IV.  Approval of the minutes

Ms. Linda Henley made a motion to accept the minutes of the November 18, 2013 meeting of the City Planning Commission. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

  1. Public Hearings

1)  SP-11-22 M2 (Continuation from 10/28/13) RC, SK, LH, RL

Special Permit Modification-Restaurant

Modify Site Plan

3001-3023 James Street and 114 North Midler Avenue

3001 James LLC-Tino Marcoccia (owner/applicant)

Business, Class A

Neither the applicant nor a designated representative appeared to speak to the Commission about the proposal, which consists of modifying the site plan to a Special Permit for a Restaurant in order to establish a 30-foot wide, right-in-right-out driveway on James Street on property situated at 3001-3023 James Street and 114 North Midler Avenue.

No one spoke in favor of or in opposition to the proposal.

After discussion and review, whereupon the Commission noted this was the third continuation of the Public Hearing and no progress had been made to provide requested traffic safety information, Dr. Ruben Cowart made a motion to deny the request without prejudice. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

2)  SP-13-20 (Continuation from 10/28/13) RC, SK, LH, RL

Special Permit-Restaurant

415 West Onondaga Street

PM General Services, LLC (owner/applicant)

Business, Class A

Neither the applicant nor a designated representative appeared to speak to the Commission about the proposal, which consists of establishing a take-out pizzeria on property situated at 415 West Onondaga Street, in which the applicant requested another extension to the Public Hearing in order to provide requested documentation from a traffic safety engineer.

No one spoke in favor of or in opposition to the proposal.

After further discussion and review, whereupon the Commission noted this was the third continuation of the Public Hearing and no progress had been made to provide requested traffic safety information, Dr. Ruben Cowart made a motion to approve the request with a negative SEQR declaration. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

3)  SP-13-28

Special Permit-Restaurant within a Convenience Store

308 North Crouse Avenue

Business, Class A

Ms. Ellen Priest, an attorney at 333 East Onondaga Street, spoke to the Commission about the proposal, which consists of establishing a deli-counter within a convenience store on property situated at 308 North Crouse Avenue.

One person spoke in favor of the proposal. Ten people spoke in opposition to the proposal.

After further discussion and review, whereupon the Commission noted that the proposal was not in compliance with applicable regulations of the City of Syracuse Zoning Rules and Regulations, as amended, and the proposal was not in harmony within the visual and physical context of the immediate neighborhood, Mr. Steve Kulick made a motion to deny the request without prejudice. Ms. Linda Henley seconded the motion. The motion passed unanimously.

Resubdivision

Realign Two Properties into Two New Lots

571 East Seneca Turnpike and 962 East Brighton Avenue

Mr. Brian Bouchard, of Clough, Harbor Associates at 441 South Salina Street, spoke to the Commission about the proposal, which consists of realigning two properties into two new Lots in order to comply with the existing zoning boundary as a companion Special Permit application to establish a Restaurant on property situated at 571 East Seneca Turnpike and 962 East Brighton Avenue.

Four people spoke in favor of the proposal. One person spoke in opposition to the proposal.

After further discussion and review, whereupon the Commission noted comments from the City of Syracuse Departments of Engineering and Water regarding the proposed lot lines, the Commission agreed to continue the Public Hearing at its next regularly scheduled meeting on December 30, 2013, in order to give the applicant additional time to deconflict the proposed lot line with City records.

Mr. Brian Bouchard, of Clough, Harbor Associates at 441 South Salina Street, spoke to the Commission about the proposal, which consists of establishing a restaurant with drive-thru service on property situated at 571 East Seneca Turnpike and 962 East Brighton Avenue.

Four people spoke in favor of the proposal. One person spoke in opposition to the proposal.

After further discussion and review, whereupon the Commission noted comments from the City of Syracuse Departments of Engineering and Public Works and the Division of City Planning, the Commission agreed to continue the Public Hearing at its next regularly scheduled meeting on December 30, 2013, in order to give the applicant additional time to address review comments and submit a revised proposal.

Special Permit-Indoor Amusement and Recreation

Mr. John Guhin, at 402 South Salina Street, and Mr. Joseph Carpenter, at 100 Haddonfield Place, spoke to the Commission about the proposal, which consists of establishing a fitness facility on property situated at 484 East Brighton Avenue.

No one spoke in favor of or in opposition to the proposal.

After further discussion and review, whereupon the Commission noted review comments submitted by the City of Syracuse Departments of Engineering and Public Works and the Division of City Planning, the Commission agreed to continue the Public Hearing at its next regularly scheduled meeting on December 30, 2013, in order to give the applicant additional time to respond to the review comments.
