Guidelines for Proposed Improvements

Architectural Review Process

These Guidelines are established to assist homeowners in preparing an application to the Architectural Committee (AC) for structural and landscaping improvements.

Following the Guidelines does not eliminate the need for submission of plans for approval by the AC. Even if the homeowner’s proposed addition or alteration is identical to another that has been approved, it must be submitted for approval. Each application will be reviewed on a case-by-case basis due to different conditions on particular lots.

The AC has adopted these Guidelines for architectural improvements, which shall apply to all lots within Sierra Ridge with the Declaration, Covenant, Codes, and Restrictions of Sierra Ridge Homeowners Association (“Declaration”). In the event of any inconsistency between these Guidelines and the Declaration, the Declaration shall prevail. These documents are intended to enhance property values and maintain high standards of development within the Sierra Ridge Homeowners Association.

All architectural improvements will be conditioned upon compliance with applicable City of Scottsdale codes.

General Principles

The purpose of the AC is to ensure consistent application of the Design Guidelines. The Committee monitors a portion of any lot or parcels which is visible from other lots or parcels, the street or Association common areas. The Design Guidelines promote those qualities in Sierra Ridge, which enhance the attractiveness and functional utility of the community. Those qualities include a harmonious relationship among structures, vegetation, topography and overall design of the community.

Protection of Neighbors

The interest of neighboring properties must be protected by making reasonable provisions for such matters as access, surface water drainage, sound and sight buffers, light and air, and other aspects of design, which may have a substantial effect on neighboring properties.

Design Compatibility

The proposed construction must be compatible with the design characteristics of the property itself, adjoining properties and the neighboring setting. Compatibility is defined as harmony in scale, materials, and color and construction details.

Workmanship

The quality of workmanship evidenced in construction must be equal to, or better than, that of the surrounding properties. In addition to being visually objectionable, poor construction practices can cause functional problems and create safety hazards. The association and the Committee assume no responsibility for the safety, or livability of new construction by virtue of design or workmanship.

Application Procedure

  1. Homeowners must obtain an application form, which is available from the management company office:

  1. Complete the application form describing your request, sign and date it, and mail it to the office above along with these documents:
  • Plot Plan: A site plan showing dimensions, relation to existing dwelling and property lines (setbacks). Measurements must be indicated on the plans.
  • Elevation Plans: Plans showing finished appearance of additions in relation to existing dwelling. An accompanying photograph of the proposed location would be helpful.
  • Specifications: Detailed descriptions of materials to be used and color samples must be submitted.

All buildings and structures erected within the Sierra Ridge Homeowners Association and the use and appearance of all land within the Sierra Ridge Homeowners Association shall comply with all applicable City of Scottsdalezoning and code requirements, as well as the CC&Rs and these Guidelines.

Review: Approval and/or Disapproval

The Board shall have forty- five(45) calendar days after the receipt of complete submittal forms and plans at the management company offices to approve or disapprove the submitted plans (with the exception of the month of December). Incomplete submittals will be returned to the homeowner prior to AC review. The AC shall furnish a written decision to the homeowner setting forth the reasons for its decision and the nature of any objections. The AC shall have broad discretionary authority to interpret the guidelines and shall, to the extent reasonably possible, apply the guidelines equally and in an even-handed manner with regard to similarly situated properties. In addition, the AC may disapprove any application if, in its discretion, it believes the homeowner has not submitted sufficient or accurate information for the AC to exercise the judgment required by the CC&Rs and these guidelines.

Review and approval or disapproval will include, but not be limited to, consideration of materials, quality of workmanship, colors, consistency with the external design and color of existing structures on the lot and on neighboring lots, and overall aesthetic considerations. The location of the improvement with respect to topography and finished grade elevation is also considered.

The AC, the Board of Directors, and the management company shall have no liability in connection with or related to approved plans, specifications or improvements. The approval of the plans does not mean that judgment is passed on the structural soundness of the addition, nor its effect upon existing or future drainage. The review of the plans is for aesthetic purposes only.

The AC shall have the right to disapprove an application if any part of it is not in accordance with the CC&Rs or these guidelines, or is incomplete, or is not in compliance with relevant government approvals and regulations, or is deemed by the AC to be contrary to the best interests of Sierra Ridge.

If a proposed improvement has been disapproved and the homeowner believes some misunderstanding might be responsible, only one appeal may be made in person or in writing, which will be considered at the next regular meeting of the AC, provided the homeowner submits an appeal in that time frame. Requests for appeals should be submitted to the management company. Late appeals will not be considered, nor will more than one appeal be considered by the AC. Only one further appeal may be made to the Board of Directors.

