Map)

This form serves as an example of the standard certifications and signature blocks that the County requires on the face of a plat that will be recorded. If an applicant chooses to use different language than the approved language, the submission will require special review by the CountyAttorney, which could delay approval and could require the assessment of additional fees.

1.8.Certificates on the face of the plat

Owners Certificate

The undersigned, being all the owners, mortgagees, beneficiaries of deeds of trust and holders of other interests in the land described herein, have laid out, subdivided, and platted said lands into lots, tracts, streets, and easements (use which are applicable) as shown hereon under the name and subdivision of ______. All public improvements so platted are hereby dedicated to public use and said owner does hereby covenant and agree that the public improvements will be constructed to El Paso County standards and that proper drainage and erosion control for same will be provided at said owner’s expense, all to the satisfaction of the Board of County Commissioners of El Paso County, Colorado. Upon acceptance by resolution, all public improvements so dedicated will become matters of maintenance by El Paso County, Colorado. The utility easements shown hereon are hereby dedicated for public utilities and communication systems and other purposes as shown hereon. The entities responsible for providing the services for which the easements are established are hereby granted the perpetual right of ingress and egress from and to adjacent properties for installation, maintenance, and replacement of utility lines and related facilities.
