This Notice shall satisfy the above-cited two separate but related procedural notification requirements.

REQUEST FOR RELEASE OF FUNDS

On or about (day & date [which is at least one day after the end of the comment period]) the Oklahoma Housing Finance Agency will submit a request to the U.S. Department of Housing and Urban Development, Oklahoma for the release of HOME Investment Partnerships Program (HOME) funds under Title II of the Cranston-Gonzales National Affordable Housing Act of 1990 to undertake a project known as (project title), for the purpose of (nature/scope/total development cost/HOME fundsfor project, and project address/location).

FINDING OF NO SIGNIFICANT IMPACT

The Oklahoma Housing Finance Agency has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Oklahoma Housing Finance Agency, 100 NW 63rd St., Suite200, Oklahoma City, OK73116 and may be examined or copied weekdays from 8:30 A.M. to 4:30 P.M.

PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Oklahoma Housing Finance Agency, Attn: John Marshall, 100 NW 63rd St., Suite 200, Oklahoma City, OK73116 or PO Box 26720, Oklahoma City,OK73126-0720. All comments received by (if notice is published: notice date plus fifteen days--if notice is posted: posting date plus eighteen days. NOTE: last day of the comment period must be a day when OHFA is open for business, i.e. the Monday following a weekend or next business day after a holiday on which OHFA is closed) will be considered by the Oklahoma Housing Finance Agency prior to authorizing the submission of a request for release of funds. Commentors should specify which part of this Notice theyare addressing.

RELEASE OF FUNDS

The Oklahoma Housing Finance Agency certifies to theU.S. Department of Housing and Urban Development, Oklahomathat John Marshall in his capacity as Housing Development Team Leader consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. U.S. Department of Housing and Urban Development, Oklahoma’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Oklahoma Housing Finance Agency to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

U.S. Department of Housing and Urban Development, Oklahoma will consider objections to its release of funds and the Oklahoma Housing Finance Agency’s certification received by (anticipated date of HUD/state receipt of rrof/c plus fifteen days. NOTE: last day of the objection period must be a day when HUD/Oklahoma is open for business, i.e. the Monday following a weekend or next business day after a holiday on which HUD/Oklahoma is closed) or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the Oklahoma Housing Finance Agency approved by U.S. Department of Housing and Urban Development, Oklahoma; (b) the Oklahoma Housing Finance Agency has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by theU.S. Department of Housing and Urban Development, Oklahoma; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the U.S. Department of Housing and Urban Development, Attn: Community Planning & Development,301 NW 6th St., Suite 200, Oklahoma City, OK73102. Potential objectors should contact U.S. Department of Housing and Urban Development, Oklahoma to verify the actual last day of the objection period.
