We and each of us hereby agree to be bound in all respects by each and every one of the terms and conditions of the scheme as set forth in any schedule of preparation works.
*the lease shall be for a minimum of 5 years; a minimum of 3 years must remain on lease at time of application; a minimum of 3 years must remain on lease at time lane is to be surfaced. The land, the subject of the lease, must consist of 20% of the holding benefiting from the scheme and must not be less than 5 acres.

Local Improvement Schemes – Qualifying Conditions
1. (a) Eligible for inclusion in the Scheme
Projects which provide access to parcels of land of which at least two are owned, occupied or leased* by different persons engaged in separate agricultural activities.
* the lease shall be for a minimum of 5 years
* a minimum of 3 years must remain on the least at time of application
* a minimum of 3 years must remain on the lease at the time the lane is to be surfaced
* the land, subject to lease, must comply with the following:
It must consist of 20% of the holding benefiting from the L.I.S. land
It must not be less than 5 acres (*Meeting MCC June 3rd, 2008)
(b) Not eligible for inclusion in the Scheme
· Roads serving only houses or buildings occupied or used by persons not engaged in agriculture.
· Roads serving only Council cottages, i.e. non-vested cottages.
· Roads or drains on bogs being developed commercially for large scale turf production for sale.
· Drainage works only.
2. Expenses of the Council must be met partly by landholder’s contributions which can vary between 10% and 15% of the total cost.
3. Landholder’s contributions must be paid in advance of the work commencing.
4. The applicants will, on completion, maintain the work in good order and repair at their own expense. The County Council will have no responsibility for maintenance or upkeep thereafter.
5. At least one occupied dwelling-house must be served by the scheme.
6. The scheme shall not proceed past the last occupied dwelling-house on the lane.
7. All necessary drainage, widening, excavating and fencing to be carried out by the applicants prior to work commencing.
8. All surface vegetation to be removed prior to work commencing.
