5.1Frameworkplans

6.Assessment­Restricteddiscretionaryactivities

6.1Frameworkplans

6.1.1Mattersofdiscretion

Whenassessingaframeworkplan,amendmentstoanapprovedframeworkplanorareplacementframeworkplanasarestricteddiscretionaryactivity,thecouncilwillrestrictitsdiscretiontothefollowingmatters:

1.theprovisionofroadsandstreetscape

2.indicativenumbersanddensitiesofhouseholdunitsandthelocationofdwellings,includingsitelayout

3.withinsub­precinctB,thetype,formandscaleofbuildings,thenatureandscaleofproposedactivitiesandtheirrelationshiptothewaterareasoftheharbourandmarina

4.withinsub­precinctA;integrationofnewdevelopmentwiththeexistingcommercialcentre;therelationshipbetweenbuildings,activities,neighbouringsites,publicamenityareasandthewaterway;thetype,formandscaleofbuilding

5.theprovisionofpedestrianlinkages

6.theprovisionofpublicopenspace,includingwhererelevant,neighbourhoodreserves,esplanadesandpedestrianwalkways

7.conservationvaluesandlandscape

8.provisionofinfrastructure.

Assessmentcriteria

Whenassessingaframeworkplan,amendmentstoanapprovedframeworkplanorareplacementframeworkplanasarestricteddiscretionaryactivity,thecouncilwillapplythefollowingassessmentcriteria:

1.Whetherthelayoutanddesignofroadswill:

a.ensureappropriateconnectionstoexistingandfutureroads

b.respondtothesite’sexistinglandform,vegetation,views,naturalwatercourses(forthepurposesofstormwaterrunoff)andareasofpublicopenspace

c.accommodatesafetrafficspeedsandsightlinesforallroadusers(pedestrians,cyclistsandmotorists)

d.providesufficientwidthtoaccommodateexpectedtrafficgeneration,parking,services,footpaths,cycleways(wherepracticable)andamenitylandscaping,andcomplywiththerelevantcodeofpractice.

e.promoteaconsistentdesignthemewhichwillensurehighamenityvalues

f.haveregardtothefuturedesignrelationshipbetweentheroad,adjoininglandandadjacentprecincts

2.Whetherfuturedevelopmentsiteshavebeenidentifiedinamannerthat:

a.respondstothecontextwithinwhichthedevelopmentsiteistobelocated,includingroads,openspace,pedestrianlinkages,viewsandnaturalfeatures

b.isappropriatetothetypeandformofhousing(i.e.whetherforsingleunithousingdevelopmentorintegrateddevelopment),havingregardtotheoveralllimitof2913dwellings,andinsub­precinctB,thedesirabilityforhouseholdunitstogenerallybelocatedonlevelsotherthangroundlevel

c.isinaccordancewiththepolicies

d.hasregardtotherelationshipwithexistingdevelopedareas

e.givesconsiderationtothesize,shapeandaspectofthelandanditssuitabilityforfuturedevelopment,withparticularregardtotherelationshipofthesitetotheroadandadjoiningsites

f.integratesthedevelopmentofsiteswiththerelevantsub­precinctasawhole

g.promotesacommunityidentity,suchasthroughprovisionofdesignprocessesandguidelines.

3.Theextenttowhichthetype,formandscaleofbuildings,thenatureandscaleofproposedactivities,theirrelationshiptothewaterareasoftheharbourandmarina,andtheirrelationshiptotheexistingcommercialcentreandpublicamenityareasgiveeffecttotheobjectivesandpoliciesfortheGulfHarbourprecinct.

4.Whetherpedestrianlinkageshavebeenidentifiedwhichwillensure:

a.internal(tothesub­precinct)linkagesbetweendevelopmentsites

b.externallinkagestonaturalfeatures,reserves,publicopenspaceandadjoiningprecinctsand,whererelevant,tosub­precinctsAandB

c.thesitinganddesignofpedestrianpathwayssothattheyareaccessible,visibleandsafe.

5.Whetherprovisiontobemadeforpublicopenspace:

a.hasregardtotheexistingprovisionofpublicopenspaceinthevicinityandproposedprovisionforpublicopenspace

b.willmeetthelikelyopenspaceneedsoftheprecincttobeserved

c.servestheneedsofthecommunity,withreferencetosize,shape,aspectandintendedformofdevelopment

d.enablessunaccess

e.hasregardtotheneedforshelter

f.enablesretentionofviews

g.promotessafety(surveillancefrompublicstreetsanddwellings)

h.isanappropriateshapetoaccommodatechildren’splayequipment

i.withinsub­precinctB,ensuresprovisionforandmaintenanceofpublicaccess,useandenjoymentofwaterways,berthingfacilities,andthewateredge(includingbeachandpromenades),withsuchprovisiontobeprotectedbycovenantsorotherlegalmechanismsapprovedbythecouncil

j.withinsub­precinctA,ensuresprovisionforandmaintenanceofpublicaccess,useandenjoymentofthewateredge,bandrotundaandpromenades,withsuchprovisiontobeprotectedbycovenantsorotherlegalmechanismsapprovedbythecouncil

6.Whetherthelocationandextentofneighbourhoodreservesisconsistentwithand/orcomplementarytotheneighbourhoodreservenetwork,andmustbeconsideredhavingregardtothe:

a.relationshipoftheneighbourhoodtootherreservesandopenspaces,existingandproposed

b.distanceandaccessibilityoftheneighbourhoodreservetousers

c.qualityofthereserveintermsofitspotentialtobeusedforstructuredandunstructuredactivities

d.relationshipofthereservetothesurroundingstreetandsitelayoutsuchthatthepersonalsafety,surveillanceandconvenienceofusersispromoted

e.opportunitiestolinkopenspacenetworks,communityfacilitiesandpublicservices

f.sizeofthepopulationthatwillbeservedbytheneighbourhoodreserve

g.presenceofotherneighbourhoodreservesinthevicinity(e.g.landadjoiningornearbytoexisting

neighbourhoodreservesmayobviatetheneedtoprovideadditionalland,inwhichcaseacashcontributionshallberequired).

7.WhetherfeaturesofnaturalandhistoricheritagesignificancewithintheGulfHarbourprecinctarerecognisedby:

a.retainingandprotectingnative,significantexoticorhistorictrees

b.retainingbushandtreeswherethisisnecessarytoachievetheplannedcharacterofeachsub­precinct

c.retainingsofaraspracticable,bushandtreesthatcontributesignificantlytoecologicalorhabitatvaluesandamenityvaluesorenhancethecharacterofthearea

d.undertakingearthworks,excavationsandtheremovaloftopsoil,onlywhereandtotheextentnecessarytoprovidefortheactivitiesforwhichthelandistobeused

e.designingthelayoutofsitesandbuildingssothatwatercoursesorwetlandswhichareecologicallysignificant,andlandformswhichcontributetoamenityvaluesorthecharacterofthelocalityaredisturbedtotheleastpracticableextent

f.protectingplacesorfeatureswhicharelistedforprotectionbecauseoftheirhistoric,archaeologicalorculturalvalue,orwhicharerecognisedashavingsignificanceinthoserespectsduringthecourseofdetailedplanningordevelopment

g.Whetherexistingnaturalfeaturessuchasstreams,thecoastandvegetationhavebeenidentified,andnaturalfeaturesareprotectedorenhanced,bymethodssuchasprecinctdesigncriteriaorcovenants.

8.Whethertheavailabilityandcapacityofexistinginfrastructureincludingroadsandin­groundservices,andtheproposedmethod(s)ofservicingthedevelopmentaresatisfactoryhavingregardtothetype,intensityandscaleofdevelopmentproposed.
