Definitions:

“campus” means buildings used in whole or in part to offer post-secondary education programs to students or provide recreational or residential services to students; areas leased by post-secondary institutions that are used to offer post-secondary education programs to students or provide recreational or residential services to students; buildings owned by post-secondary student unions that are used in whole or in part to offer post-secondary education programs to students or provide recreational or residential services to students; and areas leased by post-secondary student unions that are used to offer post-secondary education programs to students or provide recreational or residential services to students

“electronic cigarette” means a vaporizer or inhalant-type device that contains a power source designed to heat a substance and produce a vapour intended to be inhaled by the user of the device directly through the mouth whether or not the device contains nicotine.

“enclosed public place” means the inside of any place, building, structure, vehicle or conveyance, that is covered by a roof and to which the public is ordinarily invited or permitted access;

“enclosed workplace” means any place, building, structure, vehicle or conveyance that is covered by a roof and in which employees work or frequent during the course or their employment and that is not primarily a private dwelling;

“playground or play area” means an area primarily used for the purposes of children’s recreation and equipped with play equipment, but not a residential location

“private dwelling” Without limiting the generality of the expression, private self-contained living quarters in any multi-unit building or facility are private dwellings

“sporting area” means an area that is used primarily for the purposes of sports such as soccer, football, basketball, tennis, baseball or beach volleyball and includes adjacent spectator areas

Purpose/Reason for Policy:

The purpose of this policy is to support Trent University’s compliance with the Smoke Free Ontario Act, Regulation 48/06 made under the Act and the Electronic Cigarettes Act, 2014 (Bill 45).

Scope of this Policy:

This policy governs the use and sale of tobacco products on Trent University premises or those spaces over which Trent University has control (e.g. leased space), including all private dwellings, but does not include the property known as 2299, 9th Line, Douro.
This policy is effective immediately.

This policy does not apply to tobacco used for traditional Aboriginal cultural or spiritual purposes. It does not apply to tobacco used for scientific research or testing, or to approved products intended for use in nicotine replacement therapy.

Policy Statement:

No person on a Trent University campus shall
  • sell or supply tobacco, tobacco products, or electronic cigarettes
  • smoke tobacco, hold lighted tobacco, or smoke electronic cigarettesin
  • in any residence room, enclosed public place or enclosed workplace including but not limited to, common rooms, elevators, exercise areas, hallways, garages, laundry facilities, lecture halls, lobbies, seminar rooms, theatres, University-owned vehicles, washrooms, and workshops
  • in children’s playground or play area
  • in a sporting area
  • in a restaurant or bar patio
  • within 9 m of a University building entrance, operable window or air intakewithin 20 m of a sporting area or children’s playground.
Ashtrays are not permitted in enclosed workplaces, except vehicles where installed by the manufacturer. Ashtrays will not be located within 9 m or any University building entrance, air intake or operable window; or within 20 m of a sporting area or children’s playground.

Trent University will post and maintain the prescribed “no smoking” signs at all building entrances and exits, children’s playgrounds, patios and sporting areas

Responsibilities:

The Associate Vice-Presidents, Deans, Directors, Executive Directors, University Registrar and University Librarian, in accordance with the responsibilities delegated by their respective Vice-Presidents, are responsible for communicating and upholding this Policy.

APPENDIX ‘B’

PROCEDURE
/ PROCEDURES TO SUPPORT THE IMPLEMENTATION OF THE SMOKE-FREE POLICY
Environmental Health and Safety Officer
PROCEDURE / Purpose / Implementation of the Smoke-Free Policy.
Procedure / The University will implement this Policy by taking the following steps.
Risk Management Department / Step 1: The Joint Health and Safety Committee will review this policy, procedure and guideline document at least annually. The Committee will forward their endorsement or recommendations to the President of the University, in writing.
President / Step 2: The President will respond to the Committee, in writing, within 21 days. If the President does not agree with the recommendations, the President will give the reasons why (s)he disagrees.
President / Step 3: A new or amended Policy will be forwarded to the President/Vice-Presidents (PVP) group for approval.
Risk Management Department / Step 4 : A new or amended Policy, once approved, will be forwarded to all University Managers and Supervisors. An electronic copy will be posted on the Health and Safety website and distributed to members of the Joint Health and Safety Committee.
University Managers and Supervisors / Step 5: Managers and supervisors will ensure their employees, contractors, students, or guests are familiar with the requirements of this policy, as required.

APPENDIX ‘C’

GUIDELINE
/ Smoke-Free Guideline

Purpose
To provide guidance to University Managers and others responsible for the communication and implementation of this policy.
Guideline
Trent University is committed to providing protection from second-hand (environmental) tobacco smoke but recognizes tobacco is an addictive substance and acknowledges the need to provide support for those with tobacco additions, where possible.
Associate Vice-Presidents, Deans, Associate Deans, Directors, Registrar and University Librarian are expected to take a leading role in communicating and upholding this policy and for providing support for smoking cessation where possible. All members of the University community are encouraged to help communicate this policy and direct smokers to designated smoking areas.
University employees who continue to violate this policy will be subject to progressive discipline within the terms of their Collective Agreement, as applicable. Residence students will be subject to progressive discipline within the terms of their Residence Agreement.
Campus Security is available to assist and investigate, as required.
Inspectors appointed by the Ontario Ministry of Health Promotion may conduct inspections of University buildings. Where contraventions are found, Inspectors may issue orders or issue personal or corporate fines.
In addition to the responsibilities outlined above, the Physical Resources Department supports this policy by ensuring all building entrances are posted with the Smoke-Free Ontario logo (see Appendix A) and by ensuring ashtrays are placed in convenient locations outside of the smoke-free areas. Risk Management Department has developed a Smoke Free website as well as awareness posters and postcards (available to all University departments) maintained in consultation with the Joint Health and Safety Committee.
