REGULAR MEETING

At aregular meeting of the Board of Trustees of the Village of Fredonia, duly called and held on the 8th day of January 2018, at 7:30 p.m. in the Trustee’s Room, 2nd Floor, Village Hall, Fredonia, New York and public notice of the time and place of this meeting has been given to the news media and conspicuously posted in one or more designated public locations in accordance with Section 104 of the Open Meetings Law.

WHEREAS members of this Board present at this meeting have read the Official

Minutes of the Board of Trustees Regular Meeting ofDecember 11, 2017, and Special Meeting of December 18, 2017,

NOW, THEREFORE, BE IT RESOLVED this Board approves the minutes as entered the Official Minutes, and

BE IT FURTHER RESOLVED that the reading of the minutes be dispensed with.

REPORTS

1.The Police Department report for the month of December 2017.

2.The Police Department annual report for the year 2017.

CORRESPONDENCE

  1. Correspondence was received from the Secretary of the Fredonia Volunteer

Fire Department to re-instate Tyler DiRusso to the active rolls.

BE IT RESOLVED that the name of Tyler DiRusso, 192 West Main Street, Fredonia, is hereby re-instated to the active rolls of the J.S. Lambert Hook and Ladder Company effective immediately.

BE IT RESOLVED that the following appointed officials and employees are hereby appointed/reappointed to their respective positions and at their present salaries and benefits or salary and benefits as modified by Board resolution or budget adoption for the ensuing official year commencing January 8, 2018 and ending January 14, 2019 and until their successors are appointed and qualified, unless sooner removed from office or employment as provided by the Charter or other applicable law:

1. Administrator (Clerk-Treasurer) - Richard R. St. George

2. Chief Inspection Officer, Building - Chuck LaBarbera

Inspector, Zoning Enforcement Officer

3. Parks and Recreation Director - Thomas Battaglia

BE IT FURTHER RESOLVED that the Board of Trustees further reserves all rights under the Charter and Section 75 of the Civil Service Law for removal or other disciplinary action for any past or future acts or conduct of employees or officers of the Village which may fall within the purview of Section 75 of the Civil Service Law or the Charter.

CHRISTINA/LYNDEN

WHEREAS the Board of Trustees of the Village of Fredonia desires to retain the engineering services of Wendel Engineering, of Williamsville, New York for the preliminary Engineering, Design, Bidding and Construction Services at the Village Wastewater Treatment Plant, per their proposal dated November 29, 2017, and

WHEREAS a proposed agreement between Wendel Engineering and the Village of Fredonia has been presented to this Board to perform said services for a total estimated fee of $800,00.00, as follows:

Task 1 – Preliminary and Detailed Design

Bidding Services$435,000 – (lump sum)

Task 2 - Construction Services (Administration

And Observation)$365,000 –(Time & Expense)

NOW, THEREFORE, be it resolved that said agreement with Wendel Engineering is hereby approved to perform said services at anestimated cost of $800,000.00, and the Mayor is authorized to sign said Agreement on behalf of the Village of Fredonia.

LYNDEN/BRITZ

BE IT RESOLVED that the attached schedule of budget transfers for the month of November, pursuant to Section 5-520 of the Village Law, is hereby approved.

ESSEK/CHRISTINA

BE IT RESOLVED that O’Brien & Gere Engineering, of Syracuse, New York, be retained for professional engineering services associated with the 2018 Emergency Waterline Replacement per their proposal dated December 13, 2017 for an overall budget of $153,700.00 which includes labor and direct expenses, and is summarized as follows:

Preliminary Design Phase $ 54,600.00

Final Design Phase$ 18,600.00

Bidding assistance$ 8,100.00

Construction Phase Services$ 30,900.00

Inspection Services (hourly rate budget)$ 41,500.00

Total not to exceed$153,700.00, and

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to sign a letter of agreement to this effect on behalf of the Village of Fredonia.

ESSEK/CHRISTINA

BE IT RESOLVED that O’Brien & Gere Engineering, of Syracuse, New York, be retained for professional engineering services associated with the Water System Improvements (DWSRF Project No. 18389) per their proposal dated December 22, 2017 for an overall budget of $239,100.00 which includes labor and direct expenses, and is summarized as follows:

Preliminary Design Phase $ 75,500.00

Final Design Phase$ 58,300.00

Bidding assistance$ 9,500.00

Construction Phase Services$ 53,300.00

Inspection Services (hourly rate budget$ 42,500.00

Total not to exceed$239,100.00, and

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to sign a letter of agreement to this effect on behalf of the Village of Fredonia.

BRITZ/BARRIS

BE IT RESOLVED that the Board of Trustees of the Village of Fredonia hereby gives Eric Volk permission to join the Chautauqua County Fire Police Rescue Team and is permitted to respond outside the district in the capacity of a fire policeman and is covered by the VFBL in the event of injury or incident, and the Mayor or Village Administrator is hereby authorized to sign the Fire and Emergency Medical Mutual Aid Plan Special Team Participation Authorization form.
