I.Call to Order & Introductions

Chair Jim Dixon called the meeting to order at 2:00 p.m. CST, and Programs Chair Kelly Dvorak introduced this month’s LQH speakers.

II.Legal Quick Hit – The United States Environmental Protection Agency’s Clean Power Plan: What does it mean for me? This LQH educated members on how utilities will be impacted by the EPA’s new Clean Power Plan, which regulates greenhouse emissions from existing power plants. The LQH also discussed impacts and opportunities for the utility industry. The LQH was presented by Emily L. Seidman of Sutherland Asbill & Brennan LLP.

III.General Information of Importance to all Energy Committee Members: Chair Jim Dixon reminds all Energy Committee members to register for the annual ACC conference. There will be an increase in the registration fee after September 9, 2015.

In September, the Energy Committee will conduct another in-person webinar at Sutherland’s office in Houston, Texas. Please submit any ideas you might have to any of the Sutherland members or Kelly Dvorak.

IV.ACC Member Benefits Spotlight: Tori Payne, ACC’s Senior Director of Committees, provided a short overview of the ACC Awards program. Some of the most prominent awards include the Top 10 30-Somethings, ACC Committee of the year, ACC Corporate Pro Bono Award, Matthew J. Whitehead, II Diversity Award, ACC Member of the Year, or the Excellence in Corporate Practice Award.

VI.Program Chair (Kelly Dvorak) Report: The Committee’s two programs have been progressing nicely. The program materials have been submitted for ACC approval. These two panels promise to be enlightening and entertaining.

Please note that at our sponsor’s annual meeting booth, we have a short 6 question survey. Completing this survey will enable the Energy Committee to improve its member offerings.

VII.Resources Chair (Stefano de Stefano) Report:

Recently released resources include:

  1. Ten Tips for Managing a Software Audit;
  2. US Sanctions: What’s New and What Energy Firms Need to Know
  3. US Bankruptcy and Derivatives: From Negotiation Through Default

Coming soon, Resources Chair de Stefano is collaborating with Sutherland on these additional resources:

  1. November 17thwebinar: A Primer on the International Swaps & Derivatives Association (ISDA) Resolution Stay Protocol for Firms that Trade Commodities; and
  1. December 2ndwebinar: A Look Back at the Year in the US Commodity Futures Trading Commission (CFTC) Enforcement and What Lies Ahead in 2016.

VIII.Membership Chair (Ashlee Effler) Report: The Energy Committee is up to 2,020 members, which is a new high for the committee. The Committee plans to send out one more email blast this year to potential members.

IX.Communications Chair (Liz Schultz): The Energy Committee newsletter is going out today and it provides a quick links to all of the Committee’s latest resources. It also lists the Committee’s need for liaisons to different energy sectors. The liaisons will keep the Committee on up to date on the latest niche-topic news.

X.Committee Sponsor’s Report:

  1. October 1, 2015: Sutherland is providing a live update on the Macondo litigation and a top ten list of what-not-to-do during crisis litigation. This live update will be held in Houston, Texas at McCormick and Schmick’s. An invitation to that eventgo out shortly.
  1. October 18, 2015: At the annual meeting, Sutherland is hosting a party on Sunday night at the Top of the Hub, which is within walking distance of the conference. Invitations are forthcoming. The party is from 8:00 – 11:00 p.m.
  1. October 19, 2015: On this date, Sutherland is sponsoring the Energy Committee’s two panels. Sutherland is also providing three giveaways at the Energy Committee’s in-person business meeting. If members complete the survey or attend the meeting, they’ll be eligible for an iPad mini, FitBit, or Bose nose cancellation headphones.

XI.ACC Report: JB Pessey reminded members to check where ACC’s upcoming events are listed. A few highlights are:

  1. September 21, 2015: ACC Law Department Leadership 2.0 in Toronto, Canada
  2. April 10-12, 2016: ACC Mid-Year Meeting in New York, New York
  3. June 12-14, 2016: ACC’s Corporate Counsel University in San Diego, CA.