Timeline for Completion of Improvements

All improvements submitted for and approved by the AC shall be completed within a ninety (90) day time frame from the date of your returned submittal. Extensions may be granted on a case-per-case basis.

Temporary Structures

Per Sec 12 (p) 5 of the CC&R’s - No structures of a temporary character, trailer, basement, tent, shack, barn, or other outbuilding shall be constructed, erected, placed, or used on portions of the Property at any time for any purpose whatsoever, either temporarily or permanently. Ramadas, gazebos or umbrellas are permitted and are covered separately in this document.

Guidelines for Specific Improvements

Guidelines for making specific improvements appear on the following pages. The Architectural Committee may amend these architectural guidelines from time to time by a majority vote of the Committee. In the event that City of Scottsdalerequirements differ from Association requirements, the stricter requirement will apply.

Homeowners may apply for a variance from a requirement of these guidelines. Such requests will be considered on a case-by-case basis, and if approved, shall not obligate the AC to grant any or similar variances on request from other homeowners. Variances may be authorized if the AC finds:

  • Special circumstances or conditions apply to the land, building, and use referred to in the request such that strict enforcement of the guidelines would be impossible or impractical in the discretion and judgment of the AC;
  • Authorizing the variance is necessary for the preservation and enjoyment of substantial property rights by the homeowners;
  • Authorizing the variance will not be materially detrimental to persons residing or working in the vicinity of the lot to which the variance applies, to the adjacent property, to the public welfare in general, or to the welfare of Sierra Ridge.

Antennas and Satellite Dishes

The Association’s preference for location of Regulated Receivers, in descending order, is as follows:

  1. A location in the backyard of the lot where the Receiver will be screened from view by landscaping or other improvements;An unscreened location in the backyard of the Lot, below the fence;
  2. On the roof, but below the roofline, rear of home;

3. A location in the side yard of the lot where the Receiver will be screened from view by landscaping or other improvements;

4. on the roof above the roofline, at the rear of the house;

5. on the roof, but below the roofline.

For systems requiring masts, homeowners must obtain AC approval prior to installation if the masts exceed twelve (12) feet in height. Masts must be painted a color that will blend into the background against which the system is mounted, e.g., the body color of the house.

Notwithstanding the foregoing order of locations, if a location stated in the above list allows the Receiver to be placed so as not to be visible from neighboring property, the Association would prefer that such location be used for the Receiver rather than a higher-listed location at which the Receiver would be visible from neighboring property, provided such location will not unreasonably delay or prevent installation, maintenance, or use of the Regulated Receiver, or unreasonably increase the cost of installation, maintenance, or use of the Regulated Receiver, or preclude reception of an acceptable quality signal.

Unregulated Receivers and other communication antennas, whether attached to a building or structure or any lot, must be approved in writing by the AC, with such screening and fencing as such Committee may require prior to installation.

Awnings (window, permanent)

Awnings over windows will be considered for approval only if they are:

  1. Installed in the rear or side of the home, behind the homeowner’s property fence.
  2. Canvas type in a solid color matching the exterior body or the fascia, or are consistent with builder-installed permanent awnings.
  3. All awnings must be maintained in a high quality condition that will not detract from the quality of the community.

Submit for AC approval information on the manufacturer, color, type, and the number of years of the guarantee prior to installation.

Awnings/Shade Screens

Awnings and shade screens will be considered for approval with the following provisions:

1. Awnings will be allowed on rear of home only. Retractable awnings can be used on sides of home or rear of home. No awnings allowed on front of home.

2.The awning/shade screens must match the body color of the dwelling.

3.All awnings/shade screens must be maintained in a high quality condition that will not detract from the quality of the community.

Submit for AC approval information on the manufacturer, color, type, and the number of years of the guarantee, prior to installation.

Balconies

Balconies will be considered for approval by the AC on a case-by-case basis. The requesting homeowner must:

1.Submit to the AC drawings that show affected sides of the existing structure, scale and style of windows, doors, fascia, and other details. The plans must show accurate measurements.

2. Obtain City of Scottsdaleapproval for such construction only after the Association has given interim approval in writing to the homeowner.

3. The balcony must be completed within 90 days of receiving the City permit, following the plans approved by the AC on an interim basis.

4. Notify the AC upon completion of the balcony in order to obtain final approval from the AC. The homeowner must make his/her premises available for an inspection by the AC, which will determine whether the plans were followed. If so, the Association will send a final approval letter to the homeowner. Any deviations from plans approved on an interim basis, as noted above, must be addressed prior to a final approval letter being sent.

