Session 3.1: Recruitment Rules in IA & AD and Reservations and Concessions in Appointments and Promotions.

SESSION OVERVIEW

The founding fathers of the Indian Constitution specifically provided for taking into consideration the claims of the members of the SCs & STs in matters of employment under the State. The constitutional provisions also empower the State to make provision for the reservation of posts in favour of backward class of citizens. The Constitution makers have proclaimed by incorporating various provisions in the Constitution of India indicating that “Scheduled Caste and Scheduled Tribe” are by and large backward in comparison with other communities in the country. This is the result of historical causes. There is a definite need to improve the condition of the Scheduled Castes and Scheduled Tribes as to bring them at par with other sections of the society as part of the scheme for the uplift as envisaged in our Constitution.

It was this consciousness and awareness of the Constitution-makers about the neglected position of certain section of Indian Society which inspired them to make provisions of reservation in favour of Backward Classes, Scheduled Caste and Schedule Tribe citizens in public employment. This constitutionally protected right of the Schedule Castes and Scheduled Tribes should be respected by all employers including the Government of India.

In this session we will learn about the Recruitment Rules as applicable to our Department and the extent and basic rules of Reservation, Relaxation and Concessions allowed to SCs, STs, OBCs, Sportspersons, Ex-Servicemen, Physically handicapped persons; in the matters of appointment and Promotion in the service.

LEARNING OBJECTIVE

The main aim of the discussion is to make participants understand the necessity of reservations for various categories of persons and to follow various rules and regulations governing these reservations to avoid any kind of miscarriage of justice; and to apply the provisions in appropriate and eligible cases keeping due regard to the Recruitment Rules.

A. RECRUITMENT RULES

1. Ministries / Departments are responsible for framing recruitment rules for posts/ services under their control till the Parliament by law regulates the recruitment and conditions of service. The recruitment rules will be framed within three months of creation of posts and published in the Gazette or from a prospective date mentioned therein.

1.2 The recruitment rules cover the following aspects:-

i) Designation and classification of posts, duration, scale of pay, filling up of the posts such as by direct recruitment, promotion, deputation (from other departments, etc.) and absorption.

ii)Qualification – Age, educational, experience, length of service, etc.

iii) Reservation for specified categories, such as SCs/ STs, handicapped personnel, etc.,and scope for exemption from reservation.

iv) General condition imposed by the Constitution of India such as domicile, bigamous marriage.

v) Promotional Avenues

vi) Appointing Authority – Generally as specified in the schedule to the CCS (CCA) Rules, 1965. the powers are specific and statutory. They cannot be re-delegated to anyone else even if senior in rank or to anyone performing current duties.

vii) Recruiting authority – UPSC/ SSC / Appointing Authority for posts not taken over by SSC.

2. Authority – Indian Auditand AccountsDepartment
2.1 Under Article 148 (5) the conditions of service of persons serving in the Indian Audit and Accounts Departments are regulated by rules made by President after consultation with the Comptroller and Auditor General of India. No separate rules have been made by the President under this Article. The rules framed by the President for the other civil services and posts are made applicable to persons serving in the Indian Audit and Accounts Department after consultation with the Comptroller and Auditor General of India.

2.1 Common aspects of every Recruitment Rules-

i) Gazette Notification No. –details about the post to which it applies. Mention of supersession of earlier notification, if applicable.

ii) Short title and commencement- These rules may be called the (as per applicable)cadre Recruitment Rules, (the year of notification). They shall come into force on the date of their publication in the Official Gazette.

iii) Applicable—to the posts specified in column 1 of the Schedule below.

iv) Number of posts, classification and scales of pay— as specified in columns 2 to 4 of the Schedule.

v) Method of recruitment, age limit, qualifications etc— as specified in columns 5 to 14 of the Schedule.

vi) Controlling Authority of the posts—The posts shall be controlled by Controller General of Accounts in Ministry of Finance.

vii) Liability for transfer-The PAO and Sr. AO shall be liable to transfer any where in India.

viii) Disqualifications —No person.—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage, with any person, shall be eligible for appointment to any of the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

ix) Power to relax—Where the Central Government is of the opinion that it is necessary or expedient so to do. it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

x) Saving—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-serviceman and other special categories of persons hi accordance with the orders issued by the Central Government from time to time in this regard.

(ii) Senior Accountants/Senior Auditors who have qualified the SAS or equivalent to Junior Accounts Officer Exam with ,3 years regular service in thegrade.The departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, Deputationists shall not be eligible for consideration for appointment by Promotion.
