STUD AGREEMENT

An agreement between J.E. & L.J. Williams, of Avoca Park Clydesdale Performance Horses, Macclesfield Victoria (03) 5968 9058, the stallion owner and, ______

Phone (___) ______the mare owner.

CONDITIONS OF STUD

The full fee of the stallion AVOCA FLAUNT IT amounting to $______must be paid upon arrival of mare to the stud.

This fee will not be refundable to the mare owner.

Agistment will be charged at the rate of DRY MARE Private paddock $15 per day

WET MARE Private paddock $20 per day

A foal handling fee of $______will be charged if the mare has a foal at foot.

Fourteen (14) days notice will be given by phone or post to remove mare or mare and foal from stud.

Mares not collected within 14 days notice will be given, will be charged agistment at the rate of $20.00 per day.

The cost of Veterinary attendance for pregnancy tests or otherwise will be paid by the mare owner. Vets may be called when and if necessary at the direction of the stud.

The balance of the fee of veterinary costs, hoofcare, drenching and agistment must be paid CASH on or before removal of mare or mare and foal from the stud. Bank cheques or ordinary cheques will be cleared before removal of mare or mare and foal.

Any mare not removed within 90 days of notice being given to do so, will be sold by auction of private treaty sale. Any equity in the sale price exceeding the amount owing to the stud after deduction of agents fees and advertising will be returned to the mare owner.

A free return service applies to mares whose foal fails to live to twenty-four (24) hours old. A veterinary certificate to certify death and cause must be produced. Normal agistment, veterinary costs, hoofcare, drenching and a two hundred dollar handling fee will apply. The free return must be taken the next breeding season (______). If the said stallion is not available to public stud, the stallion owner will refund the service fee except for the ($200.00) handling fee.

After the mare arrives at stud the stallion owner will obtain a veterinary certificate certifying that the mare’s reproductive organs are normal and suitable for breeding and a uterine culture taken by swab while the mare is in season before breeding

Upon the mare owner sending the mare or mare and foal to the stud it is deemed that they have inspected the facilities and consider them adequate and agree with the management practices of the stallion owner. No responsibility will be taken for accident or otherwise occurring to the mare and/or foal while at the stud.

In consideration of the mare owner accepting the terms of this contract, the stallion owner will give the mare or mare and foal every possible care and attention, including the adequate feeding of the mare or mare and foal while agisted at the stud.

The mare owner agrees to release the stallion owner from all liabilities and demands by any third party whether arising directly or indirectly or howsoever and whether for personal injury, property or other damage whatsoever out of the presence or activity of any mare or foal owned or leased by the mare owner, for injury or damage to any mare or foal whilst at the
