Synopsis As Introduced
Creates the Illinois Universal Health Care Act. Provides that all individuals residing in the State are covered under the Illinois Health Services Program for health insurance. Sets forth the health coverage benefits that participants are entitled to under the Program. Sets forth the qualification requirements for participating health providers. Sets forth standards for provider reimbursement. Provides that it is unlawful for private health insurers to sell health insurance coverage that duplicates the coverage of the Program. Provides that investor-ownership of health delivery facilities is unlawful. Provides that the State shall establish the Illinois Health Services Trust to provide financing for the Program. Sets forth the requirements for claims billing under the Program. Provides that the Program shall include funding for long-term care services and mental health services. Provides that the Program shall establish a single prescription drug formulary and list of approved durable medical goods and supplies. Creates the Pharmaceutical and Durable Medical Goods Committee to negotiate the prices of pharmaceuticals and durable medical goods with suppliers or manufacturers on an open bid competitive basis. Sets forth provisions concerning patients' rights. Provides that the employees of the Program shall be compensated in accordance with the current pay scale for State employees and as deemed professionally appropriate by the General Assembly.

Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that any licensee disciplined under a licensure Act administered by the Division of Professional Regulation for an offense relating to the failure to pay taxes or student loans or relating to continuing education or advertising may file a petition with the Department on forms provided by the Department, along with the required fee of $200, to have the records of that offense removed from public view on the Department's website if certain conditions are met. Provides that nothing shall prohibit the Department from using a previous discipline for any regulatory purpose or from releasing records of a previous discipline upon request from law enforcement, other governmental body, or the public. Provides that removal of records of a disciplinary offense from the Department's website shall not be considered a vacating or expunging of the offense from the licensee's disciplinary record. Effective immediately.

Amends the Chicago School District Article of the School Code. On or before July 1, 2015 and thereafter, requires the Chicago Board of Education to appoint a superintendent of early childhood education. Provides that persons appointed to that office shall serve pursuant to a performance-based contract for a term ending on June 30th of the third calendar year after appointment. Provides that the superintendent of early childhood education shall have charge and control of the provision of early childhood education by the district, subject to the approval of the board. With regard to the provision of early childhood education by the district, provides that, on July 1, 2015, all powers, duties, assets, liabilities, employees, contracts, property, records, pending business, and unexpended funds of the general superintendent of schools, the chief executive officer, or persons appointed by the general superintendent of schools or chief executive officer are transferred to the superintendent of early childhood education. Sets forth other provisions with respect to this transfer.

Amends the Early Intervention Services System Act. Provides that all early intervention services shall be initiated as soon as possible, but not later than 30 days after parental consent has been obtained for the Individualized Family Service Plan. Provides that services may be initiated later than 30 days after parental consent has been obtained if the multidisciplinary team determines that a later initiation date is necessary in order to meet the individual needs of the child and family, the child's parent provides informed written consent for the later initiation date, and the reasons for the later initiation date are documented by the multidisciplinary team. In provisions concerning procedural safeguards, provides that a child shall continue to receive the appropriate early intervention services during the pendency of any State complaint procedure, due process hearing, or mediation (instead of any proceedings or action) involving a complaint, unless the State agency and the parents or guardian otherwise agree. Effective immediately.
House Committee Amendment No. 2
Replaces everything after the enacting clause. Reinserts the provisions of the bill as introduced, but with the following change: Removes the amendatory changes providing that (i) all early intervention services shall be initiated as soon as possible, but not later than 30 days after parental consent has been obtained for the Individualized Family Service Plan; and (ii) services may be initiated later than 30 days after parental consent has been obtained if the multidisciplinary team determines that a later initiation date is necessary in order to meet the individual needs of the child and family, the child's parent provides informed written consent for the later initiation date, and the reasons for the later initiation date are documented by the multidisciplinary team. Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides the Department of Financial and Professional Regulation with the authority to grant volunteer licenses to licensed health care professionals. Defines "volunteer practice" and provides that a health care professional practicing under a volunteer license shall engage only in volunteer practice. Further provides that a volunteer license shall be granted in accordance with the requirements of the licensing Act that applies to the health care professional's given field of health care practice and that the licensure fee shall be waived.
House Committee Amendment No. 3
Replaces everything after the enacting clause. Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides the Department of Financial and Professional Regulation with the authority to grant volunteer licenses to licensed health care professionals. Defines "volunteer practice" and "health care professional". Provides that the Department may grant a volunteer license to a health care professional who meets the requirements of the licensing Act that applies to his or her health care profession and the rules adopted under the Act and who agrees to engage in the volunteer practice of his or her health care profession in a free medical clinic or in a public health clinic and to not practice for compensation. Further provides that a volunteer license shall be granted in accordance with the licensing Act that applies to the health care professional's given health care profession and that the licensure fee shall be set by rule. Prohibits a health care professional from holding a non-volunteer license and a volunteer license in the same health care profession at the same time. Requires that the Department waive the licensure fee for the first 500 volunteer licenses issued and provides that the Department may by rule provide for a fee waiver or fee reduction that shall apply to all licenses issued after the initial 500. Provides that the Department shall file proposed rules implementing these provisions within 6 months after the effective date of this amendatory Act. Effective immediately.

