The enforcement of codes violations will commence in the near future. While not many violations have been identified so far, some that were are deserving of immediate attention from the Marshal’s Office. It is my understanding that residents of Green Mountain Falls have been very willing and prompt in addressing those violations that have been pointed out and it is my hope that this community pride and spirt will continue.

I would ask that all residents familiarize themselves with Chapter 7 and Chapter 8 Section II of the Green Mountain Falls Municipal Code. The Municipal Code can be found at theTown of Green Mountain Falls’ Website and clicking on the Municipal Code tab.

Additionally, I will begin review of business licensing and will be completing site visits to assure compliance with Town Ordinance. The ordinances concerning business licenses can be found in Chapter 6 of the Town of Green Mountain Falls Municipal Code.

Some of the most common violations that will be focused on are (but are not limited to)the following:

Sec. 7-74. - Duty of property owner to cut.

It shall be the duty of each and every person owning, occupying or possessing any lots, tracts or parcels of land within the Town to cut to the ground all weeds and brush when said weeds and brush grow to a height of twelve (12) inches or more.

Sec. 7-148. - Barking dogs prohibited.

No person owning or keeping a dog shall fail to prevent such dog from disturbing the peace and quiet of any other person within the Town by loud, and/or persistent barking, baying, howling, fighting, yipping, crying, yelping or whining, whether the animal is on or off the owner's or keeper's premises.

Sec. 7-92. - Running at large prohibited.

It shall be unlawful for any owner of any animal to permit the same to run at large within the Town.

Sec. 7-131. - License required.

t is unlawful to own, keep or harbor a dog within the Town unless the same is licensed by securing a license for such dog from the Town Clerk on or before January 31 of each year or within thirty (30) days after the dog reaches the age of three (3) months. Dogs purchased, obtained or otherwise acquired subsequent to January 31 in any calendar year shall be licensed within thirty (30) days after becoming such residents to secure a license hereunder. Said license shall be issued by the Town Clerk upon application stating the name, breed, color and sex of the dog, and name, address and phone number of the owner and upon production of satisfactory evidence that such dog has been inoculated against rabies pursuant to prevailing standards of the Colorado Department of Public Health or other controlling agency, and upon payment of the license fee.

Sec. 7-42. - Accumulation of refuse; prohibited and declared nuisance.

Any accumulation of refuse on any premises, improved or unimproved, in the Town is prohibited and is hereby declared to be a nuisance.

Sec. 8-24. - Junk vehicles on property.

No person in charge or control of any property within the Town, whether as owner, tenant, occupant, lessee or otherwise, shall allow any junk vehicle to remain on such property longer than thirty (30) days; except that this Section shall not apply with regard to a vehicle within an enclosed building, a vehicle on the premises of a business enterprise operated in a lawful place and manner when necessary to the operation of such business enterprise, or a vehicle in an appropriate storage place maintained in a lawful manner by the Town.

  • Junk vehiclemeans any of the following:
  • a. Any inoperable motorized vehicle;
  • b. Any nonmotorized vehicle which is not capable of highway travel in connection with its normal power source;
  • c. Any vehicle not bearing current license plates, unless exempt from registration, to be consistent with State statutes regarding licensing and registration.

Ample warning and discussion will be provided per Code in the enforcement of these ordinances and codes.

Serious violations that impact public health, safety or welfare or are determined to constitute a public nuisance may be cited immediately and without warning.

Parking violations may be cited immediately for any of the following:

Parking in handicapped spaces without appropriate plates or placards

Blocking residential or business driveways (towing of vehicles may be required)

Parking in a traffic lane (12’ of clearance is required for access to areas by emergency vehicles, towing of vehicles may be required)

Parking in a no parking zone as established by the Town of Green Mountain Falls. (Trail heads and other posted areas, towing of vehicles may be required)

Within 15’ of a fire hydrant

Blocking any alley owned by the Town of Green Mountain Falls (unless the vehicle is making a delivery and is stopped for a reasonable amount of time for the purpose of loading or unloading)

The Marshal’s Office respectfully asks for all residents to be cognizant of the codes enacted by the Board of Trustees and to abide by these codes and ordinances in a community wide effort to keep Green Mountain Falls a shining example of small town life that it has become.