Basketball Goals

Basketball Goals will be allowed as a portable installation adjacent to driveway; permanent goals are prohibited. Goals must be stored out of site when not in use.

Canopies

Children’s Play Structures

Plans for a children’s play structure must be submitted for approval since in most instances they protrude over the fence. Furthermore, such structures are subject to the following:

  1. Play structures may be erected in rear yards only and structures must be set back a minimum of seven (7) feet from any perimeter wall.
  2. Maximum height allowed topping support bar or highest point of structure is ten (10) feet.
  3. Maximum height of any deck/platform is to be four (4) feet above ground.
  4. The distance from the ground elevation to the top of the perimeter fence must be measured and submitted with the plans.
  5. The AC will take the appearance, height and proximity to neighboring property into consideration.
  6. Any shade canopy must be a solid earth tone color.
  7. Brochure or picture should be submitted, if possible.
  8. Trampolines without safety nets are pre-approved, provided setback requirements are met. Trampolines with safety nets that are visible over the fence line must be submitted for approval.

9.Trampoline safety poles must match paint on the body of the house (stucco). Setbacks are same as those for other play equipment.

Clotheslines

Clotheslines or other outside facilities for drying clothes are not permitted unless they are placed exclusively within a fenced yard and not visible above the block wall or otherwise concealed.

Decorative Items, front yards

Benches will be considered with the following provisions:

  1. The bench must be located within four (4) feet of the front door. Variances will be considered by the AC based on different styles of homes and front entryways.
  2. Material must be of natural wood, concrete, or a combination of metal and natural wood or wrought iron.
  3. Plastic chairs/tables will not be allowed in front yards on a permanent basis.

Flower/Decorative Pots are pre-approved with the following provisions:

  1. Figurative pots (figurines that incorporate a flower pot) are not permitted.
  2. The pots are to be of a natural color material (not figurative).
  3. The pots must be maintained in acceptable condition.
  4. Dried flowers or silk flowers, plant displays and trees will be allowed in the front, provided they are maintained in quality condition and are in good taste.

Fountains: See Water Features, p. 8.

House Ornaments, exterior, is pre-approved with the following provisions:

  1. Only three (3) ornaments on the front of the house (sun faces, etc.) are permitted.
  2. Colors are limited to verdigris, peach, terra cotta, black or copper.

Signs/statues will be considered with the following provisions:

  1. Only signs such as name, security or welcome signs of seventy-two (72) square inches or less will be approved.
  1. Not more than two (2) signs or two (2) statues or a combination thereof will be approved.
  1. Signs or statues must be located within four (4) feet of the door opening.
  2. Variances will be considered by the AC based on different styles of homes and front entryways.
  3. Statues can be a maximum of two (2) feet in height.

Water Featureswill be considered with the following provisions:

1)Review and approval of the AC.

2)Well maintained.

Doors, front entry

Main entry doors are pre-approved provided that replacements are the original design and color installed by the builder. If the original design and color are no longer available or if you wish to make another choice, submit an application that includes a picture of the proposed new door.

Guidelines for Security Doors are listed separately under that title.

Driveway Extensions and Additions

Driveways, extensions, and additions must be maintained free of stains. Oil drip pans, plywood, cardboard, and oil-stained carpets placed on the driveway are not acceptable when the vehicle is removed from its parking spot on the driveway and must be removed from view.

  • Driveway “Extensions” are defined as and are specifically for residents who need to gain access to their rear yards through an existing “RV” gate. An “RV” gate is defined as an existing gate with a minimum opening of eight (8) feet. Homeowners who wish to redesign their existing single gate openings to accommodate an RV opening and gate must have a minimum of six (6) feet available on the side of their homes without going beyond their property lines. Submittals for driveway extensions must include at least the following:
  1. A plot plan or drawings of the existing lot indicating the area of the proposed expansion (Plot plan must show all measurements of front yard.);
  2. The exact measurements/dimensions of the proposed additional concrete surface;
  3. Note that the City of Scottsdalecodes state that the maximum allowable parking and maneuvering space in a front yard is thirty-five (30) percent.

Driveway extensions:

1. Must be consistent with the existing concrete slab.

2. May be used as an additional parking area.

  • Driveway “Additions”are defined as 18” additions on either or both sides of the driveway. This configuration is the only option available to homes with single gates.

Submittals for driveway additions must include at least the following:

  1. A plot plan or drawings of the existing lot indicating the area of the proposed expansion;
  2. The exact measurements/dimensions of the proposed additional concrete surface.
