An ASUCD Senate Resolution to express support for a San Francisco City Ordinance titled “Administrative Code - Bicycle Yield Enforcement Policy" and express desire for similar policy to be implemented in Davis, California.

WHEREAS, this ordinance allows bicyclists to treat a stop sign as a yield sign if and only if an automobile or pedestrian is not present; and,

WHEREAS, under the proposed ordinance running a stop sign when traffic is present is still illegal; and,

WHEREAS, under the proposed ordinance aimlessly speeding through a stop sign is illegal regardless of traffic conditions; and,

WHEREAS, under current law gently rolling through a stop sign when nobody is present is illegal; and,

WHEREAS, Davis boasts one of the largest bicycling communities in the United States; and,

WHEREAS, Davis claims to be the “most bike friendly town in the world,”but has failed to pass common sense bicycling policy; and,

WHEREAS, this San Francisco ordinance has been endorsed and lobbied for by the San Francisco Bike Coalition, which seeks to protect the interests of cyclists; and,

WHEREAS, a version of the SF Bike Yield Policy has been successfully implemented in Colorado since 2011 and Idaho since 1982; and,

WHEREAS, the San Francisco Police Department (SFPD) will focus enforcement on behavior known to cause the majority of traffic related deaths and thus won’t crack down on safe bicyclists; and,

WHEREAS, a contemporary study has shown a 14.5% decrease in collision rates for people biking and no significant collision impact for people walking in bike yield communities; and,

WHEREAS, under current law SFPD and the Davis Police Department can still ticket bicyclists for cautiously rolling through stops when nobody else is around; and,

WHEREAS, SFPD can dedicate the majority of their efforts to enforcing other more dangerous traffic violations; and,

WHEREAS, a similar ordinance passed in Davis would be helpful to UC Davis students, especially those living off-campus that commute to school; and,

WHEREAS, Davis cannot call itself the “most bike friendly town in the world”without adopting this change.

THEREFORE LET IT BE RESOLVED THAT, the Associated Students, University of California, Davis (ASUCD) urge City of Davis Leadership to support an ordinance similar to; and,

THEREFORE LET IT BE FINALLY RESOLVED THAT, copies of this resolution shall be sent tothe members of the Davis City Council, the members of all appropriate Davis City Council committees, and local media outlets, including the California Aggie and the Sacramento Bee.
