33 46 00 / Delete Supplementary Conditions Article SC7.1.13 and replace with a new Supplementary Conditions Article SC 7.1.13 as follows:
“SC7.1.13 Electronic Submittal of Payroll Records. Delete General Conditions Article GC7.1.3.5(b) and replace with the following:
“(b) A certified copy of payroll records provided for in State of California Labor Code Section 1776 shall be furnished to the Engineer each week, and shall be provided within seven (7) Days after the regular payment date of the payroll period. Failure to comply with these requirements may cause suspension of progress payments during the period of noncompliance or may delay final payment.
(c) Within seven (7) Days following NTP, the Contractor shall register at BART’s designated website for electronic submittal of Certified Payroll Records. BART’s Office of Civil Rights will notify the Contractor and provide all necessary information related to BART’s designated website for electronic submittal of Certified Payroll Records. Each week, the Contractor and its Subcontractors shall submit their respective Certified Payroll Records electronically to BART’s designated website in accordance with the requirements of the website. These records shall be provided within seven (7) Days after the regular payment date of the payroll period. Failure to comply with these requirements may cause a suspension of progress payments during the period of noncompliance or may delay final payment. Contractor shall include in its Subcontracts, and require its Subcontractors of every tier to include in their respective Subcontracts, provisions incorporating the requirements of this Supplementary Conditions Article SC7.1.13 for electronic submittal of Certified Payroll Records.”
Delete Supplementary Conditions Article SC7.3.2 and replace with a new Supplementary Conditions Article SC7.3.2 as follows:
“SC7.3.2 Certified Payroll Records Submittal to the California Department of Industrial Relations (DIR). Within thirty (30) Days following Award of the Contract, the Contractor and its Subcontractors shall register with the State DIR at https://efiling.dir.ca.gov/PWCR/ in order to enroll in the electronic system for monthly submittal of Certified Payroll Records. Thereafter, each month the Contractor and its Subcontractors shall submit electronically a copy of their respective Certified Payroll Records to the DIR. Contractor shall include in its Subcontracts, and require its Subcontractors of every tier to include in their respective Subcontracts, provisions incorporating the requirements of this Supplementary Conditions Article SC7.3.2 for Certified Payroll Records submittal to the DIR. Failure to comply with these requirements may cause a suspension of progress payments during the period of noncompliance or may delay final payment.”
In Supplementary Conditions Article SC10.27, delete the Articles SC10.27A and B that follow Article SC10.27G and replace with new Articles SC10.27H and I to read as follows:
