ZONING BOARD OF ADJUSTMENT

MEETING MINUTES

Thursday, June 30, 2016

Chairman, Arthur Limoges called the meeting to order at 6:10 p.m. in North Troy.

Present: Arthur Limoges, Irene McDermut, Henry Stocek, Jim Ferguson, Ed Lipinski, and Secretary, Terri Medley

Guests: Richard and Deborah Morrissette, Charles and Evelina Farrar, Chantel Ely, Brian Kirsch, Raymond and Tina DelaBruere.

The first item of business was to consider application #11-16 from Raymond and Tina DelaBruere to install a business sign plus lighting at 6529 VT Route 100 in Troy along with a ramp and landing at the back of the building and to enclose an open structure in the back of the property to be used for storage.

Tina explained they contacted the State of Vermont highway department to ensure the sign will not affect the visibility of the area. Our Zoning By-laws require a 35 foot setback, resulting in

the need of a 20 foot variance.

A motion was made by Jim to approve the installation of the sign with a 20 foot setback variance. Motion carried.

A motion was made by Art to approve the installation of the loading ramp and closing in the open structure for a storage shed. Motion carried.

The Second item of business was to consider application #15-16 from Mike and Lise Brown for a setback variance at 96 Woodland Drive in Troy.

Mike and Lise did not attend and therefore the Board could not ask them questions. Irene made a motion to table their application until they can provide the Board with drawings of the proposed lean-to. Terri will notify them regarding the next meeting on July 12th, 2016.

The last item of business was an appeal from Charles Farrar regarding building permits #8-16 and #9-16 by Richard and Deborah Morrissette at 445 Loop Road in Troy.

Charles discussed the shared right-of-way that abuts both properties.

Jim made a motion to go into deliberative session.

In other business Chantel discussed the fence at Travis Bowen’s apartments on Railroad Street in North Troy. She indicated the fence was not being properly taken care of and that the fence does not go as far back as he was asked to place it.

Chantel was told the board would take a look at the fence and discuss it at the next meeting on July 12th.

Brian Kirsch discussed water runoff he is dealing with on his property at 1758 VT Route 101 in Troy. The abutting land owner had excavating done on her property and it has caused a large amount of water to run onto the Kirsch property.

The Board indicated to Brian that it is not something the Board of Zoning or Planning has jurisdiction over.

Art brought up the various temporary signs that have appearing around the town. It was discussed that these signs should only go up for a limited time for a particular event and not be a permanent sign advertising a business. Letters will go out to all the individuals that are using these signs for a longer period of time.

The Board went into deliberative session at 8:02 p.m. to discuss the appeal of Charles Farrar.

The Board exited the deliberative session at 8:35 p.m.

A motion was made by Jim to deny the appeal of Charles Farrar regarding permits #8-16 and

#9-16. The Board found the appeal was not germane to the permits being considered.

Irene brought up the position of Zoning Administrator and the fact Robert Langlands would like to step down from the position. Terri indicated she would be interested in the position. Jim made a motion to recommend Terri Medley as Zoning Administrator. Motion Carried.

The recommendation will be forwarded to the Selectboard.

There being no further business to the board, the meeting was adjourned at 8:48 p.m.
