Dear Ms. Marjanovic,

I refer to your letter of 24 January 2002 requesting a written waiver from the High Representative’s Decision of 27 April 2000 that bans the reallocation of state owned property, including former socially-owned property.

In particular, you request this office to allow the Municipality of Jajce to allocate five plots of land, registered in the land books as cadastral units, as it follows:

number 75/17 (made of the parcel 75/1), covering the area of 70 m2 – cadastral municipality of Divicani,

number 869/3 (made of the parcel 869/1), covering the area of 130 m2 – cadastral municipality of Barevo,

number 869/2 (made of the parcel 869/1), covering the area of 70 m2 – cadastral municipality of Mile,

number 715/18 (made of the parcel 715/14), covering the area of 70 m2 – cadastral municipality Sibenica and

number 76/136 (made of the parcel 76/121), covering the area of 210 m2 – cadastral municipality of Divicani to the HPT-Mostar, Telecommunication Center – IJ KT Jajce for the purpose of legalising the existing telecommunication buildings TTZ-1024 for the placement of telephone exchanges for the areas of Podmilacje, Barevo, Mile, Sibenica and Kupresani.

The land books records that you enclose demonstrate that the above mentioned cadastral numbers refer to socially-owned and undeveloped land with the right of use on the Municipality of Jajce with no other users registered.

Based on the Article 47 of the Law on Construction Land the land allocation in question was confirmed by the Municipal Council of Jajce, in its decisions: number 03-31-280/01, number 03-31-1519/01, number 03-31-282/01, number 03-31-1452/01 and number 03-31-283/01 of 20 December 2001. The land allocation in question was also approved by the Deputy of the Municipal Public Attorney, Mr. Esad Hodzic, in his Opinion number U 1/02 of 9 January 2002, who states that the land allocations in question are in accordance with the relevant laws and regulations. The Investor’s request for the urban permits was approved on 5 December 2001.

According to the Municipal Council’s Decisions of 20 December 2001, the Investor is obliged to pay the land allocation compensation as it follows: for the land registered as cadastral unit 75/17, amount of 630.00 KM, for the land registered as cadastral unit 869/3 amount of 1,170.00 KM, for the land registered as cadastral unit 869/2 amount of 630.00 KM, for the land registered as cadastral unit 715/18 amount of 630.00 KM and for the land registered as cadastral unit 76/136 amount of 1,890.00 KM.

In light of the information that you have provided, this office authorises the Municipality of Jajce to allocate the aforesaid land for the purpose described above.

To the extent that this waiver is granted on the basis of the validity of the documentation you have provided, this waiver shall itself cease to be valid if a court of competent jurisdiction, under a final and binding decision, brings into question the authenticity or accuracy of this documentation, and/or the information that it contains.
