RULES AND REGULATIONS

Reasonable rules and regulations are necessary for the comfort and convenience of residents and their guests and in order to maintain a family residential community of which we can continue to be justifiably proud. Accordingly, the Board of Directors of Harbourtowne at Country Woods has been authorized by Florida Statues and by the Condominium documents to adopt such rules as in its judgment may be required to achieve those goals. We believe these rules simply meet the test of common sense. The Association intends to enforce the rules strictly. If necessary, legal action will be taken to enforce them.

Please understand, you are renting a Condominium, not an apartment. These rules are in addition to any rules in your rental agreement. If there is a conflict between terms in your rental agreement and this document, this document shall supersede those terms in your rental agreement. Furthermore, these rules are effective as of May 18, 1998 - all previously adopted or modified Rules are hereby repealed and revoked and the Restrictions contained herein shall be substituted for all current or previously existing Rules in their entirely.

The Association is responsible for the grounds and common areas. If you are an owner, you are responsible for the interior of your condominium. If you are leasing a condominium, please review your lease to determine who is responsible for interior maintenance.

2. RENTAL APPLICATION AND APPROVAL PROCEDURE

(a)   If an owner is listing a unit with a rental agent other than an on-site agent, the owner shall notify the AssociationManagement office of such listing. Unit owners are responsible for informing rental agents of the Association’s rental rules and procedures, copies of which are available at the AssociationManagement office during normal business hours at a cost of $5.00 each. If the owner already has a unit listed with an on-site rental company, then either the owner or agent may notify the AssociationManagement office of such a listing. The owner is responsible for reporting any changes in the rental agent to AssociationManagement.

(b)   A rental approval application in a form specified by the Board of Directors shall be completed in its entiretly and submitted to the AssociationManagement office. Applications must be accompanied by completed forms relating to policies governing pets, garbage and parking. New lessees agree to supply the Association with a photograph of their pet prior to moving in. Applications not completely filled in shall be returned and not acted upon until received in its complete form. The Board, at its sole option, may accept an Agent rental application in lieu of a Board application form.

(c)   An application for rental or resale must be submitted together with a fifty dollar ($50.00) fee plus the cost of credit reports. The fees are non-refundable and are intended to cover costs associated with receiving these applications. The Board at its option, may accept a credit report from an Agent provided the applicant consents.

(d)   Any and all proposed new lessees shall met the following criteria:

1.   Their gross monthly income shall be sufficient to adequately cover the cost of the monthly rent and utilities.

2.   They have never been evicted.

3.   There have ever been any civil actions against them as a result of non-payment of any account.

4.   They have never been subject to any collections relating to any utility.

5.   They shall have a maximum of two (2) vehicles per household unit, with no exceptions. All vehicles must conform to Item 9 Parking and Vehicles Rules and Regulations as set out in this document.The Management office shall verify character and credit reference employment records, previous addresses and miscellaneous personal information.

(e)   All applications that have been processed by the AssociationManagement office shall be submitted to the Review Committee for approval and shall be acted upon by the Board within ten (10) days.

(f) Approval shall be denied by the Board if the background investigation by the review committee reveals a history of violations of rules and regulations at previous residences, reports of damage or forfeiture of security deposits, or if information submitted on the application is false or misleading, or if references are not able to be verified or if the applicant is not willing to submit and accept Board rules and restrictions. Interviews will be in person, not over the telephone.

(g) Applicant and unit owners shall be notified in writing by the AssociationManagement office of the Board’s’ action.

(h) The Associationmanagement office shall be notified at least one day in advance of any move-ins, after an application has been approved by the Board.

(i) . Tenants mMovinge-ins orand movinge-outs must check in at the Association office prior to move. All move-ins and move-outs shall be between 9:00 a.m. and 9:00 p.m. ONLY.


3.   USE REGULATIONS

(a)   GARBAGE AND TRASH:

All trash/garbage must be securely bundled in plastic bags before being placed in dumpsters. Every one must dispose of trash in the dumpsters provided. No items are to be placed outside the dumpsters. All trash/garbage must be securely bundled in plastic bags before being placed in dumpsters. Residents are responsible for removal of all bulk items. Call City of Dunedin - Trash Pickup at 738-1887 to arrange for large item disposal. There is a charge for dumping fees if caught dumping beside dumpsters.

Except to the extent necessary for normal household use, no person shall use or permit to be brought on to the Condominium property any flammable oil or fluid such as gasoline, kerosene, naphtha, benzene or other such articles or explosives.

© PET POLICY:

The Condominium Documents read as follows: “One pet will be allowed for owner residents only if the pet’s weight at maturity is under twenty (20) pounds. No pets will be allowed for lessee.”

In order to accommodate, to the extent possible, pets that are currently in residence, the Board has adopted the following rules:

(i)   Any pet currently in residence shall be registered with the Association by contacting the AssociationManagement Office. Registration shall take place within thirty days from the date of this Restriction. A sworn affidavit with regard to residency of the pet, executed by a registered veterinarian and the owner of the pet shall be required in order to insure the integrity of the restriction. The Board reserves the right to reject the registration of any pet for any reason.

(ii) The owner of the pet must sign and agree to a statement holding him/her responsible for any and all damage to the common property of the association and to others while on premises. When on the common grounds, pet must be kept on leash at all times. and potty scoopers must be used. Residents with a pet are responsible for cleaning up after their own pets - particularly all animal waste deposited on the common areas which must be picked up and disposed of in the proper receptacle.

