BOROUGH OF BRIELLE Union Lane Water Main Replacement NOTICE TO BIDDERS Notice is hereby given that sealed bids will be received by the Borough of Brielle (BOROUGH) at the Office of the Administrator, 601 Union Lane, Brielle, New Jersey 08730, until 10:00 A.M. prevailing time on January 7, 2015, at which time they will be publicly opened and read aloud for: UNION LANE WATER MAIN REPLACEMENT/DEMOLITION OF EXISTING WATER STORAGE TANK Pre-Bid RFI Conditions: All Bidders shall be advised that the Owner, via the office of the Engineer, will limit requests for information (RFI's) to questions transmitted in writing, via mail, fax and email. No verbal RFI's will be received or considered. All valid, written RFI's will be received no later than fourteen (14) calendar days of the date of the Bid Opening (December 24, 2014) as described herein. Scope of Work: This contract consists of two projects; Project No. 1308001-002, Union Lane Water Main Replacement and Project No. 1308001-003, Demolition of Existing Water Storage Tank. The scope of Project No. 1308001-002, Union Lane Water Main Replacement includes the replacement of approximately 4,000 linear feet of 12" Cl. 52 ductile iron pipe (DIP), 150 linear feet of 10" Cl. 52 DIP, 245 linear feet of 8" Cl. 52 DIP, 375 linear feet of 6" Cl. 52 DIP and 100 linear feet of 4" Cl. 52 DIP and abandoning the existing water main located in Union Lane beginning at the entrance to the Department of Public Works property at 629 Union Lane and extending a little ways past Wainwright Place in the Borough of Brielle, Monmouth County, New Jersey. This project also includes replacement of approximately 70 water services along Union Lane between Old Bridge Road and Wainwright Place. The scope of Project No. 1308001-003, Demolition of Existing Water Storage tank includes demolition of the existing Union Lane Water Storage Tank located at the Department of Public Works property at 629 Union Lane in Brielle, New Jersey. Be notified that this project is expected to be funded in part with funds from the NJDEP and the New Jersey Environmental Infrastructure Trust (NJEIT). The NJDEP and the NJEIT consider the replacement of the water main including services to be one project (NJDEP Project No. 1308001-002) and the demolition of the existing water storage tank (NJDEP Project No. 1308001-003) to be a separate project. All work to be performed in accordance with the Contract Documents (plans and specifications) and is to be completed within two hundred and forty (240) consecutive calendar days from the date specified in the Notice to Proceed. Bids must be typed or hand printed on the forms furnished and enclosed in a sealed envelope indicating the name of the Bidder and the title of the Bid being submitted. Bids must include bid security in the form of a Bid Bond, Cashier's Check, or Certified Check in an amount equal to 10% of the total price Bid, but in no event shall the required Bid Security be more than $20,000. Each Bid Proposal shall include a Consent of Surety issued by a Surety Company licensed to transact business in the State of New Jersey in such form as may be acceptable to the BOROUGH. Failure to supply the above documentation at the time of the submission of the Bid Proposal shall be cause for rejection. The Surety Company shall provide such Bonds (Performance, Labor and Material Payment, Maintenance and Environmental Maintenance) as are required by the Contract Documents in such form as may be acceptable to the BOROUGH and in compliance with relevant State statutes. Bids may be hand delivered or submitted by mail. However, firms choosing to submit their Bids via the United States mail, Federal Express, UPS, messenger service, etc. are required to have said mail delivered prior to the Bid Opening time. No bids will be received after the appointed Bid Opening Time. Bids may not be withdrawn within sixty (60) days of the Bid Opening date. Bids may be held longer with the consent of the Bidder, by agreement with the BOROUGH, and only in accordance with New Jersey Local Public Contracts Law. The BOROUGH reserves the right to reject any and all Bids and waive Bid informalities and/or irregularities as permitted by the New Jersey Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) and with the advice of their legal Counsel when it has sound documented reasons which are in the best interest of the BOROUGH. Any award will be made to the lowest, complying and responsible bidder. Award shall be based on lowest responsible bid for alternate selected by Owner. All bid securities will be returned within ten (10) working days of Bid Opening, excluding Saturdays, Sundays and holidays, excepting those of the three (3) lowest Bidders or others requesting that security be held. Bidders whose securities are returned are considered as having their Bids withdrawn. Each Bidder shall complete and submit with the Bid Proposal, the Ownership Disclosure Statement, Non-Collusion Affidavit and Equal Employment Opportunity Certification Forms included in the Contract Documents. Failure