Deputy Supervisor Quinn called regular town board meeting to order at 6:05 p.m. opening with the Pledge of Allegiance.

1. Town Board Congratulates

Town Clerk:

Deputy Supervisor Quinn read letter received from the New York State Town Clerks Association honoring Town Clerk Laurie Fuller as a Registered Municipal Clerk. Town Board members congratulated her on receiving her award.

2. Approve Minutes:

Town Clerk provided each board member a drafted copy of minutes dated April 13th & April 21st 2017 for approval.

Motion to approve minutes as written for meetings dated April 13th & April 21st 2017 was made by Councilman Dechene.

Good Evening!

Spring Sports: Spring volleyball has been practicing for a few weeks now, with 30 5th and 6th grade girls in the program, coached by Diane Helms. Volleyball is every Monday and Thursday until June 1st, from 6-7:30p at the High School Gym. . Girls Softball began practicing last week on Tuesdays/Thursdays from 6-8p at Municipal park, with 26 girls currently enrolled in the program. Game travel is set to begin for the U10 team May 23rd and the U14 team June 6th. Registration deadline for Spring Baseball is Friday, May 12th. Baseball will begin Monday, May 22nd and will end Wednesday, June 28th. Baseball will be held Mondays and Wednesdays from 5-6:30pm at Municipal Park. The cost to participate is $15/player or $30/ family.

Job Opportunities: The Town of TL is now accepting applications for all summer job openings. The following opportunities are in the following job titles; Lifeguard, Water Front Director, and Day Camp Counselors. All applications, physicals and certifications (when applicable) MUST be in no later than May 15, 2017 to be considered. Beach Caretaker: Our new Beach Caretaker has hit the ground running! We are working on getting the campground and beach up and ready for opening weekend May 25th!

Grants: Summer Day Camp was lucky enough to have won two grants for this upcoming summer! From the Franklin County Youth Bureau we received a $1000 grant for transportation to events and a Community Discussion Reading Initiative Program grant through Humanities NY. The students will be exploring a tool kit provided by the not-for-profit discussing Friendship as expressed through a specific children’s novel. Day Camp will be partnering with the Goff Nelson Library to host the event.

Day Camp: We are planning an action packed summer for the youth of Tupper Lake! We are adding a ton of new and exciting activities that have never before been provided. Stay tuned and keep your eye out for the official drop of the Day Camp Calendar! J

-Picked up piles of sand on Sunset Ave, Broad Street, Bushey Ave, Stetson Road, Larkin Ave, Beckey Ave, Hosley Ave, Old Wawbeek and Racquet River drive.

-Swept all town roads.

-Took Road posted signs down as of 05/01/17.

-Cleaned around the town hall and Maddox Hall.

-Took down the cross country ski signs at the bottom of Country Club Rd and at the Country Club entrance and put into storage at the Country Club along with the grooming equipment.

--Hauled 160 tons of stone dust from Saranac Lake Quarries to the town garage for stock pile for future use.

-Hauled 160 tons of coarse crusher run from Saranac Lake Quarries for stock pile for future use.

-Painted one way plows and wings on unit 54 and 55.

-Serviced the tractor at the beach.

-Cold patched potholes as needed.

-Weekly dump run for the town hall and Maddox Hall.

-Repaired the driveway entrance at 35 Gull Pond Road due to poor drainage.

-Cut and chipped down trees on the sides of the road that had fallen over the winter.

-Cleaned up storage area at the Country Club for future use to store sand and crushed stone.

-Hauled 90 tons of fine crusher run from Thauhas to the Country Club for their use.

-Ryan helped John turn the water on at the beach for the season.

-Currently raking at the beach.

-Sanded and painted the flag pole for the Country Club, just waiting for the solar light to come in to put the flag pole back up.

5. Committee Reports:

Councilwoman Luton reported Youth Activity director will need to hire another Swimming Instructor, Miss Luton has step down from positon, and Dog Control Officer is up to date with reports.

Councilman Dechene reported Country Club Restaurant is up and running, golfing limited due to weather conditions, thanked highway crew for hauling crusher run for cart paths. $400.00 in garbage was taken off property; still have barrels of kitchen Greece need to get rid of.

Front stairs at Rod & Gun Club are in need of repair Mike Donah has started to repair them feels they are beyond repair and should be tore out. Possibly tear out right to building. Stone may be worth something probably save and store at garage. Paul will take a look and see what is required for code.

Deputy Supervisor Quinn reported the caretaker for Littlewolf has been busy getting ready to open. Supervisor Littlefield & Councilman Quinn had a meeting with Attorney Gagnier on future of train station, also meet with DANC about update on Water& Sewer Consolidation.

Councilwoman Fontana also thanked Highway Crew and had a discussion with Supervisor need to review policies on renting out Pavilion at Littlewolf should have insurance and one day event permit, Attorney Gagnier should take a look at new policy.

6. Approve Garden Compost:

Paul O’Leary explained the Community Garden group wants to set up a compost station approximately 100 sq. ft. at the Community Garden location at Town Hall. $600.00 dollars has been raised to help with cost of concrete blocks. Blocks are 6Lx2Wx2H have enough money to purchase 7 blocks.

Councilman Dechene made motion for compost set up for the Community Garden and anyone wishing to use it.

Zoning and Land Use Code Development

Introduction

The Town and Village of Tupper Lake propose to engage the services of a land use planning consultant to guide the community through a review of its Joint Land Use Code and subdivision regulations to ensure compatibility with Tupper Lake’s 2013 Revitalization Strategy. The consultant will also assist the community in review of previously adopted design guidelines and consideration of adoption of design standards to advance the community’s revitalization goals.

Ensuring that the existing Joint Land Use Code and subdivision regulations support Tupper Lake’s efforts to achieve its vision and goals is an essential step in its tourism destination development efforts.

This project will be funded by Local Waterfront Revitalization Program grant award #C1000547 from the Department of State. $40,000 in funding is available for completion of the project, described in the scope of work that follows.

Motion to approve sending Request for Expression of Interest for Land Use Planning Consultant Services was made by Councilman Dechene.

9. Approve Littlewolf Concession Agreement:

CONCESSION AGREEMENT

THIS AGREEMENT made this 11th day of May, 2017, between the TOWN OF TUPPER LAKE, a municipal corporation of Franklin county, New York with offices at 120 Demars Boulevard, Tupper Lake, New York (hereinafter referred to as the “Town”), and John Sparks II of Tupper Lake, New York (hereinafter referred to as the “Concessionaire”);

WITNESSETH:

WHEREAS, the Town owns and operates the Little Wolf beach, Picnic area and campsite in the Town of Tupper Lake, which includes a snack bar; and,

WHEREAS, the Concessionaire has been employed by the Town to operate the Little Wolf beach, campsite and picnic areas, and as part of the consideration for Concessionaire’s duties to maintain and control those areas, the Town will grant the Concessionaire the concession to operate the snack bar at the beach.

NOW THEREFORE, for valuable consideration and in consideration of the mutual promises conveyed herein, the parties hereby agree as follows:

The Town grants to the Concessionaire the sole and exclusive right and privilege to operate the Little Wolf snack bar for the period beginning with the date this agreement and terminating with close of the campsite and beach area in September of 2017.

The Concessionaire shall have the exclusive occupancy of the snack bar building at the Little Wolf beach for the term of this agreement and shall operate the snack bar during the hours of the snack bar beyond the beach area hours, if he so desires. The Concessionaire shall operate the snack bar on a basis substantially similar to previous years, and shall be solely responsible for the purchase of food and other items for sale, and shall be entitled to retain all of the proceeds of such sales.

The Town shall be responsible for all electricity and other utilities furnished to the campsite and snack bar, as well as all cleaning and other supplies necessary to operate and maintain the beach, campsite, snack bar, picnic area and restrooms as required hereunder.

The Town assures the Concessionaire that the cooking and refrigeration equipment in the snack bar will be in working order at the commencement of this agreement. The town will replace or repair equipment due to ordinary wear and tear, and Concessionaire will make all repairs to such equipment as a result of any damage caused by himself or his agents or representatives or otherwise.

The Concessionaire assumes all risk in the operation of the snack bar pursuant to this agreement and shall be solely responsible and answerable in damages for all accidents or injuries to person or property resulting therefrom. Concessionaire hereby covenants and agrees to indemnify and keep harmless the Town and its officers and employees from and all claims, suits, losses, damage or injury to person or property of whatsoever kind and nature, whether direct or indirect, arising out of the operation of said snack bar pursuant to this agreement or the carelessness, negligence or improper conduct of the concessionaire or his servants, agents or employees.