(iii)   Only one pet is allowed and thatThe pet must be either a domestic dog or cat. The pet’s weight at maturity must be no more than twenty (20) pounds. No exotic pets are permitted, such as snakes, lizards, etc.

(v)   No new leases shall be entered into by the owner of a condominium where there is a pet. There shall be no replacement of any pets upon its permanent removal or death.

Any registered pet which causes a nuisance may, after proper notification and/or penalty, shall be required to be removed from the condominium property.

(d)   PERSONAL DRESS

(i)   Owners, lessees and their guests shall not appear in, or use the lobby, recreation rooms, or any other area other than pool-side, in any form of attire other than street or sports clothes, to include tops.

(ii) Shoes or sandals must be worn at all times when outside of the condominium, except when at poolside.

(iii)   Shirts, robes or jacket tops must be worn at all times when outside of the condominium, except when at poolside.

(e)   PERSONAL PROPERTY

No items of personal property shall be kept or stored on the common elements, except in an area specifically designed for such use. Items of personal property left on the common elements are subject to removal without warning.

(f)   RESPONSIBILITY

All residents must be responsible for their actions and must see that visitors and guests comply with all use restrictions of the condominium. Violations by them shall subject the owner to the same liability as if the owner had committed the infraction. Observed violations must be reported in writing to the Association.

(g)   ROOF/MANHOLES

Only authorized maintenance and repair personnel are permitted on the roof of the building or in manholes.

(h)   SIGNS

No sign, advertisement, notices, lettering or descriptive design of any kind shall be displayed or placed upon any part of the Condominium property except in a place, style and manner approved by the Association.

(i)   SMOKING

Smoking in lobby, stairwells, corridors, and recreation room is prohibited. According to the Clean Indoor Air Act under jurisdiction #386.203 and Florida Statue, violators are subject to $100.00 fine for the first occurrence, and $500.00 fine for each subsequent occurrence.

(j)   SUPERVISION OF ASSOCIATION EMPLOYEES

No owner or tenant shall supervise, direct or attempt to assert any control over any of the employees of the Association and no owner or tenant shall request personal work of any such employee nor interfere with the work of maintenance personnel with lengthy conversations during work hours.

(k)   WALKWAYS

The walkways, corridors, halls, entrances and stairways shall not be obstructed or used for any purpose other than the providing of access, ingress and egress between the Common Elements and the units.

(l)   VIOLATIONS OF USE RESTRICTIONS

Fines may be levied by the Board of Directors as provided by law, after notice of the violation and a hearing are held.

4 UNIT OCCUPANCY

(a)   TOTAL OCCUPANCY

Depending upon the size of the unit, total occupancy, including overnight guests, will be limited to a reasonable number. “Reasonable number” shall be defined as:

ONE BEDROOM------2 PERSONS

TWO BEDROOM------4 PERSONS

THREE BEDROOM------6 PERSONS

(b) LEASE RESTRICTIONS

The minimum term for leases is three (3) months. Each apartment is restricted to residential use by owners, lessees, their immediate families and guests. All intended occupants must be named in the lease. No owner or lessee of any condominium units shall permit use for transient hotel or commercial purposes. Loaning of condominium is prohibited. The lease must specify that subletting is prohibited.

(c )© OWNER RESTRICTIONS

Occupancy of a unit shall be limited as follows:

In the case of ownership, the owner and his immediate family many occupy the unit within the overall occupancy limits indicated elsewhere herein. Immediate shall mean and be defined as the husband, wife, grandparents, parents, children and grandchildren.

Where the owner(s) of a unit desires to allow occupancy of the unit when the owner(s) isare not in occupancy, the following restrictions shall apply:

All guests must register in advance with the AssociationManagement office and upon arrival, the guests must report to the office. The unit may be occupied by one or more persons, subject to all other applicable occupancy limitations for a period of time not to exceed twenty-one (21) days in any calendar year. Any occupancy in excess of this restriction shall be deemed to be a lease, subject to application requirements and other approvals as contained in the condominium documents. Where a unit is subject to a lease or rental, only the person(s) whose names are listed on the lease may occupy the unit, as well as any guest(s) who may visit (subject to all other restrictions relative to use and occupancy of the condominium) while the lessee(s) is/are in residence. In the absence of the approved lessee(s), occupancy of the unit shall be prohibited. All lessee(s)’ guest(s) using the Common area facilities must be accompanied by the lessee.

Where a lease is to be entered into with any entity other than a natural person, the proposed Lessee shall be required to disclose the names and such other information as the Board may reasonably require of the natural persons who will occupy the unit during the period of the lease. Said designations may not be changed more than one (1) time during the term of the Lease.

5.   INDIVIDUAL UNIT BALCONIES AND EXTERIORS

(a)   ANTENNAS AND AERIALS:

No antenna or aerial shall be placed upon or affixed within the balcony area, extend or protrude beyond the exterior planes of such exterior areas, including the roof.

(b)   ALTERATIONS

No owner may paint or otherwise decorate, change, alter or modify the appearance of any portion of the building not contained within the unit, unless the prior written consent of the Association is obtained.

(i)   Only articles of lawn furniture or plants and planters may be kept on the balcony area.