to supply any or all of the above referenced documents at the time of the submission of the Bid Proposal may be cause for rejection. The successful Bidder is required to submit the Bonds required by the Contract Documents on or before the execution of the Contract. Bidders must comply with Federal and State non-discrimination rules and regulations, including NJSA 10:5-1, et seq., as amended by P.L. 1975, Chapter 127; effective July 23, 1975. Bidders are required to comply with all relevant Federal and State Statutes Rules and Regulations as described in the Bidding Documents. Contract Documents are available at the offices of the Engineer, PS&S, Central Monmouth Business Park, 1433 State Route 34, Suite A-4, Wall Township, New Jersey 07753. Cost of complete, full-sized Documents is $200.00 per set, non-refundable, payable by check to PS&S. SMALL BUSINESS CONCERNS OWNED AND CONTROLLED BY SOCIALLY AND ECONOMICALLY DISADVANTAGED INDIVIDUALS (SEDS): General The local government unit must comply with N.J.A.C. 7:22-3.17(a) 24 and 7:22-4.17(a), or 7:22-6.17(a)24, which require that the recipient shall make a good faith effort to award not less than 10 percent of the total amount of all contracts for building, materials or services (including planning, design and building related activities) for a project to small business concerns owned and controlled by socially and economically disadvantaged individuals as defined in the Small Business Act (15 U.S.C. 637(a) and 637(d)), and any regulations promulgated pursuant thereto. Where a local government unit has Minority Business Enterprise/Women's Business Enterprise (MBE/WBE) goals which exceed 10 percent of the total amount of all contracts, the local governments unit's goals will take precedence over State goals. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22 3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9 Awarding Contracts for State Assisted Projects to Small Business Concerns Owned and Controlled by Socially and Economically Disadvantaged Individuals included in the SED Section. Contractor's Responsibility The Contractor shall submit a plan to meet SED Utilization Requirements within 30 days of contract award. The Contractor's Plan shall include statements of how the SED participation requirements shall be achieved over the duration of the project. Every month the Contractor is required to submit a monthly SED report. There are two reports that are required (one per month). The SED report must be submitted by the 15th of each month. The two reports that must be submitted are the OEO-002 and OEO-003. The reports track the Contractor's efforts to award subcontracts to MBE/WBE firms in order to reach the contract goals. Form OEO-002, included in the Specifications, must be completed by the Contractor and Project Compliance Officer quarterly on MBE/WBE utilization. (January, April, July, October) Form OEO-003, included in the Specifications, must be completed by the Contractor and Project Compliance Officer monthly, unless a quarterly report is due, to monitor SED utilization progress. (February, March, May, June, August, September, November, December) The Contractor shall comply with all requirements imposed on the Contractor to fulfill the Socially and Economically Disadvantaged Utilization Plan. NJDEP FUNDING REQUIRED LANGUAGE: 1. A project identification sign, at least eight feet long and four feet high, bearing the emblem of the Department shall be displayed in a prominent location at each publicly visible project site and facility. The sign shall identify the project, State loan support, and other information as required by the Department. The NJDEP Project Sign detail has been included in the Supplemental Conditions section.
2. The Contractor shall use the NJDEP Change Order Form included in the Division 1 Specifications section when making changes to the Contract.
3. In accordance with NJAC 7:22 - 3.17(d) and 4.17(d), this Contract or Subcontract is expected to be funded in part with funds from the NJDEP and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be a party to this Contract or Subcontract or any lower tier Contract or Subcontract. This Contract or Subcontract is subject to the provisions of N.J.A.C. 7:22 - 3, 4, 5, 9 and 10.
4. In accordance with NJAC 7:22 - 3.17(a)1 this Contract is subject to Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.).
5. In accordance with LPC 40A: 11 - 23, all advertisements for bids shall be published in a legal newspaper sufficiently in advance of the date fixed for receiving the bids to promote competitive bidding, but in no event less than 10 days prior to such date; except that all advertisements for bids on contracts for the collection and disposal of municipal solid waste shall be published in a legal newspaper circulating in the county or municipality, and in at least one newspaper of general circulation published in the State, sufficiently in advance of the date fixed for receiving the bids to promote competitive bidding, but not less than 60 days prior to that date.
6. In accordance with LPC 40A:11 - 6.1 and 40A:11 - 24, all purchases, contracts or agreements which require public advertisements for bids shall be awarded to the lowest responsible bidder. Prior to the award of any other purchase, contract or agreement, the contracting agent shall, except in the case of the performance of professional services, solicit quotations, whenever practicable, on any such purchase, contract or agreement the estimated cost or price of which is $1,000.00 or more, and the award thereof shall be made, in accordance with section 3 (C.40A:11-3) or 4 (C.40A: 11-4), as the case may be, of the Local Public Contracts Law, on the basis of the lowest responsible quotation received, which quotation is most advantageous to the contracting unit, price and other factors considered; provided, however, that if the contracting agent deems it impracticable to solicit competitive quotations in the case of extraordinary, unspecifiable service, or, in the case of such or any other purchase, contract or agreement awarded hereunder, having sought such quotations determines that it should be awarded on the basis of the lowest quotation received, the contracting agent shall file a statement of explanation of the reason or reasons therefore, which shall be placed on file with said purchase, contract or agreement.
7. The contracting unit shall award the contract or reject all bids within such time as may be specified in the invitation to bid, but in no case more than 60 days, except that the bids of any bidder who consent thereto may, at the request of the contracting unit, be held for consideration for such longer period as may be agreed. All bid security, except the security of the three apparent lowest responsible bidders, shall be returned, unless otherwise requested by the bidder, within 10 days after the opening of the bids, Sundays and holidays excepted, and the bids of such bidders shall be considered as withdrawn. Within three days, Sundays and holidays excepted, after the awarding and signing of the contract and the approval of the Contractor's performance bond, the bid security of the remaining unsuccessful bidders shall be returned to them.
8. The contract shall be signed by all parties within the time limit set forth in the specifications, which shall not exceed 21 days, Sundays and holidays excepted, after the making of the award; provided, however, that all parties to the contract may agree to extend the limit set forth in the specifications beyond the 21 day limit required in this subsection. The Contractor, upon written request to the contracting unit, is entitled to receive, within seven days of the request, an authorization to proceed pursuant to the terms of the contract on the date set forth in the contract for work to commence, or, if no date is set forth in the contract, upon receipt of authorization. If for any reason the contract is not awarded and the bidders have paid for or paid a deposit for the plans and specifications to the contracting unit, the payment or deposit shall immediately be returned to the bidders when the plans and specifications are returned in reasonable condition within 90 days of notice that the contract has not been awarded.
9. In accordance with LPC 40A:11 - 33, 34, Any person who makes or causes to be made, a false, deceptive or fraudulent statement in the statement or answers in response to the questionnaire, or in the course of any hearing hereunder, shall be guilty of a misdemeanor, and upon conviction shall be punishable by a fine of not less than $100.00 nor more than $1,000.00, and shall be permanently disqualified from bidding on all public work or contracts of the contracting unit which submitted the questionnaire; or, in the case of an individual or an officer or employee charged with the duty of responding to the questionnaire for a person, firm, co-partnership, association or corporation, by such fine or by imprisonment, not exceeding 6 months, or both.
10. In accordance with LPC 40A:11 - 18, Each local unit shall provide, in the specifications for all contracts for county or municipal work or for work for which it will pay any part of the cost, or work which by contract or ordinance it will ultimately own and maintain, that only manufactured and farm products of the United States, wherever available, be used in such work.
11. In accordance with NJAC 7:22-3.17(e), 4.17(e), EPA Form 5720-4 (5-13), Labor Standards Provisions for Federally Assisted Construction Contracts has been included in the Supplemental Conditions Section of the specifications.
12. This project is funded in part by the New Jersey Environmental Infrastructure Financing Program and the bidder must comply with all provisions of NJAC 7:22-9.1 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs).
13. Contractor to comply with the SED Utilization Plan for the Borough of Brielle, included in the Supplemental Conditions section.
14. In accordance with N.J.A.C. 10:5 - 33, bidders are required to comply with the requirements of P.L. 1975, c. 127.
15. The Contractor and sub-contractors shall comply with the discrimination and affirmative action provisions of N.J.S.A. 10:2-1 through 10:2-4, the New Jersey Law Against Discrimination (N.J.S.A. 10:5-1 et seq.), and the rules and regulations promulgated pursuant thereto, including but not limited to N.J.A.C. 17:27.
16. The contractor shall pay not less than the prevailing wage rate to workers employed in the performance of any contract for the project, in accordance with the rate determined by the Commissioner of New Jersey Department of Labor pursuant to N.J.S.A. 34:11-56.25 et seq. OR the United States Secretary of Labor pursuant to 29 CFR Part 5, whichever is greater.
17. Access to records, the Department Shall have access to the Facilities, premises and records related to the project pursuant to NJAC 7:22-3.23 and 4.23
18. A preconstruction meeting with NJDEP representatives is required prior to the start of construction.
