Corson County Commission Proceedings June 9, 2015

The Corson County Board of County Commissioners met in the Commissioner Room of the Courthouse on June 9, 2015. Chairman Stephen Keller called the meeting to order at 9:15 a.m. with Commissioners Shawn Hinsz and Edward Schock present. Darren Bauer and Donald Pazie were absent.

Approve Minutes

All voted in favor of a motion by Schock, seconded by Hinsz, to approve the minutes of the May 5, 2015 meeting.

Approve Agenda

All voted in favor of a motion by Hinsz, seconded by Schock, to approve the agenda as presented.

Highway Report

Discussion was held on gravel, road conditions, speed limit signs, and Keldron Road project. No action taken.

Superintendent Schell presented a quote from Jensen Rock & Sand, Inc. for the paving and sealing of courthouse parking lots in the amount of $24,865.00. Following discussion, all voted in favor of a motion by Schock, seconded by Hinsz to accept the bid from Jensen Rock & Sand.

Township Bonds

All voted in favor of a motion by Schock, seconded by Hinsz, to approve the following township bonds:

Budget

Discussion was held on insurance renewal rates. Consensus was to figure a 25% increase in premium for 2016 budgeting purposes.

Cell Phone Policy

All voted in favor of a motion by Hinsz, seconded by Schock to implement the following wireless telecommunication device policy effective immediately and make it a part of the personnel handbook.

WIRELESS TELECOMMUNICATION DEVICE POLICY

Corson County recognizes that wireless telecommunication devices are necessary conveniences of the business world and may be sole personal phone for county employees. However, deadly crashes involving drivers distracted by using wireless telecommunication devices, including without limitation text messaging, highlight a growing danger on the roads nationwide. Use of a wireless telecommunication device causes drivers to take their eyes off the road and at least one hand off the steering wheel, endangering themselves and others. Corson County requires that our employees follow the policy set below for their own safety and the safety of others.

1.  Definition:

(A)  “Wireless communication device,” any wireless electronic communication device that provides for voice or data communication between two or more parties, including a mobile or cellular telephone, a text messaging device, a personal digital assistant that sends or receives messages, an audio-video player that sends or receives messages, or a laptop computer. A wireless communication device does not include global positioning or navigation system (GPS) used to receive driving directions.

(B)  “Voice operated or hands free technology,” technology that allows a user to write, send, or listen to a text-based communication without the use of either hand except to activate, deactivate, or initiate a feature or function; and

(C)  “Write, send, or read a text-based communication,” using an electronic wireless communications device to manually communicate with any person using text-based communication including communications referred to as a text message, instant message, or electronic mail.

(D)  “Electronic message” means a self-contained piece of digital communication that is designed or intended to be transmitted between physical devices. The term includes e-mail, a text message, an instant message, a command or request to access a worldwide web page, or other data that uses a commonly recognized electronic communications protocol. The term does not include:

(1)  Reading, selecting, or entering a telephone number, an extension number, or voice mail retrieval codes and commands into an electronic device for the purpose of initiating or receiving a telephone or cellular phone call or using voice commands to initiate or receive a telephone or cellular phone call;

(2)  Inputting, selecting, or reading information on a global positioning system device or other navigation system device;

(3)  Voice or other data transmitted as a result of making a telephone or cellular phone call; or

(4)  Data transmitted automatically by a wireless communication device without direct initiation by an individual.

2.  Employees are not permitted to use a wireless communication device to write, send, or read a text-based communication while operating a motor vehicle. Corson County has a zero tolerance policy regarding using wireless communication devices while driving. Safety must come before all other concerns.

3.  The prohibition set for in ¶2 above does not apply to an employee who is using a handheld electronic wireless communication device:

(A)  While the vehicle is lawfully parked;

(B)  To contact any emergency public safety answering point or dispatch center;

(C)  To write, read, select, or enter a telephone number or name in an electronic wireless communications device for the purpose of making or receiving a telephone call; or

(D)  When using voice operated or hands free technology.

4.  Employees who are charged with traffic violations resulting from the use of their phone while driving will be solely responsible for all liabilities that result from such actions.

5.  Violations of this policy will be subject to the highest forms of discipline, including termination.

6.  Corson County reserves the right to amend or alter the terms of this policy.

Notary

Consensus of the Board was to have Treasurer Heather Gall proceed with becoming a notary public.

4-H

Dawne Donner met with the commission to discuss upcoming 4-H events, 4-H Club checking account, and repairs needed at 4-H building. The Corson County Fair is scheduled for August 7th-9th.

Register of Deeds

Diane Anderson informed the board that Sherry Ternes, Deputy Register of Deeds, will begin employment on June 15th.

Malt Beverage Hearing

Ray Maxon, Jess Maxon, and Jim Peetree representing T-Spoons Corner were present for the malt beverage license renewal hearing. States Attorney, Eric Bogue appeared telephonically. Following discussion, all voted in favor of a motion by Hinsz, seconded by Schock, to table the renewal of the following license until July 7, 2015:
