INTRODUCTION OF ORDINANCE NO. 46-2010, AN ORDINANCE AMENDING CITY ORDINANCE 2-97 CHAPTER 32-36, ENTITLED “SPECIAL LAW ENFORCEMENT OFFICERS PROGRAM” ADOPTED FEBRUARY 18, 1997
BE IT RESOLVED that the above ordinance, being Ordinance 46-2010 as introduced, does now pass on first reading and that said Ordinance shall be considered for final passage at a meeting to be held on January 4, 2011 at 7:00 p.m. or as soon thereafter as the matter can be reached at the regular meeting place of the City Council and at such time and place all persons interested be given an opportunity to be heard concerning said Ordinance and that the City Clerk be and she is hereby authorized and directed to publish said ordinance according to law with a notice of its introduction and passage on first reading and of the time and place when and where said ordinance will be further considered for final passage.

WHEREAS, the governing body of the City of Hackensack has been advised that an emergency affecting the safety and welfare of the City of Hackensack and the general public did occur when an intersection traffic light repair at Hudson and Moonachie was needed; and
WHEREAS, the signals department notified the City Manager setting forth the circumstances regarding this emergency; and
WHEREAS, the cost of repair was $9,484.87 which is fair and reasonable; and Allan Briteway Electric has supplied all materials and overhead for such; and
WHEREAS, the Chief Financial Officer has certified that funds are available in the PPS account 0-05-55-502-000-273, purchase order #10-00992.
NOW, THEREFORE, BE IT RESOLVED by the City of Hackensack pursuant to N.J.S.A. 40A:11-6 which authorizes the governing body to pay Allen Briteway Electric of 130 Algonquin Parkway, Whippany, NJ 07981 for this emergency therefore be paid.

WHEREAS, pursuant to an advertisement in The Record, proposals were received on December 3, 2010 for Shade Tree Supply and Planting of 20 trees on City streets of the City of Hackensack; and
WHEREAS, five bids were received from Greenland Landscape, Ascape Landscape, D’Onofrio & Sons, Inc., F.A. Bartlett, Edward Clark Landscape; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the contract for Shade Tree Supply and Planting of 20 trees be awarded to Greenland Landscape Co., Inc., 396 Forest Avenue, Paramus, NJ, 07652 for the contract price of $6,317.50; and

WHEREAS, the City of Hackensack Police Department requires an Online Training Module designed specifically for their computer system; and
WHEREAS, the services are of extraordinary nature for mandatory training requirements set forth by the New Jersey Attorney General’s Office and the CALEA and NJSACOP accreditation Programs; in 5:3014C promulgated by the Local Finance Board, Division of Local Government Services, Inc.; and

WHEREAS, statute N.J.S.A. 53:3-21 permits an appeal by taxpayer or taxing district, petition, complaint;
WHEREAS, a taxpayer feeling aggrieved by the assessed valuation of the taxpayer’s property, or feeling discriminated against by the assessed valuation of other property in the county, or a taxing district which may feel discriminated against by the assessed valuation of property in the taxing district, or by the assessed valuation of property in another taxing district, in the county, may on or before April 1, or 45 days from the date the bulk mailing of notification of assessment is completed in the taxing district, whichever is later, appeal to the county board of taxation by filing with it a petition of appeal;
WHEREAS, Armour Realty LLC, has filed a direct appeal with the Tax Court of New Jersey, for property known as Block 304 Lot 5, also known as 32 Mercer Street, Hackensack, for the years 2008-2009 and has been granted the Freeze Act for 2010 per N.J.S.A. 54:51A-8.

WHEREAS, the Fire Chief of the City of Hackensack has recommended that said agreement be renewed for the years 2011 and 2012;

WHEREAS, the Tax Assessor finds and declares that New Boston Prism Hackensack LLC was not at any time the owner of Block 504.02 Lot 14.02, also known as “Commerce Way” and,
WHEREAS, any tax payments made by New Boston Prism Hackensack LLC for Block 504.02 Lot 14.02 should be refunded to them for the previous years in question, as authorized by the Governing Body; and
WHEREAS, the rightful owner, Hackensack Industrial Center, is responsible for real estate taxes on this property for 2005 to present, and will be given 60 days to make payment without interest;
