Registration Requirements for Personal Care and Body Art Industries

The following guidelines apply, but are not limited to, the following premises:

  • Hairdresser
  • Beauty Treatment includes

Waxing

Manicures, Pedicures

Application or mending of artificial nails

Facial or body treatment

Application of cosmetics

  • Skin Penetration Procedures

Ear Piercing

Body Piercing

Electrolysis

Tattooing

A person conductingany of the above must register their business with their local Municipal Council under the Public Health and Wellbeing Act 2008and must comply with thePublic Health and Wellbeing Regulations 2009 as well as the Health Guidelines for Personal Care and Body Art Industries.

Registration Process

  1. Plan Assessment

It is recommended that you submit plans of the fit out of your proposed premises to Council for assessment prior to beginning any work.

There is a fee for Plan Assessment.

The benefit of plan assessment is to avoid you carrying out any unnecessary or unapproved work that could result in additional costs. It may save you money in the long term.

To consider your application the following information must be supplied:

  • Completed Application for Plan Assessment for Premises under the Public Health and Wellbeing Act 2008.
  • Pay relevant application fee for Plan Assessment
  • One set of plans showing that all requirements have been complied with (refer to the Public Health and Wellbeing Regulations 2009 and the Health Guidelines for Personal Care and Body Art Industries)
  • Details of the procedures to be undertaken at the business, e.g. hairdresser, manicures, waxing, semi-permanent make-up, electrolysis, etc.
  1. Fit Out

Once plans have been assessed and approved by Council’s Environmental Health Department, the fit-out can commence.

A progress inspection may be carried out during the fit out.

  1. Registration

Registration will be granted and a Certificate of Registration issued when:

  1. The fit-out is completed in accordance to the assessed and approved plan; and
  2. A final inspection has been conducted by an Environmental Health Officer; and
  3. Council is satisfied that all procedures are carried out in accordance with relevant guidelines or regulations to minimise the spread of infectious disease; and
  4. A completed Application for Registrationwith the appropriate fee has been lodged.

The premises will be registered under the Public Health and Wellbeing Act 2008and Council will issue a certificate of registration for the current calendar year.

General Requirements

  • Equipment, furniture, fittings, floors and walls must all be purpose built or purchased specifically for the task to be performed. They must be durable, safe and suitable for cleaning and maintenance, and constructed of sealed non-porous material.
  • An appropriate splash back is to be provided behind plumbing fixtures.
  • Adequate lighting and ventilation must be provided throughout the premises.
  • The area of client procedure rooms/cubicles must be no less than 2.5 metres square.
  • The applicant must comply with the PublicHealth and Wellbeing Regulations 2009 and the guidelines outlined in the Department of Health 2004 publication Health Guidelines for Personal Care and Body Art Industries.

Specific Requirements

  • A hand washbasin with hot and cold running water supplied through a single outlet, liquid soap and paper towels through a dispenser must be installed in each procedure room/cubicle.
  • Where hairdressing ONLY occurs, a hair wash basin may be used as hand washbasin.
  • Where skin penetration procedures are performed, the hand wash basin must be hands free (for example, foot operated or knee operated). Elbow operated taps are not permitted.
  • A sink with hot and cold water in addition to the hand washbasin is to be provided exclusively for washing equipment and instruments and is to be located in the cleaning area.
  • Sharps used for skin penetration or single use razor blades are considered clinical waste and must be disposed of into sharps containers in compliance with the relevant Australian standards.

Sterilisation

  • Premises with processes that involve skin penetration including body piercing, electrolysis and tattooing, must be provided with a means of sterilising equipment (unless single use equipment is used).
  • Steam under pressure sterilisation is the only recommended process for businesses in the personal care and body art industries.
    Bench top autoclaves should conform to AS2182.

Client Information

  • Under Regulation 32 of the Public Health and Wellbeing Regulations 2009, proprietors of a skin penetration premises must provide written information directly to their client about the transmission of infectious diseases associated with the process undertaken.

Record Keeping

  • Under Regulation 33 of the Public Health and Wellbeing Regulations 2009, the proprietor or occupier of a registered premises that provides tattooing or body piercing must ensure that the name, address and telephone number of each client is recorded and stored at the premises for a period of 12 months following the date of the last body piercing or tattooing procedure under taken by the client at the premises.

Minimum Age for Tattoos and Body Piercing

(Summary Offences Act 1966)

Tattoos

It is illegal for anyone to tattoo or perform scarification (scarring), tongue splitting, branding and beading on anyone under the age of 18 years.

Body Piercing If Under 16

It is against the law for someone to perform a body piercing on someone under 16 unless the person has a letter of consent from their parent or guardian.If the client is over 10 they also have to give theirown consent in writing.

Intimate Body Piercings

It is against the law for body piercers to perform intimate body piercings on anyone who is under 18 years of age. This means that the client must be 18 before genitals, anal area or nipples are pierced.

Exception

If the tattoo or piercing needs to be done for a medical reason, and is performed by a doctor, this law does not apply.
