Information for Bidders
A. Submittals
A bid submittal must include the following documents:
· Signed Bid Form
· Signed Acknowledgement of all Addendums
· List of Sub-Contractors
· Bid Bond
· Certificate of Vote
· Non-Segregated Facilities Certification;
· Buy American Certificate;
· Certificate of Non-Collusion in Bidding for the Contract;
B. Proposal Submittals
All proposals must be made upon the blank proposal form bound herein, must give the price for each item and aggregate amount for the work, and must be signed and acknowledged by the bidder in accordance with the directions in the aforementioned documents.
C. Subcontractors and Major Suppliers
The bidder shall complete "Sub-Contractors" form of the Proposal, to include the following:
1. License numbers and work descriptions for each subcontractor performing work under this Contract shall be included. Each Subcontractor shall hold an appropriate and valid license issued by the State of Arizona Registrar of Contractors.
2. Major suppliers and manufacturers whose "services' are in excess of $10,000.00 shall be listed with the description of the service or products. For purposes of this requirement, such suppliers and manufacturers shall include both those who provide services or materials on the job site and those who provide services or materials off site that are brought to the site for incorporation into the project. The completion of the "Certification of Intentions Concerning Subcontracting" with false or incorrect information with the intent to avoid the licensing requirements or to mislead the Sponsor as to which sub contractors are intended to be used shall be considered irregular and will be rejected. False, incorrect or incomplete information which is, in the opinion of the Sponsor, either inadvertent or which will result in a benefit to the Sponsor may be waived by the Sponsor.
The Sponsor will use the "Sub-Contractors" form in determining the competency and capability of those who will be allowed to work on the Sponsor's project. Once a subcontractor or supplier has been listed and approved, a change will not be allowed unless said subcontractor or supplier is unable to perform or unless express authorization to change a subcontractor is given by the Sponsor. All subcontractors substituted pursuant to this paragraph shall first be approved by the Sponsor.
D. Coordination with Utilities shall be the Contractor's Responsibility
The Contractor shall contact a representative of affected utility companies or providers to coordinate any of the Contractor's work that may involve a specific utility and he shall coordinate his operations with the utility to facilitate the satisfactory completion of the work.
At least forty-eight (48) hours prior to commencing excavation, the Contractor shall call Blue Stake Center between the hours of 7:00 a.m. and 4:30 p.m. Monday through Friday, for information relative to the location of buried energy, communications and water utilities at 1-800-STAKE-IT.
The Contractor shall take full responsibility of costs incurred due to damage to utilities as a result of grading or excavation operations. Utility locations shown on the Plans are approximate, and all utilities are not necessarily shown. The possibility of conflicts with in-place utilities-in-service exists. The Contractor shall make all arrangements necessary to maintain utility service to all existing uses during the full term of the work.
It shall be the responsibility of the Contractor to contact the utility companies in order for them to determine if there is a need for any bracing or shoring of power or telephone poles during the construction of the project. If bracing or shoring is necessary, the Contractor shall effect this work to the satisfaction of the utility company.
No measurement or direct payment will be made for bracing or shoring.
E. Submitting Bids
No bid will be considered unless it is submitted on the bid forms contained herein. Bids received after the time and date specified above will be returned unopened to the bidder. A bid may be withdrawn prior to the time set for opening bids.
Bids accepted by the Sponsor constitute a legally binding offer. In addition, the successful bidder will be required to sign a construction contract.
F. Telegraphic, Facsimile or Electronic Modification
Telegraphic, facsimile or electronic submissions or modifications of bids already received by the Finance Office will not be permitted. Modifications to submitted bids must follow the process delineated under Item 15 (Withdrawal of Bids) below, whereby bids are withdrawn, modified and resubmitted to the Chief Financial Officer in person before the specified date and time of the bid opening.
G. Bonds Required
1. Each bid must be accompanied by a cashier's check made payable to the order of the Sponsor in the sum of not less than 10% of the total bid, or a bond with sufficient sureties to be approved by the Yuma County Airport Authority in the sum equal to 10% of the total bid, and naming the Yuma County Airport Authority as obligee.
2. Bonds in the following amount will be required at the time of executing the contract:
1) Contract (Performance) Bond - One Hundred (100%) percent of the contract price.
2) Labor and Materials (Payment ) Bond - One Hundred (100%) percent of the Contract Price.
3. At the time of approval of any additional work by CHANGE ORDER the Contractor may be required to provide an additional amount for Contract (performance) Bond and/or Labor and Material (payment) Bond as deemed appropriate by the Yuma County Airport Authority.
4. Performance and Payment Bonds must be provided on Statutory forms included in Part IV of these documents.
5. Each bond shall be executed solely by a surety company or companies holding a Certificate of Authority to transact surety business in the State of Arizona issued by the Director of the State Department of Insurance pursuant to Arizona Revised Statutes. The bonds shall not be executed by an individual or personal surety or sureties.
H. Interpretations, Addenda
Should a Bidder find an ambiguity, inconsistency or error in the Drawings or Contract Documents, or should he be in doubt as to their meaning, he shall at once notify the Sponsor, who will prepare a written addendum. Neither the Owner nor the Engineer will be responsible for oral instructions or information. In the event questions are received less than four (4) days before the bid opening a determination will be made concerning the sending of written addendum which may result in the establishment of a new bid opening date.
Questions or interpretations required by contractors, suppliers, dealers and other participants bidding, shall be directed to the Engineer. Each bidder shall designate a specific individual from their organization to communicate with the Sponsor. Any Addenda issued by the Engineer during the time of bidding are to be included in the Bid, and will become a part of the Contract. Bidders must acknowledge receipt of all Addenda on the Bid in the space provided.
Addenda will be mailed to each person or firm recorded as having received the Bidding Documents and will be available wherever the Bidding Documents are kept.
I. Rejection of Bids
The Sponsor reserves the right, as the interest of the Sponsor require, to reject any and all bids, to waive any informality in the bids received, and to accept, increase or reduce the quantities of any or all items of any bid, and reserves the right to reject the bid of any person who has been delinquent or unfaithful to any contract with the Sponsor.
J. Execution of Contract
The Contractor shall execute the contract with the Sponsor within ten (10) days after receiving the Notice of Award for the contract.
K. Site Investigation and Representations
The bidder must be acquainted with the nature and location of the WORK, the general and local conditions, particularly those bearing upon transportation, disposal, handling and storage of materials, availability of labor, water, electric power, roads and uncertainties of weather, the conformation and condition of the ground, the character, quality and quantity of surface and subsurface materials to be encountered, the character of equipment and facilities needed before and during performance of the WORK, the relation of the Plans and Specification, Drawings, and other Contract Documents to the actual conditions at the WORK site (including, without limitation, measurements, dimensions, layout, location of existing or future improvements, etc.), and all other matters which can in any way affect the WORK or costs under this contract. Any failure by the bidder to acquaint himself with information concerning these conditions does not relieve him from responsibility for estimating properly the difficulty or cost of successfully performing the WORK. The OWNER assumes no responsibility or liability for any discrepancy or omissions in the Plans and Specifications, Drawings, or Contract Documents (or as such discrepancies or omissions relate to the WORK site, including, without limitation, measurements, dimensions, layout, location of existing or future improvements, etc.), or any understanding or representations made by any of its employees or agents during or prior to the execution of this contract, unless (1) such understanding or representations are expressly stated in the contract, and (2) the contract expressly provides that the responsibility is assumed by the OWNER.
