General Information, Terms, Conditions and Registration

This September 26 – October 2, 2015 tour is offered by the Western Reserve Section of the Mercedes-Benz Club of America, Inc solely as a service to club members. To register, read, answer and acknowledge the following three pages, and send with an event organizing fee of $450 per person (payable to Western Reserve Section - MBCA). Payments can also be made by PayPal through the Western Reserve Section website If paying by PayPal, please forward the registration materials to Ron Harshman.

General Details: An Approximate Itinerary of this Tour along with suggested lodging accompanies this Registration. A route map with suggested daily destinations will be provided to you after registration. Daily schedules are suggestions. There is no cut off date or limit to the number of participants however designated headquarters hotels/motels and some group dinners have space limits and reservation deadlines. .

Lodging and Tour Expenses:Make lodging reservations directly at each evening’s destination. Headquarter lodgings with phone numbers and approximate price are included in the Itinerary. Reservations must be made on or before August 15, 2015 to insure lodging at the suggested hotels. You are under no obligation to use designated lodging. Designated headquarters inns/hotels/motels have special pricing for the tour, recognizing that there will be individual preferences for exact room features. Participants are responsible for all personal expenses, i.e. telephone charges, laundry, valet, side trips, alcoholic beverages, and all other items not selected à la carte as in the next paragraph.

Trip Options: There will be some meals during the tour requiring advanced catering arrangements. Based on the size of our group at various destinations, final price quotes may be different then the original and may require additional deposits in August applicable to the number of people in your party. These include a kick-off dinner; the cooking school in Picton, Ont.; the concluding dinner at the Ballroom 384 in Rochester; a boat tour and visit to Boldt Castle, and box lunch during the tour.

Fees: Enclose a fee of $450 per person . Cancellations, less $25, will be honored until additional reservation deposits (as in Options paragraph above) are collected in August. After that date catering commitments may make it impossible to give refunds. Registration form is provided on the following page.

I understand and agree that the Western Reserve Section of MBCA and its trip leaders are acting only as agent for tour participants and assumes no liability whatsoever for injury, damage, loss, accident, delay and/or irregularity which may be occasioned by any reason whatsoever, including but not limited to defect in any vehicles, or the acts or omissions of any company or any person transporting, accommodating or serving the trip participants. The Western Reserve Section of MBCA assumes no liability whatsoever for losses or expenses due to delay or changes in air or land transportation, hotel accommodations and/or other services. All such losses or expenses will be borne by the trip participant. In the event the services and/or accommodations offered cannot be supplied or in the event of a deviation in itinerary due to causes beyond the control of the Western Reserve Section of MBCA, reasonable efforts will be made to offer comparable services and or accommodations, but this cannot be assured, and no refund will be made.
B. Each and every trip participant waives and releases any claim whatsoever against the Western Reserve Section of MBCA, trip leaders, any and all other parties and their representatives, agents, employees, officers and directors for any damage to or loss of property, or for injury to or the death of any person, due to or arising out of (i) any act or omission of any entity or any person, including, but not limited to, those rendering services and/or accommodations included in the trip itinerary and (ii) any circumstance, cause or condition incurred or experienced during the trip.
C.The Western Reserve Section of MBCA and all other parties cannot be held liable for lack of performance under “force majeure” circumstances (including, but not limited to, war, riot, insurrection, terrorism, acts of god, strikes, and labor stoppages).
D. Each and every trip participant (i) authorizes and consents to treatment, hospitalization and other care rendered to them in the event of their illness, injury or other emergent circumstance that may occur while participating in the trip and (ii) assumes full responsibility to pay for all costs and expenses for any such care or treatment (therefore, agreeing to fully hold harmless and indemnify MBCA therefore).
E. Acceptance of the trip participant’s registration form and deposit shall be deemed to be participant’s consent to all terms and conditions, including the provisions of the waiver, release and consent to medical treatment set forth above.

Right to Accept, Reject or Remove Participants: The Western Reserve Section of MBCA retains the right to accept, reject or remove any person as a trip participant.
