TECHNICAL ASSIGNMENT
REGARDING: QuotationforDelivery, InstallationandCommissioningof 4 MeteorologicalStations
1. Currentstate:
Assarel-MedetJSCMiningandProcessingComplexislocatedintheSashtinskaSrednaGoraMountain at 11 km to the northwest from the town of Panagyurishte and to 90 km to the east from the capital, Sofia. (42.547516degrees north latitude and24.136276 degrees east longitude). Itoccupiesanareaofabout20,000 decares on a broken mountainous relief. Its average altitude is about 1,000 meters as the lowest point is at about 600 m and the highest point is at 1,500 m (according to the Baltic Altitude System).
The region is characterized with temperate climate with four seasons. Winter lasts from November to March and the air temperature varies from +5to -20С(-15Сis the average for the season).SummerishotanditlastsfromJunetoSeptemberwithairtemperatureupto +35С. The temperature within the pit area can reach + 45º С. The prevailing average temperature during the rest of the seasons is about 20С.
Themainworkshops, i.e. theMineandConcentratorPlant, workcontinuously24 hoursperdayand 365 daysperyear. Operations are performed in three shifts and the work time of the regular shift is 8 hours.
Currently, meteorologicaldataforAssarel-Medet’s industrial site is collected using devices with insufficient accuracy which do not measure all parameters. Constant readiness for collecting and accumulating data is not ensured since the reading of the devices is not automatic.
2. Requirements for the character (objective), contents and peculiarities of the service.
2.1. Objectiveandtasks
Theobjectiveistorendertheprocessofcontinuouscollecting, storageandremoteaccesstometeorologicaldatacompletelyautomaticfor 24 hoursperday (continuousmode) bypurchasing, installingandcommissioning 4 automatedstationswhichworkinanintegratedinformationalenvironment. Then, the said data shall be incorporated into the existing Dispatch System and all information systems of Assarel Medet JSC.
Theachievementofthisobjectivewillprovidemeteorologicaldataendurableintime, susceptibletoanalysisandcorrelation, neededforplanningandimplementationoftheinvestmentandproductionactivityofAssarel-MedetJSC.
2.2. Contents and scope of the task
2.2.1. Determining the location of the meteorological stations according to the requirements for their building up.
ThemeteorologicalstationshavetobelocatedinsuchawaysothatreliableinformationcanbeobtainedfromallaltitudesintheAssarelMineregion, LyulyakovitzaTailingsDam, AssarelConcentratorPlantandtheotherworkshops, unitsandfacilitiesontheAssarelindustrialsitewhichwillenablethedrawingofkeycurvesmonitoringthestatisticprocessingofdatafor hydrogeological and weather reports for the Company’s entire concession area.
ItwillbegoodthatthemeteorologicalstationintheMedetmineregionbe integrated into this system. It case this turns out to be impossible due to relief and linear obstacles, it may function individually.
2.2.2.Working design of the areas and the system
Preparation and submission of a work project for building up and accommodating the areas for the new equipment –levelness, degree of enclosure, foundations, power supply/autonomous supply, security systems, etc.
Theworkproject shall be prepared according to the requirements for equipment installation which is to be installed also according to the Bulgarian legislation in force applicable for these activities.
TheConstructionandInstallationPartoftheworkingprojectshallcontainbill of quantities for the types of activities and shall serve as an available prerequisite for carrying out a contest and assignment of the works to a contractor.
Thesystemshallbedesignedinsuchawaysothatitmusthavelowoperationandsubsequentmaintenanceandservicingcosts. The needed means for its implementation shall also be optimized.
Thefacilitiesandthesystemshalloperateefficientlyin the temperature range from -35 С to + 75 С.
2.2.3. Constructionoftheareas (ConstructionandInstallationWorks) – accomplishmentofthepreparedWorkProjectbytheselectedcontractor – fullengineeringincaseordesireornecessityorofferstudyandcontesttoassigntheConstructionandInstallationWorkstoacivilworkscontractorbasedontheprepared and accepted Working Project for building up and accommodating the areas.
