Equine Adoption Contract

BE IT KNOWN, that for fee in the sum of $______, the full receipt of which is acknowledged, the undersigned Safe Harbor Equine and Livestock Sanctuary (Rescue) hereby transfers custody to ______(Adopter), the following described horse (Horse):

The adoption is subject to the following conditions and representations:

Rescue acknowledges receipt of $______as adoption fee for horse. This fee is refundable for the first 30 days post adoption, provided horse is returned to rescue in same or better condition than at time of rescue (determined at sole discretion of rescue), at adopter’s time and expense. After the initial 30 days, and up to 1 year post adoption, the adoption fee may be transferred to the adoption of a different horse provided horse is returned to rescue in same or better condition than at time of rescue (determined at sole discretion of rescue).

Adopter agrees that horse is adopted AS IS. Rescue agrees that horse has been seen by a veterinarian and tested for Equine Infectious Anemia (coggins) and given vaccinations during the prior 12 month period, and in the case of mature males has been castrated. Rescue makes no guarantees about horse’s physical condition, long-term health, experience or compatibility with adopter.

If the adoption is not completed, and the horse is returned to the rescue in a condition not equal to the time of adoption, the Rescue reserves the right to retain a portion of the adoption fee suitable to cover any veterinary or rehabilitation costs.

Adopter agrees that the horse may never be raced, bred, sold, given away, auctioned, sent to slaughter, disposed of, or have any interest in there of transferred for the remainder of the horse’s life. The adopter agrees to pay Rescue liquidated damages, attorney fees, and costs in the amount of $10,000 for any violation of this provision. In a life threatening situation, only a licensed veterinarian may humanely chemically euthanize the named horse. In the event that Adopter is unable to continue caring for the horse, Adopter MUST notify Rescue at . Rescue may, at their sole discretion, approve a new home in cooperation with Adopter or request the return of the horse to the rescue. Adopter may relinquish the horse back to the rescue at any time during the life of the horse with 14 days’ notice provided for rescue to secure an appropriate foster location. If the horse is found to be bred or raced, and immediate return to rescue is required.______(Initial)

General Care Requirements Named Horse is a minimum of BCS 4 on the Henneke Scoring System. Adopter will assure that horse maintains a body score between (4) Moderate and (6) Moderately Fleshy. If horse falls above or below this score, Rescue may request a certification from a licensed large animal veterinarian with a corrective action plan to correct the horse’s condition. Rescue may require an immediate relinquishment of the animal if they do not feel that the needs of the horse are adequately being met. Horse shall have free access to fresh water, hay and pasture at all times as well as salt/mineral supplements and a feed schedule of grain provided to the needs of the horse. At a minimum, a shelter of three sides and roof or thick stand of trees must be available at all times. Horse shall not be left in a stall for more than 24 consecutive hours unless the horse’s health demands otherwise, as documented by a veterinarian. Stalls, if used must be clean and well ventilated. Adequate fencing must be provided. If electric fencing is used, it must be on at all times, with adequate voltage and at least two rows or strands. Rescue has completed a site visit and has approved of the site for the horse, or but any material changes to the detriment of the horse may violate this approval.______(initial)

Health Care Required

Yearly vaccinations and coggins testing are required for any horses that depart their pasture for trail riding, competition, sports, or other travel. If outside horses enter the property yearly vaccinations are highly recommended. Vaccinations should include a 5 Way Vaccination, Rabies, West Nile, and Strangles. Appropriate hoof care by a qualified farrier is required. Horses must have their feet

attended to barefoot or shod at a maximum of every 10 weeks. Horse must be kept on a regular deworming program and should consult their veterinarian for guidance on the appropriate program given current environmental factors. Teeth must be kept in good condition, and must be examined by a veterinarian or equine dentist annually and floated when necessary. The Adopter agrees in advance that Rescue has the right to obtain all veterinary and/or farrier records directly from any veterinarian or farrier treating the horse, and the execution of this form shall serve as a release to the applicable professionals authorizing the delivery to Rescue of all records maintained. Should adopter fail to abide by the above requirements, upon notice by Rescue, the horse shall be returned to Rescue within 1 weeks’ time. ______

Illness or Injury Care

The Adopter agrees to provide recommended veterinary care for illness and/or injury at the Adopter’s expense, according to the horse’s needs and/or according to the laws of the State of Tennessee. If unsoundness/lameness is an issue, horse must be examined by Veterinary in Adopter’s State. Should adopter fail to abide by this requirement, upon notice by Rescue, the horse shall be returned to Rescue within one week’s time. ______

Post Adoption Follow Up

For the remainder of the horse’s life, the Adopter agrees to permit a representative of the Rescue to visit the stabling property, and the horse and to return the horse to the program is Rescue determines the situation is undesirable for the well-being of the horse according to the standard explained herein. Additionally, ADOPTER agrees to send by email photos of the horse 2 weeks post adoption and annually thereafter to . Photos shall be clear, current, and show the entire horse in the picture including body and hooves. Rescue shall send a reminder email each year requesting the annual update photos. ______

Entire Agreement

This agreement constitutes the entire agreement between Adopter and Rescue. In the event of any dispute over this agreement, it shall be governed by the laws of the State of Tennessee, County of Davidson. The Adopter releases Rescue from any liability and agrees to hold harmless, rescue and any of its employees, volunteers, agents, directors or trustees from any and all liability related to the horse, and any injury or cause of action related to the horse.
