Annex 4: Partnership Statement

I, the undersigned, being the statutory representative of the insert the name of the project partner organization as a partner organization hereby declare that:
/ The partner organisation I represent:is not bankrupt, being wound up, or having its affairs administered by the courts, has not suspended business activities, is not subject of proceedings concerning those matters, nor is it in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
has not been convicted of an offence concerning its professional conduct by a judgement which has the force of ‘res judicata’;
has not been guilty of grave professional misconduct proven by any means which the MA/NA can justify;
has fulfilled its obligations relating to payment of social security contributions or the payment taxes in accordance with the national legal provisions;
following another procurement procedure or grant award procedure financed by the Community or national budget, has not been declared to be in serious breach of contract for failure to comply with its contractual obligations:
/ we confirm the content as well as our role in the project;
/ we will accept the obligations as a project partner deriving from the subsidy contract, which will be signed by the Lead Partner in case of the project approval;
/ we have the adequate legal, financial and operational capacity to complete the proposed project including the capacity of project pre-financing;
/ we declare that we are not in receipt of any double funding for the same project activities.
Own contribution to project budget
Herewith we also declare to secure EUR insert amount, representing <insert percentage>% of the Project Partner’s total eligible costs as own funds (own co-funding).
The Lead Partner and Project Partner agree on the following:
/ the Lead Partner is authorized to sign the subsidy contract on the part of the whole project partnership and is the only organization communicating with the Managing Authority; / the Lead Partner must consult regularly with project partners and keep them fully informed of the progress of the project;
/ the Lead Partner and the Project Partner shall determine their rights and
obligations in the Partnership Contract, following the provisions suggested by the Managing Authority;
/ proposals for substantial changes to the project (e.g. partners, etc.) must be agreed by all partners before being submitted to the Managing Authority;
/ the Lead Partner and the Project Partner undertake to comply with the principles of good partnership practice.