2.2.4. Delivery–theneededequipmentshallbedeliveredincompliancewiththetechnicalcharacteristicsoftheTechnicalAssignmentwiththerespectivecompleteness, quality and configuration with reliability level which is to provide minimal availability of 95% throughout the year.
Thedeliveryshallbeaccompaniedwiththeappropriatedocumentationofthemanufacturer - certificates, operationandmaintenancemanuals, declarationofconformity, certificatesforqualitybythemanufacturer, planttestreports, softwarecertificates, etc., translatedintoBulgarian.
2.2.5. Equipmentinstallation – installationofqualityaccordingtotherequirementsfor normal, flawlessandsafeoperationoftheequipment.
2.2.6. Commissioningofthemeteorologicalstations
Aftertheequipmentinstallationandtests, 72-hourtestsshallbecarriedoutwhichwillinvolveacompletesetofmeasurements, datapresentingandprocessing thus ensuring the fulfillment of the technical requirements of the assignment. The testing programs and methods shall be prepared by the Contractor and approved by the Client.
2.2.7. Trainingofthepersonnel
TheContractorshallpresentatrainingprogramforoperators, maintenancepersonnelandengineers. The training aims to show how hardware and software are maintained during the warranty and after-warranty period. The training shall cover all user levels of the system, settings and maintenance as certificates for successful completion of the training will be issued.
2.2.8.BuildingupaconnectionbetweenthemeteorologicalstationsandtheestablishedinternalcorporatecommunicationnetworkofAssarel-MedetJSC (opticalnetwork, wireless network or structural cabling).
2.2.9.BuildingupasystemforautomatedcontinuouscollectingandunlimitedstorageofrepresentativemeteorologicaldatafromthemeteorologicalstationscomparablewiththedatafromthemeteorologicalstationsoftheNationalInstituteofHydrologyandMeteorology which are suitable for climatic, hydrological and other characteristic of the region.
Acommunicationconnectionhastobebuilt up from and to each meteorological station whose purpose is to provide reliable data transfer. The latter has to be integrated in the already established IT infrastructure of Assarel-Medet – optical network and structural cabling. Additional structure has to be provided for the remote access spots. The relief and communication peculiarities have to be considered during the design and implementations stage.
DatacollectionfromthemeteorologicalstationshastobedoneinrealtimeandtobefullyautomatedandintegratedinthelocalcomputernetworkofthecompanywithanequippedreceivingpointonAssarel-Medet’ssite. It shall consist of a computer, communication module and specialized software needed for meteorological data collection andprocessing. Thebackupvalues (permanentbackup) shallbestoredinthereceivingpointattheAssarel-Medetsitewithinthemeteorologicalstationslifetime.
A possibility for adding additional modules and sensors, if needed, shall be considered.
2.2.10.Developmentofasoftwareapplicationwhichshallallowdataexchangebetweentheautomatedsystemforcontinuousmeteorologicaldatacollectionfromthe 4 meteorologicalstationsandtheDispatchSystemofAssarel-MedetJSCandalsoremoteaccesstothecollectedmeteorologicaldata.
The software has to be developed in such a way so that the user can always exercise control. The user control has to be provided by one of the following directives:
-The user shall always be the active agent versus the system.
-Theusershallhavetheopportunitytodoarandom, buttothedefinedbythesystemdegree, setting of the graphical options such as font, color, size, etc.
Specific requirements to the software:
-The software must have text information written in Bulgarian sued in help files, home pages, menus, other controls, messages, including error messages as well. In addition, the text information shall be part of the resource files but not source codes of the developed software.
-TheBulgariantextusedintheinformationshallbefreeofanyvaguedefinitionswhichcanhavevariousmeaningsindifferentcontextsaswellasslangandinappropriateabbreviations.
-Keyboardabbreviationsinthedevelopedsoftwareshallcorrespondtothesystemabbreviationsoftheplatform. No duplication of additional keyboard abbreviations especially developed for the software with the system abbreviations is allowed.
Theusersoftwareshallprovideremoteaccessnotonlytothedatabaseswithbackupparametersbutalsototherealtimemonitoring(online)by at least three users.
