General Common Element Landscape Resolution

Purpose: The purpose of this policy is to set forth guidelines to be used by The Pointe Condominium Association, Inc. ("Association") or by homeowners who may want to modify the Association's General Common Element landscape area at the homeowner's sole cost and expense. The aim being to maintain landscape continuity as well as reduce maintenance through the use of xeriscape concepts which include low water usage, use of drought tolerant perennials, and minimal maintenance.

·  Homeowners must receive prior written approval from the Association for any proposed changes to the Association's General Common Element landscaping. All landscape changes proposed by the homeowner MUST be performed by the Association's designated landscaper only!

·  A homeowner may only propose a change to the General Common Element landscape area that

·  is directly adjacent to their unit.

·  Current irrigation/sprinkler system must remain intact.

·  Grading and drainage must funnel water away from buildings.

·  Plantings should be chosen from a recommended palette.

·  If decorative rock is used, it must be similar to what is used throughout the community.

The aim of any landscaping project should be to reduce maintenance such as weeding or annual replanting and reduce water usage.

Homeowners who apply to make landscape changes on General Common Elements adjacent to their

unit acknowledge and agree to pay all costs and expenses for any proposed landscape modification. The Association may request prepayment or a deposit from the homeowner prior to approval of any landscape change.

The Association will continue to improve and update Common Elements as funds are available. This is determined by the Board with recommendations and cost estimates from the Association's landscaper.

The desired landscaping changes proposed by the homeowner must be submitted for prior approval to the Landscape Committee via the property manager using the Landscape Change Application form.

The homeowner is required to obtain their adjacent neighbor's signature on the application evidencing their agreement to the proposed landscape changes before submitting the application to the Association. The approving neighbor will not be financially responsible for payment of the landscape changes proposed by the applicant.

Briefly describe changes you would like to make to the Association's General Common Element landscaping (i.e., take out flora, replace flora, stone, etc). Please specify any live plantings you wish to use. Use exact names. These will be reviewed by the committee and must require little water and little care such as plants used in Xeriscape landscaping. Any landscape modifications cannot add extra work for the landscape company. All landscape changes must blend in or enhance the look of The Pointe.

The Homeowners Association At The Pointe

Fellow Association Members,

The following is a quick reference guide to show the repair and maintenance responsibilities of the Association as well as the repair and maintenance responsibilities of the unit owner. It is compiled from our community's Amended and Restated Condominium Declaration that was adopted on May 19, 2015, and is meant only as a reference; for greater detail, please refer to Section 6.3 in our Declaration.

Association Responsibilities

(a)  foundations, but not the floating concrete basement floors

(b)  siding and painting on the exterior of the buildings

(c)  roofs, exterior chimneys, roof decking, roof trussed, gutters and downspouts

(d)  original decks, subject to the provisions of Section 6.1 and the "Deck Resolution"

(e)  outside porches and steps leading to the main entrance on the end units

(f)  patios located under the rear deck

(g)  painting of exterior window frames

(h)  painting the exterior surface of the main entry door and door frame

(i)  all main water and sewer lines serving more than one unit

(j)  rodent and bird removal from attic areas

(k)  snow removal from parking areas, private roads and driveways as contracted

(I)  lawns, landscaping, and irrigation systems

(m) private streets, driveways, sidewalks outside a courtyard, street lights

Unit Owner Responsibilities

(a)  all of the unit interior including flooring and drywall, floating concrete basement floor

(b)  all glass surfaces

(c)  windows, casings, locks and screens

(d)  entry door and storm door

(e)  pipes, lines, ducts that serve only your unit, water and sewer to the main lines

(f)  fireplace and chimney below the roof line

(g)  all communications, television, telephone, cable, electrical lines serving one unit

(h)  rear deck, deck board painting and replacement as needed

(i)  courtyard, landscaping and maintenance per the "Courtyard Resolution"

(j) skylights

(k)  dryer and furnace vents serving the unit, excluding roof vents

(I)  sump pump within or serving the unit

(m) crawlspace including insulation and moisture barriers

(n)  attic

(o)  whole house fans

(p)  radon units

(q)  venting systems

(r)  hot water heater

(s)  heating and air conditioning units for the unit

(t)  garage, including interior, cement floor, garage door and opener

(u)  light fixtures and bulbs inside or outside the unit

(v)  any improvements to the unit and/or Common Elements

Some unit improvements, exterior and those affecting other units, may require an Architectural Control Committee Application to be submitted and approved by the Association Board.
