100 years ago The entire section was cleared and cross fenced and agriculture was commenced.

61 years ago Smith sold the Brown the "Easterly 1/2 of the SW ¼ of Section 15." Brown fenced his dividing line and began possession.

60 years ago Smith sold land to Williams by deed, "Beginning at the southwest corner of Section 16, thence North1320 ft to an iron pipe, thence East 1320 ft to an iron pipe, thence South 1320 ft to an iron pipe on the section line, thence West 1320 ft along the section line to the POB." Williams fenced his parcel, and began possession and agriculture.

50 yrs ago Smith dies leaving all his land to his estate.

Today Sipe buys land from the estate described as "the SW ¼ of Sec. 15 less the land sold to Brown and Williams." Sipe hires you to do a survey of his property. The attached graphic is a scaled map of all the pertinent features in Section 15. You do an excellent retracement job and uncover the true original SW Corner of Section 15 without a doubt. Apparently the fence corner believed for years to be the section corner is hundreds of feet from the real section corner.

Process Use a straight edge to construct the various deed locations. You can use the provided scale to measure distances (make marks on the edge of a sheet of paper). Analyze the by likely "scenario" which caused the current situation. Develop deed location opinions for: Sipe, Williams, Smith estate's remaining land, Brown, Clark, White, Black. (or their successors in title using the same descriptions). Identify ownership conflict zones and state the conflicting claims. For deed overlaps or gaps, give an ownership opinion.

In your analysis, answer the following questions: Describe the scenario by which the original cross fencing was done. Describe the scenario by which Brown fenced the new parcel. Describe the scenario by which Smith/Williams set the pipes and Williams fenced the new parcel.