2.2.11. Warrantyandafter-warrantyservicemaintenanceofthesystemforcontinuouscollectingofmeteorologicaldatabythe 4 meteorologicalstations, includingcalibrationonaregularbasis, shallbeprovided.
The Contractor shall provide a service for the meteorological stations as well as the needed spare parts, components and consumables for its normal operation during the warranty and aster-warranty period.
The lifetime of the individual machines, devices, consumables and sensors, their replacement period and forecast prices based on a one-year operation during the after-warranty period shall be stated..
2.2.12. Ingeneral, thesystemshallprovidethefollowingmeteorologicalcharacteristicsinrealtime:

- Evapotranspiration of the following sites:
-Watermirrorof the sprinkling fields at the leach dumpfield
- Watermirrorof Lyulyakovitza Tailings Dam
- Watermirrorof Pregnant Leach Solutions Tank;
- Watermirrorof Contact Water Tank – 400 cubic meters
- Watermirrorof the Medet Mine
- Flow at different spots/water movement sites
- Open channel for mine waters to the Mine Water Treatment Plant
- Pipelinebetweenthebufferwatertankand the Pregnant Leach Solutions Tank
- Open channel from the Microbiological Leaching Area to the tailings pipeline
2.2.13. Deadline for the task implementation – within 6 monthsuponcontractsignature
3. Quality requirements to the service
- Competitionpart :
- The quoting company shall mandatory make a site visit and asses the scope of work. It shall then sign a Site Visit Declaration. During the site visit by the quoting companies, it will be good that a specialist from the Information Technology and Equipment be present.
- ThequotationshallcontainaproposalforfinalfixedpricesinUSDorleva. The currency shall be selected upon discretion of the Buyer in the format in the Table – Attachment No. 2 which will remain the same for the entire period of the contract considering inflation and other processes which influence their formation. When payment is done in currency, the VAT payment will be done in leva according to the exchange rate of the Bulgarian National Bank as of the day when the invoice is issued.
Suggestions for elements of price formation for types of works which arose in the work process and were not included in Table 1. (The latter shall be filled in Table 1 below).
- Thequotationshallcontainaworkprogramandtableforthetaskimplementationincludingtaskstobefulfilled, deadline, unitpriceandtotalvalue (inleva, excludingVAT).
- The quotation shall contain an hourly rate and number of man hours for Supervision, if necessary.
- The quotations shall contain a detailed description of the activities with prices.
- The quotation shall contain a financial payment scheme for the project and the task. The maximally deferred payment of the amounts will be preferred.
- The work project has to be of minimal investments and minimal needed term for the Construction and Installation Works.
- Theworkproject, plannedConstructionandInstallationworksandtheentireimplementationofthetaskshallcomplywithallregulativerequirementsintheareaofenvironmentprotection, occupationalsafetyandhealthandfireprotection.
- The quoting company shall prepare a list with all sites where they have designed such a facility and give the names of at least three contact persons with their telephone numbers for references regarding their work, including access to their site for a site visit upon request by the Client.
- Thequotingcompanyshallpresentindividuallytheteamforthetaskimplementationwithevidencefortheirprofessionalandpracticalexperiencefordesignandimplementationofsitesofthesametype.
- IndividualcertificatesbytheChamberofEngineersintheInvestmentDesignfor 2012 ofthe specialists who are in charge of the task.
- The Contractor shall provide a maximal “Performance Bond” which covers the warranty period of the system as well as bank guarantees in case advance payment is provided in the payment scheme. The Performance Bond will be released when the set technical parameters for the warranty period are proven within 90 days upon successfully carried out 72-hout tests under operation conditions.
- The quoting company shall also state penalties in case of failure to implement the task.
- ThequotingorganizationsshallpresentaninsurancepolicyincompliancewithArticle 171 andArticle 172 oftheTerritorialArrangementActandtheRegulationfortheConditionsandOrderforMandatoryInsuranceinDesigningandConstructionaccepted with Enactment of the Council of Ministers No38 from February 24, 2004 promulgated in State Gazette, issue 7 from March 2, 2004.
- The quotations shall contain a detailed description of the activities according to table No. 1 of the Technical Assignment with specified prices.
-Quoted implementation term in business days for each of the activities in Table 1 of the Work Program.
- Readiness to start work.
- Payment way and conditions – the quoting companies shall present a payment financial scheme. The maximally deferred payment of the amounts will be preferred. Bank guarantee is required if advance payment is made.
- Assarel-Medet JSC shall retain 10 (ten) % of the total price of the work (or an issued band by an acceptable for Assarel-Medet JSC bank) until the project completion. The latter is to ensure that all clauses for delivery, installation and normal operation are fulfilled.
- Warranty period – at least 24 (twenty-four) months upon successfully carried out 72-hour tests.
- Delivery requirements – DDPAssarel-Medet JSC, town of Panagyurishte according to Incoterms – 2000.
- CertificatesforconformitywiththenationalandEuropeanstandards for occupational safety and work, environmental protection and fire protection, calibration certificate, origin of the equipment.
Delivery certificates – not less than 90 days.

4. Way and criteria for contractor selection
TheprincipleforacontractselectioniftherestoftherequirementsintheTechnicalAssignmentaresatisfiedtoamaximalextentis themostcost-effectivequotation.
Comparative analysis of the proposals is made based on the evaluation of the following:
- Meeting the technical requirements
- Quality, standardsandcertificates, provingprofessionalcompetenceandcompliancewiththestandards.
- Prices: complex and single ones.
- Guarantees.
- Payment terms.
- Ex works.
- Delivery and implementation term
- References /written letters of recommendation, proving the applicant’s experience.
Way and criteria for accepting the accomplished work
The meteorological stations will be finally accepted by an acceptance committee consisting of specialists of the company after carrying out the 72-hour tests with an Acceptance Certificate, approved by the Executive Director.
5. Otherconditions
1. TheGeneralRequirementstocontractsconcludedforactivitiesperformedbyhiredpartnersontheterritoriescontrolledbyAssarel-MedetJSCwithregardstooccupationalsafetyandhealth, fireprecaution, environmentprotection, accesscontrolandsecurityandhumanresourcesprovisionwhichwillbeintroducedtotheselectedcontractorupon concluding the contract and shall be complied with by the latter.
2. Any directions by the Occupational Safety and Health Department, Environment department and Corporate Security department and control authorities shall be mandatory observed.
3. The quoting companies will be given access to the site and the selected contractor will be admitted to the company’s territory within the standard work time.
4. The selected company shall present a complete price list with prices DDU/DDPAssarel-Medet JSC inUSDon a CD of the system spare parts and components – valid for 2012 and a commitment that the prices will not be changed in 2012. Price adjustment is allowed with maximum 1.5% per year after 2012.
5. Alistofallmajorcomponentsandtheirexpectedlifetimeinworkinghours (foreachcomponent) shallbepresented.
6. The quotations shall be submitted by 4.00 pm on 20.04.2012 in one of the following ways:

Thequotationshallbesubmittedin a large envelope which contains two smaller envelopes with the following contents:
Sealed envelope No. 1 with notice: DOCUMENTS (technical part) including all needed documents which concern the offered technical features, technical requirements and specifications, specification of the spare list (without prices), lifetime of the major units and components, suggested term for implementation, warranty, references, financial statement and costs and incomes report for the last three years.
Sealed envelope No.2with noticeCOMMERCIAL CONDITIONS (Attachment No. 2 to the Assignment)shall contain the Contractor’s proposal for price and way of payment of commodities/services.

Quotations are opened by the appointed for the purpose committee.
The results will be announced when the committee terminates its work as ranking of the submitted quotations shall be done only in one round.
The established order in the companyforstoringthequotations, transparencyandadherencetoprinciplesforthetimetheyarereviewedexcludesanypossibilityofinfluencingtheselectionofacontractionorupontheingoingqualitycontrolthroughbribing. Moreover, ifsuchattemptsarefoundout, theresponsibleofficialsshallbedisciplinarydismissedandthecontractswiththerespectivepartnersshall be terminated.
