We acknowledge receipt of theclaim for an accident which occurred on the above date. We have conducted a review of coverage provided by the insurance policy issued to you. We have compared the policy to the claims being presented against you andMarin Parpaut and must inform you there is no coverage for these claims.
The facts of this accident indicateMarin Parpaut was driving the listed2000 Toyotawhen hewas involved in an accident with a 2012Nissanowned and driven by Irene Fok. You advised Marin Parpaut is your son and had been a resident of your household for about six months.Marin Parpautis not listed as a driver on the Declarations page of your policy. You had not notified us or your agent of the additional driver in your household.
Omni Insurance Company issued personal auto policy number 5638130 to you with effective dates of 12/31/2013 through 06/30/2014. The policy limits for liability coverage under this policy are $25,000/$50,000/$10,000. The pertinent policy coverage form is 0846. (If you desire a copy of this policy, please advise).

Coverage your policy provides is limited by a number of exclusions. The exclusions list those risks for which coverage is specifically not provided. In particular please see under Part A - Liability Coverage, Exclusion number 14 which states the following:
EXCLUSIONS
A. Wedo not provide Liability Coverage for any insured:
14. For bodily injuryor property damageresulting from the ownership,
maintenance or use of any vehicle byany resident, including a family
member, of yourhousehold who is notlisted on the Declarations page as
adriver or operator.
Since it has been determinedMarin Parpaut is a resident of your household and Marin Parpautis not listed on the Declarations page of your policy as a driver, we maintain the above exclusion applies. Therefore, we respectfully disclaim any duty to indemnify you or Marin Parpaut for the property damage and/or bodily injury claims arising out of this unfortunate accident.
The grounds for our disclaimer of coverage asserted in this letter are stated to inform you of our current coverage position. The Omni Insurance Company reserves the right to supplement, modify and amend our coverage position in this letter as new facts are learned or new allegations are made. The Omni Insurance Company does not waive any coverage defenses available, either under applicable policy(ies) or the law, by failing to expressly set those out in this letter.
If you have other auto insurance coverage, we recommend you notify that carrier of this accident. If you have any questions regarding our coverage position, or take exception to it, please advise the undersigned immediately of the basis for your disagreement. If there are additional facts which you feel should alter Omni Insurance Company’s coverage position, please promptly advise me as to those facts in writing.
