NHS Property Services ‘Standard Lease’
The LMC has be informed that NHS Property Services is circulating a lease that is being framed a 'standard lease' which has the backing of the BMA. Although GPC has had a number of discussions with NHSPS about developing a standard lease, GPC has not agreed to standard lease nor endorsed one.
The LMC is bringing this matter to the attention of practices who are, or may become, tenants of NHSPS.
This notification is particularly relevant for GP tenants of NHSPS buildings currently in the process of negotiating a new lease with NHSPS. If this is the case, we would strongly advise practices not to sign any lease without seeking specialist legal advice first as well as notifying the LMC.
GPC is urgently raising this issue with NHSPS as it was their understanding that a standard lease was not in circulation.
Friends & Family Test (FFT) materials
NHS England has now published a range of materials relating to the Friends & Family Test that practices can use to publicise the scheme. These can be accessed here.
The FFT becomes a contractual requirement for GP practices from 1 December 2014. The GPC, NHS England and NHS Employers have jointly published guidance to help practices with implementation, which can be accessed here.
Patient Online Toolkit
In preparation for the 2015 GMS contractual obligation for GP online services (online appointment booking, online ordering of repeat prescriptions and online access to the summary information from the patient record), NHS England have produces a Patient Online Practice Toolkit. This can be accessed by the following link. The materials are also available on the RCGP website. The interactive toolkit provides guidance to practices on getting started with records access, identity verification, coercion and proxy access.

Ebola guidance for primary care
Practices are reminded that easy to understand guidance on how to deal with suspected Ebola cases is available in the BMA website. This website also provides links to the most up-to-date guidance on the Public Health England and Public Health Wales websites.
Sending documentation to area teams
NHS England has reported some confusion among practices about where to send their GMS Contract Variations Notices and Dementia Identification Schemes. Practices should always send this documentation to their area team rather than to the NHS England central office to ensure that the process runs smoothly.
Christmas and New Year openings 2014 - England
As Christmas and New Year approaches, practices should have received a statement from the Area Team detailing requirements for practice opening hours. Please note that Area Teams are mandated by NHS England to collect the information stated on the pro forma. Practices which wish to close early on Christmas Eve and New Year’s Eve should act in accordance with BMA guidance which can be found here. This guidance details contractual requirements and suggests actions practices might consider to ensure patients' reasonable needs are met.
Department of Transport guidance for healthcare professionals on drug driving
The Department of Transport guidance provides an explanation to healthcare professionals of the new drug driving offence. It also provides useful information on the statutory ‘medical defence’ available to patients who have taken their medicine in accordance with the advice of a healthcare professional. The document reminds healthcare professionals of existing advice that one would consider giving to patients about taking medicines that could impair their driving.
Payment of NHS Pension Scheme Contributions
During recent months a number of GP practices have not met the deadline for payment of pension contributions for their staff to the Scheme.
From April 1st 2014, NHS Pension Scheme regulations changed authorising NHS Pensions to charge interest at a rate of 4.7% APR and an administration charge of £75.00 to employers who pay late.
An amount is deemed late where contributions do not reach the NHS Pensions bank account by the 19th of the month, following the month in which the earnings were paid to the member.
In order to avoid inadvertently paying late when using the GP1 payment processing method, please note the following:
· Ensure that you submit the payment request with sufficient time for the payment to clear. The GP1 submission initiates a Direct Debit payment from your bank account that requires two to five working days (this excludes weekends and bank holidays). Payments submitted by the recommended processing date and time will ensure payment is received on time.
· Ensure that you press the “SUBMIT” button on the GP1 at the bottom of the screen. A small number of employers have missed making a payment because they have printed the input screen when processing the GP1 without finalising the action. A screen message will confirm your payment has been submitted.
To assist employers in ensuring they will meet the payment deadlines, a GP1 payment processing schedule is provided below for the remaining months of the 2014-15 financial year.

Maternity Pay for GP Trainees (Registrars)
We understands there may be some confusion for area teams regarding payment of maternity leave to GP trainees. To clarify, each new post on a rotation that a GP Trainee undertakes does not constitute a break in service. Where practices have followed the provisions in the GP trainees framework contract on maternity pay, which are consistent with the Directions to Health Education England (GP Registrars) 2013 and the NHS Litigation Authority (GP Registrars) 2013, the GP Trainee is entitled to receive ordinary maternity pay (OMP) and should be fully reimbursed in accordance with the Directions.
Paragraph 15.3.(b)(iii) of the Statement of Financial Entitlements (SFE) 2013 (page 58) confirms that NHS England should reimburse maternity pay if 'the performer on leave is entitled to that leave under… a contract of employment'.
BMA 2015 research grants for medical practitioners
Applications are invited from medical practitioners and/or research scientists, for research in progress or prospective research. The 2015 research grants will be available to apply for online on the BMA website from 09 December this year. The application deadline is 09 March 2015 at 5pm.

New Guidance on DNACPR
A recent court ruling may affect the way you approach DNACPR forms. The BMA, Resuscitation Council (UK) and Royal College of Nursing have jointly issued new guidance called 'Decisions Relating to Cardiopulmonary Resuscitation' which takes into account developments in clinical practice and developments in the law regarding anticipatory decisions about CPR.
Some of the key issues are detailed below:
· If a patient has capacity there is no need to involve any other individual, unless they so wish.
· In patients without capacity, merely ticking the box on the form to say they do not have capacity is only acceptable if an assessment of capacity has been carried out and documented in the patients records on the day the form was signed.
· A person is unable to make the decision for himself if he is unable to:
· Understand the information relevant to the decision.
· To retain the information.
. To use or weigh the information as part of the process of making the decision, or to communicate the decision (in whatever way is appropriate). (Ref - Mental Capacity Act 2005, Code of Practice)
· If in your opinion the patient does not have a capacity a ‘best interest process’ should be followed, whereby the GP should consult with family members and the care home staff as appropriate. Failure to do this may leave you open to litigation.
GP practices will be paid £60 per home visit to patients registered with an out-of-area practice
The enhanced service, designed by NHS England, will support the updated choice of GP practice arrangements that will be introduced from 5 January 2015. From this date, all practices will be able to register patients who live outside of their traditional boundaries, without being required to provide home visits or out-of-hours care.
Practices will not be obliged to participate in the scheme, and will remain able to refuse registrations from out-of-area patients. They will also not be obliged to offer home visits for patients registered elsewhere. Any patient who requires ‘urgent and local care’ and cannot reasonably travel to their out-of-area practice will be able to access primary medical services nearer their home, under the new enhanced service.
Practices participating in the DES will be expected to provide home visits to registered out-of-area patients in their appointed boundary area, where it is clinically required. If any practice chooses not to sign up for the DES, neighbouring practices that have signed up may have to provide services for wider areas. In such circumstances, national pricing does not apply and would be ‘agreed locally’.
Patients registered out-of-area will be given a review to decide whether it would be more appropriate for them to be registered with a practice nearer their home, should they arrange at least four consultations under the DES within a 12-month period. This will also be triggered if they receive two home visits within the same period.
Only practices that currently maintain an open list will be eligible to sign up to the DES. Existing GP health centres and walk-in centres that already provide unregistered patient services will be ineligible.
