Wings to Fly Club Membership Agreement

By joining the Wings to Fly Club (“WTFC”), you are accepting all the terms in this agreement.

When you become a member of WTFC, you agree that we may contact you by telephone, mail, or email regarding club news and information.

This Agreement contains all of the terms and conditions applicable to your use of the services provided to you through your WTFC membership. If you do not wish to agree to be bound by the terms and conditions of this Agreement, please do not sign this Agreement or enroll in WTFC.

You must read, agree with, and accept all of the terms and conditions contained in this Agreement, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of WTFC.

We may amend this Agreement at any time by posting the amended terms on the WTFC web site or by providing you with notice of the amended terms via any other means. Except as stated below, all amended terms shall automatically be effective 30 days after they are initially posted on the web site or otherwise provided to you. This Agreement is effective upon your acceptance as a member of WTFC by the management of WTFC.

MEMBERSHIP ELIGIBILITY:
Our services are available only to, and may only be used by, individuals who can form legally binding contracts under applicable law. WTFC allows one, single membership per individual. If you are an experienced Hang Glider or Paraglider pilot who is not on student status, you must be a member of the United States Hang GlidingAssociation (USHGA) and a member of the Ohio Flyers Association (OFA) to be eligible for club membership. If you do not qualify for eligibility, please do not join WTFC.

MEMBERSHIP CANCELLATION:
You may cancel your membership at any time by notifying one of the management representatives of Wings to Fly ltd.

FEES:
Joining WTFC is free of charge.

TERMS AND CONDITIONS:
As a member of WTFC, you agree to abide by the rules and regulations of the club as promulgated by Wings to Fly ltd from time to time. Copies of those rules and regulations will be made available to you upon request.

BREACH:
Without limiting other remedies, we may limit your activity, issue a warning, temporarily suspend, indefinitely suspend, or terminate your membership, and refuse to provide our services to you if: (a) you breach this Agreement; or (b) we are unable to verify or authenticate any information you provide to us.

GENERAL:
This Agreement shall be governed in all respects by the laws of the state of Ohio as such laws are applied to agreements entered into and to be performed entirely within Ohio between Ohio residents. We do not guarantee continuous or uninterrupted access to our services, and operation of the hang gliding club activities may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

Wings to Fly Club Rules
Issued October 30, 2004 (all prior rules are hereby superceded)

1. All WTFC club members must have signed the form of waiver and release used by Wings to Fly ltd at the time prior to engaging in any club-related activities.
2. WTFC members who are required to maintain current USHGA and OFA memberships will immediately notify Wings to Fly ltd in the event that their USHGA and/or OFA membership lapses for any reason.
3. WTFC members who are required to maintain current USHGA and OFA memberships will not participate in any club-related flying activities unless they have a current USHGA and OFA membership.
4. All WTFC members will familiarize themselves with the basic safety requirements (BSRs) and will observe the BSRs (unless waived as provided in the BSRs).
5. All WTFC members who participate in connection with any club-related flying or towing activities shall strive to maintain their physical and mental fitness.
6. All WTFC members who participate in any club-related flying or towing activities will at all times comply with all applicable laws and regulations in connection with such activities.