Creates the Telehealth Act. Provides that telehealth services consist of (1) the provision of services and the mode of delivering health care services, including, but not limited to, primary care, counseling, psychiatry, emergency care, and specialty care and public health services via information and communication technologies, including, but not limited to, remote patient monitoring, to facilitate the examination, assessment, diagnosis, consultation, treatment, education, care management, and self-management of a patient's health care while the patient is at the originating site and the health care provider is at a distant site and (2) as it relates to the delivery of health care, mental health care, or substance use disorder treatment, the use of interactive audio, video, or other telecommunications or electronic technology by a health care provider to deliver a health care service within the scope of practice of the health care provider from the distant site to the originating site at which the patient is located. Sets forth the requirements for the delivery of telehealth services and telepsychiatry services. Amends the Illinois Insurance Code, the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, and the Voluntary Health Services Plans Act to provide that health care plans and policies must provide coverage for telehealth services, including primary care, counseling, psychiatry, emergency care, and specialty care as set forth in the Illinois Insurance Code and as otherwise set forth in the Telehealth Act. Sets forth requirements concerning the coverage of telehealth services.

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the scope of practice for community health workers is a set of core competencies that include skills and areas of knowledge that are essential to bringing about expanded health in diverse communities and to reduce health disparities. Sets forth core competencies for effective community health workers as members of health teams. Provides that within 90 days after the effective date of the amendatory Act, the Director of Public Health shall establish and appoint the Illinois Community Health Worker Advisory Board. Provides that the Board shall propose to the Department leadership the training and certification processes for community health workers and that the Board shall also advise the Department, the Governor, and the General Assembly on all matters that impact the effective work of community health workers. Sets forth provisions concerning Board membership. Provides that the Board shall develop a plan for the certification process of community health workers.

Replaces everything after the enacting clause with the introduced bill with the following changes. Deletes the provision that the scope of practice for community health workers is a set of core competencies that include skills and areas of knowledge that are essential to bringing about expanded health in diverse communities and to reduce health disparities. Provides instead that the core competencies of a community health worker include skills and areas of knowledge that are essential to bringing about expanded health and wellness in diverse communities and to reduce health disparities. Specifies that nothing in the provision concerning the integrated team-based health care, community health workers, and the creation of the Illinois Community Health Worker Advisory Board shall permit a non-certified community health worker to engage in or perform any act or service for which a license issued by a professional licensing board is required. Specifies that the 11 members of the Board are voting members and shall represent different racial and ethnic backgrounds and geographic areas. Requires the Board to develop and submit a proposed plan by December 31, 2014 for the certification process of community health workers to the Director of Public Health, the Governor, and the General Assembly within 9 months after their first meeting. Provides that members of the Board shall serve without compensation, but may be reimbursed for reasonable expenses incurred as a result of their duties as members of the Board from funds appropriated by the General Assembly for that purpose. Requires the Department of Public Health to provide administrative and staff support to the Board. Dissolves the Board on January 1, 2015. Makes other changes.
Senate Committee Amendment No. 1
Replaces everything after the enacting clause. Creates the Community Health Worker Advisory Board Act. Establishes the Advisory Board on Community Health Workers and sets forth the membership of the Board. Requires the Department of Public Health to provide administrative and staff support to the Board. Provides that the Board shall consider the core competencies of a community health worker, including skills and areas of knowledge that are essential to bringing about expanded health and wellness in diverse communities and reducing health disparities. Requires the Board to develop a report with its recommendations regarding the certification process of community health workers and sets forth the information to be included in the report.
