The Centralia School District is requesting price bids for approximately 437,000 half pints of milk products to be delivered as required during the 2014-2015 school year.

Bids will be received until 1:00 p.m., April 9, 2014 at the Administration Office located at 2320 Borst Ave, P.O. Box 610, Centralia, WA 98531. Any bid received after that time will not be considered and will be returned unopened to the bidder. The District reserves the right to reject any and all bids made, waive informalities to the bids.

No company may withdraw or alter their bid after the hour set for the opening until and unless the award of the contract is delayed for a period of more than forty-five (45) days from the opening. Bids will be evaluated with bid pricing of its food service contractor. The Board reserves the right to waive any informality or irregularity in any bid received and to accept the bid which in its judgment is in its own best interests.

1. Interpretation

Questions regarding specifications should be addressed to Kathy Bridges, Purchasing, (360) 330-7600 or Mike Young, Food Service Director, (360) 330-7626. Questions will be answered by addendum to all bidders. All addenda issued during the time of bids will be incorporated into the contract.

2. Submission of Bids

Bids shall be enclosed in a sealed envelope with the name of the company on the upper left hand corner and "Milk Products Bid, (date)" across the bottom. Bids are to be delivered to the Centralia School District; 2320 Borst Avenue; Centralia, WA 98531 and must be received by 1:00 p.m. April 9, 2014. Facsimile bids will not be accepted. All bids are to be made on the form printed.

3. Signature

Each bid must be signed in longhand by the bidder with his usual signature. Bids by partnerships must be signed with the partnership name by one of the partners, followed by the signature and designation of the partner signing. Bids by corporations must be signed with the legal name of the corporation followed by the signature of the person authorized to bid on the matter. The name of each person signing shall be typed or printed below the signature.

4. Specifications and Alternates

The bids shall be based on the attached specified products.

5. Quantities

Quantities indicated are estimated and subject to increase and decrease on any item listed herein with the understanding that the price per unit will apply to the revised quantity.

6. Terms of Contract

Deliveries are to be made to the specified locations for the 180 days of the 2014-2015 school year. The pricing of this contract becomes effective August 1, 2014 and terminates July 31, 2015. The District will accept bids for both fixed prices and with an escalator. Pricing is to be based on the Advanced June on the USDA Federal Milk Order for the Pacific NW, scheduled to be released February 2014. (see www.fmmaseattle.com). The District reserves the right to add additional locations/schools and extend the agreement to cover summer or other special programs.


7. Invoices and Payments

A numbered, itemized invoice or delivery ticket will be made at the time of each delivery and signed by a designee of the District. A statement will be issued weekly or monthly covering all activity during the period. Payment will be made on a monthly basis by the District or its agent.

in refrigerated trucks with the frequency of three times per week. Milk will be placed in coolers by the supplier; rotated with older stock in the front; and will not be greater than an internal temperature of 40 degrees Fahrenheit.

10. Credits

Unused milk may be left at the buildings under refrigeration except during the winter holiday, spring vacation, or during other periods when school may be closed for longer than five days. Full credit shall be given for unused milk during any of the above periods and at the end of the school year. Sour milk and leakers are to be replaced by the dairy. The district will make a reasonable attempt to cooperate with the successful company to minimize the amount of credit milk during the above period(s).

11. Basis

Bids will be submitted on the basis of delivery to the locations specified and will be the net price per unit. Bid pricing will be fixed for the term of this agreement.

Sales tax, if any will not be included in the bid price. If there is a prompt payment or other trade discount, please specify the terms on the bid form. Prompt payment discounts will not be considered when evaluating bids, however discounts will be taken if payment is made within the discount period.

12. Awards

The District reserves the right to reject any or all bids submitted, to deviate from the total low bid on the basis of its evaluation of quality and service, and to make an award to the bidder who best serves the interest of the Centralia School District.

The District’s bid evaluation will be based on the pricing for Items 1 and 2, (1% and Non-fat Chocolate Milk) in the Product Specifications. If a vendor does not produce those types, the milk with the next higher butterfat content will be used in evaluating the bid.

13. Escalator Pricing

The district will accept bids with escalator pricing. The escalator price must be based upon monthly changes in the USDA Federal Milk Order (FMO) for the Pacific Northwest. All price changes over the term of this agreement must be verified with a copy of the FMO.

The successful bidder will, at the districts request, explain any change in pricing for milk purchased under this contract. The changes must be made monthly following the issuance of the FMO. Notifications of price increases or decreases will be sent to the District Business Office five days before any change.

14. Termination for Default

The District, by written notice, may terminate this contract, in whole or in part, for failure of the successful bidder to perform any of the provisions herein. In such event, the bidder shall be liable for damages, including the excess cost of re-procuring similar supplies; provided that, if it is determined for any reason that the vendor was not in default or the vendor's failure to perform is without their control, fault or negligence, the termination shall be considered a termination for convenience.

15. Termination for Convenience

The District may terminate this contract, in whole or in part, when it is required by, or in its best interests.

16. Affirmative Action Program

During the performance of this contract, the vendor is required to follow the District’s policy of Affirmative Action Program which is to promote the objectives of the Equal Employment Opportunity Commission's Guidelines as set forth in the Equal Employment Opportunity Act of 1972; Presidential Executive Order 11246, of September 24, 1965; and applicable State (Washington, Oregon, and Idaho) laws and legal mandates. The goal of this program is to ensure equal employment opportunities for all persons without regard to race, color, age, creed, national origin, religion, sex, or physical requirements not constituting a bonafide occupational qualification. It will be the vendor's responsibility to obtain the specific requirements of this program and implement them accordingly, or be subject to contract termination and suspension from future contracts. The vendor will certify on “Attachment E” that they will comply with the intent and the letter of the above statutes.

17. Certification Regarding Debarment

As a condition of the award, bidders must complete Attachment B, USDA Certification Regarding Debarment.

18. Pricing

Per Federal procurement rules, 7 CFR 3013.369(c) and CFR 3019.43, cost plus a percentage of cost method shall not be used.

All items that have a manufacturing pull date will be delivered as soon after the bottling date as possible. All items will be manufactured in accordance with all applicable State and Federal food and health standards.

Instructions for Certification

1. By signing and submitting this form, the prospective lower tier participant is providing the certification set out on the reverse side with accordance with these instructions.

2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.

3. The prospective lower tier participant shall provide immediate written notice to the person to which this proposal is submitted if at any time the prospective lower tier participant learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
